The plan referenced below is an accurate depiction of the Iimits of Federal- jurisdiction under Section 404 of the Cl-ean Water Act and only reflect that jurisdiction within Tract A. As shown on the enclosed drawings, lfr" area of Tract A is approximately L.204 acres. Elder owns at the Ranch at the Roaring Fork, near Carbondale, Colorado. The property is locatedin Section 36, Township 7 South, Range 88 West, Garfield County, Colorado. Based on a site inspection by Dtr. Nick Mezei of this officeon June L3, L994, we determined that your wetland boundarydelineation is accurate. The plan titled Elder Amended Blat, anddated O9/L4/94 is an accurate depiction of the linits of Federaljurisdiction under Section 404 of the Clean Water Act. The Elder property contains wetlands in the immediatevicinity of the building envelopes. We appreciate the effortproposed by Mr. Elder in his November 3, L994 faxed letter tothis office, in which he stated that the verified wetland boundary will be placed on the final plat for Filing 3, Phase 4,Lots 47 through 63, Ranch at the Roaring Fork. He also statedthat deed restrictions will be incorporated into each Iot andparcel of the rrElder Propertyrt, to assure that current and future owners are made a!'rare of the location of wetlands on their Property, and the Clean Water Act Jurisdiction over the wetlands. We reconnend that prior to construction activity, the wetland boundary be clearly marked in the'field and that aL1 constructionpersonnel be j.nformed about avoiding any inpacts to the wetland areas at the risk of violating the Clean Water Act.
