Amendment to a Limited Impact Review Land
Use Change Permit for a Water
Impoundment, Material Handling, Processing
and Storage (Water Management Facility) —
Garfield County File Number LPAA-12-15-

This letter is being provided to you as the authorized representative for WPX
Energy Rocky Mountain, LLC in regard to an amended to an approved Limited
Impact Review Application for a Water Impoundment, Material Handling,
Processing and Storage, known as the Parachute Water Management Facility and
as represented in Exhibit A. The Water Impoundment, Material Handling,
Processing and Storage facility is located north of the Town of Parachute on
property also known by Assessor's Parcel No. 2171-363-00-007.
This Application has been reviewed in accordance with the Land Use and
Development Code, Section 4-106 "Amendments to an Approved Land Use
Change Permit". The provisions of this Section provide for a Decision by the
Director of the Community Development Department as to whether the proposed
amendment is a Minor Modification or Substantial Modification.
Based on the criteria found in Section 4-106(C), the Director has found your
amendment request to be a Minor Modification and has approved your requested
amendment subject to the following conditions:

1. That all representations of the Applicant contained in the Amendment
Application submittals including the revised site plan (attached as Exhibit 1) shall
be conditions of approval unless specifically amended or modified by the
conditions contained herein.
2. All previous conditions of approval contained in the Land Use Change
Permit (reception number 867980), attached as Exhibit 2, shall remain in full force
and effect.
3. The Applicant shall maintain compliance with all standards as required by
the Land Use and Development Code of 2013, as amended.

A Portion of a Parcel of Land Owned by WPX Energy Rocky Mountain, LLC
Located Northeast of the Town of Parachute Off U.S. Highway 6 and 24 in
Portions of Section 35 and 36, Township 7 South, Range 96, West of the 6th
P.M., Garfield County with a Project Area of Approximately 37.62 acres Within
an Overall 383.78 acre Property
(Assessor's Parcel No. 2171-363-00-007)
In accordance with and pursuant to provisions of the Garfield County Land Use and
Development Code of 2013, as amended, and a Resolution of Approval (Resolution
Number 2014-71) of the Board of County Commissioners of Garfield County, State of
Colorado, the following activity is hereby authorized by Land Use Change Permit:
WATER IMPOUNDMENT, MATERIAL HANDLING, PROCESSING AND
STORAGE (WATER MANAGEMENT FACILITY), ON A 37.62 ACRE PORTION
OF A 383.78 ACRE PROPERTY (LIPA-8048)
This Land Use Change Permit — Lim ted Impact Review is issued subject to conditions of
approval as set forth in Exhibit "B" and shall be valid only during compliance with such
conditions and other applicable provisions of the Garfield County Land Use and
Development Code, as amended, Building Code, and other regulations of the Board of
County Commissioners of Garfield County, Colorado.

Conditions of Approval
Conditions Prior to Issuance
I. Thc Applicant shall demonstrate that all improvements have been madc
to the access road which are consistent with the Secondary Access
standards outlined in Section 7-107. Demonstration that these
improvements are complete shall be submitted and reviewed by the
Garfield County contract engineer prior to issuance of the Land Use
Change Permit.
2. The Applicant shall submit the new CDOT access permit once it is issued.
The new access permit shall be reviewed by the Garfield County contract
engineer prior to issuance of the Land Use Change Permit.
3. The Garfield County Community Development Department is authorized
to issue the Dewatering Operations Area Building Permit number BLCO-
8-14-3350 within 3 -days following signature of the Resolutior. of
Approval.
4. WPX Energy is authorized to conduct road/drainagc improvements work,
access to Highway 6 improvements and grading for the Dewatering
Operations Area Building, as described in the Applicant's submittal, prior
to issuance of the Garfield County Land Use Change Permit.
Other Conditions
5. That all representations made by the Applicant in the application shall be
conditions of approval, unless specifically altered by the Board of County
Commissioners.
6. That the operation of the Water Impoundment, Material Handling,
Processing and Storage facility shall be done in accordance with all
applicable Federal, State, and local regulations governing the operation of
this type of facility.
7. The facility shall maintain compliance with Storni Water Management
Plan, Drainage and Grading Plans and Reclamation for the site.
8. The Applicant shall control fugitive dust during the operation of the site.

9. The facility shall maintain compliance with Section 7-306 Lighting, with
all lighting to be directed inward and downward toward the interior of the
site. Facilities shall bc painted a non -glare neutral color to lessen any
visual impacts.
10. The Applicant shall comply with the submitted Noxious Weed
Management Phut including the best management practices.
11. The hours of operation for the site shall be 24 hours per day, 7 days per
week.
12. No parking shall be permitted along the access road in order to ensure
atierpate fire protection access.
13. A minimum of a 500 gallon fresh water cistern shall be maintained with
wale: to supply the restroom facility.. The water shall be provided by a
licensed water hauler.
