CU 81601 office: 970-94i.R212 Far: 970-38t-3474 Reference: Administrative Review —Suma ADU, File Number GAPA-12-15-8411 Dear Eric; The Department of Community Development has reviewed the additional submittal materials related to the request for the Suma ADU. This site if located on Lot 9 of St. Finnbar Farms Subdivision at 24 St. Finnbar Farm Road. The application has been determined to be technically complete pursuant to the submittal requirements in the 2013 Land Use and Development Code, as amended (LDDC), which determination allows the process to proceed. The next step is to set a decision date, then to execute the notice requirements. A Director Decision date has been set for February 19, 2016 at which time a decision will be issued on whether to approve, approve with conditions or deny the application. It is your responsibility as the Applicant to complete the required 15 -day public notice requirement. Please mail the attached Notice Form, certified mail to adjacent properties within 200' of the subject lots, and certified mail with return receipt to any mineral owners of the subject sites. You must provide both proof of mailing and proof of receipt (for mineral owners) prior to the Director Determination on the application. The notice is required to be sent at least 15 days prior to the date of Director Determination (mailed by February 3, 2016 at the latest). An outline of the review process is provided: 1. The Director Decision is set for February 19, 2016; 2. You must send the Public notice by February 3rd in order to meet the minimum 15 day time requirement for notice; 3. A request will be sent to the St. Finnbar Farms Homeowner's Association/Architectural Review to review and provide comments on the request; 1 4. The planner will review the submittal materials and provide comments on any required additions or modifications; 5. On February 19, 2016 the Director will issue the decision (upon receipt of the affidavit of proper noticing, attached) and notify both the applicant and the Board of County Commissioners (BOCC) of the decision. The BOCC has the ability to "call-up" the application for a public hearing. We are required to give the BOCC 10 days to review and determine if the application should be called -up for hearing (deadline February 29, 2016). Upon expiration of the call-up period without a request for call-up, the decision is final. The Applicant can then work to address any conditions of approval or, if none, the Land Use Permit can be issued.
