We are submitting a draft of amended plat Lot 2 Elder Subdivision/ A
resubdivision of a portion of Ranch at Roaring Fork 4 filing 3. In August, 6 of the lot owners ,
collectively,received a wetland delineation verification (see adjoining letter). As a result of
the new wetland delineation lot 2 (as well as one other lot ) had wetlands in the existing
building envelope. We , the owners of lot 2 , decided to amend our plat , since the existing
wetlands area within our building envelope was minimal'

Dear Ms. Wade,
This letter is in response to your application for an Amended Plat for Lot 2 of the Elder
Subdivision, as submitted to Garfield County. Staff has completed a Technical Compliance
review of your application, and has not found it to be in Technical Compliance. This means that
additional information is required for staffto review the application. The following items need to
be submitted:
l. Garfield County subdivision regulations 6:10 (A, B, C) state that the following
information regarding the proposed amended plat shall be frled with the application:
A. Copy of the deed showing ownership in the applicant, or a letter from the
property owner(s), if other than the applicant;
B. Names and addresses of owners of record of land immediately adjoining ond
within two hundredfeet (200') of the proposed amended plat, mineral owners
and lessees of mineral owners of record of the property to be a part of the
amended plat, and tendnts of any structure proposedfor conversiou (You
may obtain this information at the Garfield County Assessors offrce. Please
also provide a map showing the location of the neighboring land owners),'
C. Evidence of the soil types and characteristics of each type.
Please submit the above detailed information for staff to review for Technical Compliance. Once
your application is found to be in Technical Compliance, a public hearing will be scheduled and
staffwill conduct a review of the application for compliance with County regulations. You also
should be made aware that this application is subject to public notice requirements. After the
above information is received, I will send you detailed information on completing the proper
public notice requirements for this application.

RESOLUTION NO.92-109
A RESOLUTION CONCERNED WITH THE APPROVAL OF A FLOODPLAIN SPECIAL USE
PERMIT APPLICATION FOR JOHN ELDER.
WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received
application from John Elder for a Floodplain Special Use Permit to allow for the placement of frll &
compensatory measures within the regulated floodplain on the following described tracts of land:
Located in Sections 25 and 36, T7S, R88W, Ranch at Roaring Fork, Phase IV, Filing III
(in the State of Colorado and the County of Garfreld); and
WHEREAS, the Board held a public hearing on the l4th day of December 1992, upon the
question of whether the above-dfscribed Floodplain Special Use Permit should be granted or denied,
al which hearing the public and interested persons were given the opportunity to express their opinions
regarding the issuance of said Special Use Permit; and
WHEREAS, the Board on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following determination of fact:
1. That proper publication and public notice was provided as required by law for the
hearing before theiBoard of County Commissioners.

2. That the hearing before the Board of County Commissioners was extensive and
complete, tt ut utt pertinent facts, matters and issues were submitted and that all
interested parties were heard atthat hearing'
3. That the application is in compliance with the Garfield County ZonngResolution of
1978, as amended,
4. For the above sta{ed and other reasons, the proposed use is in the best interest of the
health, safety, morals, convenience, order, prosperity and welfare of the citizens of
Garfreld CountY.
NOW, THEREFORE, BE IT RESOLVED by the Board of county commissioners of Garflreld
County, Colorado, that the Special use Permit be and hereby is authorized perrnitting to allow for the
placement of f,rll & compensatorylmeasures within the regulated floodplain, upon the following specific
conditions:
l. All proposals of the applicant shall be considered conditions of approval unless stat''ed
otherwise by the Board of County Commissioners'
Z. All required building permits will be obtained. Elevation certificates will be required
to ensure that allstructures will be located at least one (l) foot above the floodplain line
indicated on the bluelines submitted with the application.
3. Driveways and roads will conform to Garf,reld County Road Standards.
4. Lot 11 ("Elder Lot") will appear on the Final Plat. A plat note will be included, as
follows:
"Lot 11 is considered unbuildable, subject to Army Corps of Engineers 404
perrnit and confonnance with Garfield County Floodplain Regulations, as
amended".
5. ASubdivision tmprovementsAgreementandappropriate securitywillberequiredprior
to approval of the Final Plat.
6. Fisherman easements and utility easements will appear on the Final Plat.
