Page Spracher From: Megan Sullivan, P.E., Water Resource Engineer Re: Permit No. 102611 — Clarification of allowed uses The well located on lot 1 of Homestead Ranch, in Garfield County, is currently permitted under permit no. 102611. This permit was issued on October 12, 1978 and approved as the only well on a tract of 35.01 acres in the SE 1/4 of the NE 1/4 of Section 36, Township 6 South, Range 88 West also described as Tract 1 of Homestead Estates. The use of the well is limited to domestic use, including the irrigation of not over one acre of home gardens and lawns. You requested clarification on the domestic use of this well. Since the well permit was issued for a tract of 35 acres or more pursuant to C.R.S. 37-92-602(3)(b)(II), the domestic use would include ordinary household purposes in up to three (3) single family dwellings. Since the well was constructed prior to the expiration date, this permit is valid. Please note that based on county records, a portion of the 35 acres encumbered by this well permit now overlaps a portion of an adjoining 7.677 acre parcel, that you also currently own. Because of this overlap by a valid well permit, a permit that is exempt from administration pursuant to C.R.S. 37-92-602(3)(b)(II)(A) (typically known as an exempt household use only well permit) cannot be issued for that 7.677 acre parcel. Should you or a future owner wish to construct a well on the 7.677 acre parcel in the future, a well permit that is issued as not exempt from administration and operates pursuant to a water court approved plan for augmentation, would have to be obtained.
