off of Highway 82 on County Road 114. Physical address is
3000 County Road 114.
Planned Unit Development (PUD)
I. BACKGROUND - DESCRIPTION OF PROPOSAL
Colorado Mountain College is proposing the construction/installation of a
telecommunication tower on the Spring Valley Campus to improve cellular telephone
coverage for the college. The tower will significantly improve communication seruices
for students, staff, public visitor usage, safety and access to 911 emergency response.
The CMC Campus is approximately 811 acres in size.
The initial plans have identified a location adjacent to the cotlege's water storage tank
on the eastern poftion of the campus. A site plan map and vicinity maps have been
provided. The location is separated from the active portions of the campus and
generally located away from improvement on adjoining properties. The tower plans are
for installation of a 56 ft. tall free standing monopole tower described as a "Lite-Site
Quick Deploy Cell Site". The facility will be located within an approximately 50 ft. by 50
ft. lease area. Characteristics of this type of tower include quick construction, minimal
site disturbance, small diameter monopole design, minimal visual impacts and reduced
loading on the tower with less of a base foundation system required. The tower will
have electrica! power extended to the site and minor support facilities will include
communication cables and an equipment shed or cabinet. The tower site may be
fenced for security. The College is working with a telecommunications consultant,
Comnet Four Corners LLC for the development and design of the facility.
The site selected for the tower has existing vegetation and trees and is adjacent to the
Colleges primary water tank which is approximately 50 ft. in height to the top of the tank.
II. AUTHORITY - CRITERIA
A. The request is being considered in accordance with Garfield County Land Use
and Development Code, Section 4-111 Location and Extent Review. The review
criteria for a location extent is noted below.
Location and Extent Review Criteria - Section 4-1ll (C)
The Planning Commission shall determine whether the project is in general
conformance with the Comprehensive Plan.
B. Decision making authority for Location and Extent Review is with the Planning
Commission and the Commission may approve or disapprove of the request based on
the above criteria. A finding of disapproval may be appealed in accordance with the
Colorado Revised Statutes. A Planning Commission Resolution formatizing the
Commission's action will be prepared.
C. The basis for the Location and Extent Review is found in the Colorado Revised
Statutes (530-28-1 10(1)(a)) that requires ...Whenever any county planning
commission...has adopted a master plan of the county...no road, park, or other public
way, ground, or space, no public building or structure, or no public utility, whether
publicly or privately owned, shall be constructed or authorized in the unincorporated
territory of the county until and unless the proposed location and extent thereof has
been submitted to and approved by such county planning commission.
D. Typically a Location and Extent Review does not include conditions of approval
based on the singular review criteria and finding. Additional review with the County
Attorney's Office has determined that conditions of approval relevant to the review
criteria may be appropriate and can be included in the Planning Commission decision
on the Location and Extent Review.
III. STAFF REVIEW AND ANALYSIS
1. Public notice required for the Location and Extent Review included publication,
posting, and ceftified mailing to propefty owners within 200 ft. and mineral right owners.
The Applicant has also conducted a neighborhood information meeting. No public
comments have been received at this time.
2. The Garfield County Comprehensive Plan 2030 designates the site as Village
Center. lt also is included in a Water and Sewer Service Area. Excerpts from the
Comprehensive Plan applicable to the request are outlined below in italics with Staff
analysis shown in bold:
Chapter 2 Future Land Use - Growth in Designated Centers - Village Centers
Vittage Centers are aileas where there is a concentration of residential development and
commercial development that is intended primarily for the convenience needs of
surrounding residential development. This mix of uses may include educational,
institutional and civic uses.
The expansion of infrastructure for the CMC Campus to include improved cellular
telecommunication is consistent with the designation as a Village Center. ln the
case of CMC the uses are primarily educational and institutional, including
student housing and services. lmproved emergency response and access to 911
services is also consistent with the Village Center Designation and an
improvement benefitting the health, safety and welfare of the residents of the
County.
Chapter 3 Urban Growth Areas and lntergovernmentalCoordination
/ssue No. 5: The County is not well set up to provide urban seruices organizationally or
fiscally. Therefore, another entity is required to provide seruices if and where urban
types of development occur in the unincorporated areas - either a municipality, a special
district or metropolitan seruice district.
ln this case CMC is moving forward independently to provide the upgraded
service which will be available to the general public (see propagation map in the
submittals)
Chapter 3 Section 4 - Economics, Employment and Tourism
Vision: The County has encouraged economic opportunity and diversity to develop in
strategic locations by designating a variety of areas as employment and commerce
centers....The County has played a key role in providing traditional and communication
infrastructure to specific commerce centers.
Modern communication infrastructur'e needs include cellular telephone and
telecommunication service not in existence when the College was originally
formed. The CMC Campus is an important component of Garfield County's
economy and economic development.
Chapter 3 Section 8 - Natural Resources
lssue No.l: Tourism is an integral component of the economy of Gartield County.
Therefore, it is important for economic development to respect the natural environment
that brings residents and visitors to the county
The proposed tower is designed to reduce visibility and impacts on scenic views.
It will be located on a portion of the PUD already developed with infrastructure
improvements (water tank).
3. Review of the existing CMC PUD Zoning with the County Attorney's Office has
identified that an amendment to the PUD to allow for the telecommunication tower is
also needed. An Application for a Minor PUD Modification has been filed with the
County and is subject to an Administrative Review Process. lt is being reviewed
concurrently with the Location and Extent Application.
tv.SUGGESTED FINDINGS FOR APPROVAL
The following suggested findings for approval of the Location and Extent request make
reference to the approval criteria contained in Section 4-111 (C) of the Land Use and
Development Code:
Location and Extent Beview Criteria - Section 4-ll1 (C)
The Planning Commission shall determine whether the project is in general
conformance with the Comprehensive Plan.
Suggested Findings for Approval
1. That proper public notice was provided as required for the hearing before the
Planning Commission.
2. That the hearing before the Planning Commission was extensive and complete,
that all peftinent facts, matters and issues were submitted or could be submitted
and that all interested parties were heard at that hearing.
3. That for the above stated and other reasons, approval of the Location & Extent
request by the Colorado Mountain Junior College District for a
Telecommunication Tower is in the best interest of the health, safety, and welfare
of the citizens of Garfield County.
4. That the Location and Extent request has been determined to be in general
conformance with the Comprehensive Plan 2030, as amended.
5. That the Location and Extent request is in conformance with the Review Criteria
contained in Section 4-111, Location and Extent of the Garfield County Land Use
and Development Code, as amended.
6. The determination of General Conformance is based on the Applicant's
representations in their Application submittal and at the public hearing before the
Planning Commission.
V. PLANNING COMMISSION ACTION
Staff suppotts an approva! of the Location and Extent request by the Planning
Commission subject to the suggested findings and the following conditions of approval.A resolution of the Planning Commission will be prepared consistent with the
Commission's motion and the Commission's action is the final decision unless
appealed. The Commission's motion should include authorization for the Chairman and
Secretary to sign the resolution.
1. That all representations made by the Applicant in the Application shall be
conditions of approval unless specifically altered by the conditions of approval contained
herein.
2. That the Facility shall be operated in accordance with all applicable Federal,
State, and local regulations governing the operation of this type of facility including any
FCC and FAA regulations.
3. Prior to construction of the facility the Applicant shall obtain a Minor PUD
Amendment to the CMC PUD to add Telecommunication Tower as a permitted use.
4. The facility shall utilize non-glare neutral colors to lessen visual impacts and no
lighting is proposed for the facility.
