in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood Springs on Monday,
the 13th day of November A.D. 2000 there were present:

A RESOLUTION CONCERNED WITH THE APPROVAL OF A ACCESSORY DWELLING UNIT
SPECIAL USE PERMIT APPLICATION FOR RANDAL AND CECILIA HARMON.
LEGAL DESCRIPTION
LOT 13, ROCK CREEK SUBDIVISION. 0574 CRYSTAL RIVER ROAD, CARBONDALE, COLORADO.
WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received
application from Randal and Cecilia Harmon, concerned with a Accessory Dwelling Special Use Permit
to allow for the construction of an Accessory Dwelling Unit;
WHEREAS, the Board held a public hearing on the 13th day of November, 2000, upon the question
of whether the above-descnbed Accessory Dwelling Unit Special Use Permit should be granted or denied,.
at which hearing the public and interested persons were given the opportunity to express their opinions
regarding the issuance of said Special Use Permit; and
WHEREAS, the Board on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following determination of fact:
1. That proper public notice was provided as required by law for the hearing before the Board
of County Commissioners.

2. That the hearing before the Board of County Commissioners was extensive and complete,
that all pertinent facts, matters and issues were submitted and that all interested parties were
heard at that hearing.
That for the above stated and other reasons, the proposed Special Use Permit is in the best
interest of the health, safety, morals, convenience, order, prosperity and welfare of the
citizens of Garfield County.
4. That the application is in conformance with the Garfield County Zoning Resolution of 1978,
as amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
County, Colorado, that the Accessory Dwelling Unit Special Use Permit be and hereby is approved to allow
for the construction of an Accessory Dwelling Unit, upon the following specific conditions:
1. That all representations of the applicant, either within the application or stated at the hearing
before the Board of County Commissioners, shall be considered conditions of approval..
2. Section 5.03.21 of the Garfield County Zoning Resolution, 1978, as amended, be complied
with by the applicant.
3. The two conditions in the letter dated July 29, 2000, from the Rock Creek Homeowner's
Association, included in the application submittal, which state:
1) Per the Protective Covenants of Rock Creek Subdivision, Item 1 (A), states that No
lands within said Subdivision shall be occupied for or used for any commercial or
business purpose.
2) Approval is subject to your acquiring all necessary permits, approvals and
inspections (including septic) required by Garfield County.,
must be complied with by the applicant.
4. The requirement of the September 8, 2000, letter from the Rock Creek Homeowner's
Association, which states, "Their requested accessory dwelling unit will be furnished water
from our water system provided that they have obtained all required permits from all
applicable agencies.", bolding added for emphasis, must be complied with by the applicant.
5. Any violation of the terms, interpretations or agreements made or represented to Garfield
County by the applicant pertaining to or included in this Special Use Permit, shall be
considered a breach of the terms of conditions and the applicant shall cease and desist all
activities and may be subject to revocation of the Special Use Permit.

for
SINGLE FAMILY DWELLING CONSTRUCTION

NEW CONSTRUCTION
ADDITIONS
ALTERATIONS

MOVED BUILDINGS
In order to understand the scope of the work intended under a permit application and expedite the
issuance of a permit it is important that complete information be provided. Adequate and complete
information will prevent delays in the plan review process. Reviewing a plan and the discovery that
required information has not been provided by the applicant may result in the delay of the permit
issuance and in proceeding with building construction. The owner or contractor may be required to
provide this information before the plan review may proceed. This causes delays because other plans
that are in line for review may be given attention before the new information may be reviewed after
it has been provided to the Building Department.
Please review this document to determine if you have enough information to design your
project and provide adequate information to facilitate a plan review. If you do not, it may be
helpful to obtain a book titled "Dwelling Construction under the Uniform Building Code".
This book is available to you through this department at our cost. Also, please consider using
a design professional for assistance in your design and a construction professional for
construction of your project.
To provide for a more understandable plan in order to determine compliance with the building,
plumbing and mechanical codes, applicants are requested to review the following check list prior to
and during design. Applicants are required to indicate appropriately and to submit the completed
check list at time of application for a permit.

Plans to be included for a Building Permit, must be on drafting paper at least 18"x24" and drawn to
scale.
Plans must include a floor plan, a concrete footing and foundation plan, elevations all sides with
decks, balcony, steps, hand rails and guard rails, windows and doors, including the finish grade line.
A section showing in detail, from the bottom of the footing to the top of the roof, including re -bar,
anchor bolts, pressure treated plates, floor joists, wall studs and spacing, insulation, sheating, house -
rap, (which is required), siding or any approved building material.
A window schedule. A door schedule.
A floor framing plan, a roof framing plan, roof must be designed to withstand a 40## per ft. up to
7,000 F.O.S. and an 80 M.P.H. wind.
All sheets to be identified by number and indexed. All of the above requirements must be met or your
plans will be returned.

If you have answered "No" on any of the questions, you may be required to provide this information
at the request of the Building Official prior to beginning the plan review process. Delays in issuing
the permit are to be expected. Work may not proceed without the issuance of a permit. If it is
determined by the Building Official that additional information is necessary to review the application
and plans to determine minimum compliance with the adopted codes, the application may be placed
behind more recent applications for building permits in the review process and not reviewed until
required information has been provided and the application rotates again to first position for review,
delay in issuance of the permit or delay in proceeding with construction.

Thank you for the letter replying to my phone call. At the time of my phone call I thought your permit
was still active. After reviewing the file and talking with the building official, (Andy Schwaller) it appears
your permit has already been cancelled. You received your money back last time because your permit
had already expired. At this point if you wish to finish this project you will need to resubmit your plans
for review and permitting. You do not need to do this until you have the time and money to finish the
project.
