Ms. Clifton:
Colorado River Engineering, Inc. has prepared this letter to address Garfield County's
water supply and distribution requirements for Peter Langegger in his construction of a
bathhouse building on his property referred to as the Turtle Tracks Riverfront Resort. A
vicinity map is attached as Figure 1. The new building will contain bathrooms, showers,
laundry, storage, fish cleaning, and related support amenities. In order to address the
requirements outlined in Section 4-203 (M) of the Garfield County Land Use and
Development Code, a 4 -hour pump test was completed on the well that will supply
water to the bathhouse. Along with the pump test, water quality tests were also
performed, as outlined in the County's Land Use and Development Code.
The well that is proposed to supply the bathhouse currently serves an existing structure
that houses two rental units. Reportedly the well has provided a reliable supply to the
existing structure. Our review of the existing well has shown that there is adequate
quality, quantity, and dependability for the existing use as well as the addition of the
proposed bathhouse building.
Legal Supply
There are a number of existing wells located on the Turtle Tracks Riverfront Resort
property. The uses for the existing wells, referred to as the Toler Well No. 1, the Wigger
Well, and the Wigger Replacement Well, include domestic use for six (6) residential
units and one (1) bathhouse, commercial use for one (1) garage/office and three (3) full
service RV hook-ups, and irrigation use for up to 5,000 sf of landscaping. The two (2)
new fish ponds on the property (Well Pond #1 -East and Well Pond #2 -West) will be used
for recreational and piscatorial purposes. The use of the wells and well ponds is
augmented by West Divide Water Conservancy District Augmentation Contract
#990527TCT(b). Copies of the current Well Permits, including the Well Pond Permits,
and a copy of the WDWCD contract are attached as Appendix A.

The total diversion outlined in the WDWCD contract is 4.275 acre-feet. The amount of
ground water to be withdrawn by the wells and stored by the well ponds shall not
exceed 4.275 acre-feet on an annual basis.
In addition to the wells mentioned above, there existed a permit for the Toler Well
No. 2. This well was permitted in 2014 as Permit 77906-F. As there are no plans to drill
this well, this permit has been canceled.
The new bathhouse will be served primarily by the Toler Well No. 1; however, there is
the potential for the bathhouse to be served by each of the wells on the property, as
outlined in Well Permit Numbers 78829-F, 78830-F, and 78910-F, see Appendix A.
Well Construction
The Toler Well No. 1 was originally permitted under Permit 52376-F. The well
construction was completed on September 30, 1999 to a depth of 37 -feet by Shelton
Drilling Corporation. At the time of construction the static water level was measured to
be 9 -feet and the well was constructed into the Wasatch Formation, as outlined in the
attached Well Construction and Test Report. A submersible pump was installed on
November 30, 1999 and the pump intake depth was 26 -feet. The pump was tested to
produce 15-gpm, as outlined in the attached Pump Installation and Test Report
completed by Aqua Tec Systems, Inc. The original Well Construction Report and the
Pump Installation and Test Report are attached as Appendix B.
The use of Toler Well No. 1 was amended in 2007 resulting in Permit 65799-F The well
permit was again amended in 2013 resulting in Permit 77905-F. The previous Well
Permits are attached as Appendix B.
The most recent Well Permit for Toler Well No. 1 was issued on 02/12/ 2015 as Permit
78829-F and is attached as part of Appendix A.
Well Yield Test
A drawdown test of the alluvial well was performed by Mark Hayes and Catherine Berg
of Colorado River Engineering on May 22, 2014 to analyze the yield of the well. The test
involved running a 4 -hour pump test to estimate water produced while monitoring
water levels in the well and the well's ability to recover.
Prior to the initiation of the well test, the initial static water level was measured to be 7 -
ft below the top of the well casing. The well casing is 54" (4'-6") above the ground level
on one side, and 56" (4'-8") above the ground level on the other side. A hose was
attached to the pressure tank located within the existing home and run outside.

At 11:15 am the hose was turned on at an initial rate of 4-gpm and subsequently
adjusted to 5-gpm by 15 -min into the test. The pumping rate had reduced to
approximately 3-gpm by approximately an hour into the 4 -hour test and it was then
readjusted to 5-gpm where it stayed for the remainder of the test.
Once the hose was turned on, the water level within the well fluctuated as the pump
turned on and shut off, recurring on approximately an 8 -min cycle. The water level
within the well initially dropped to a depth of approximately 18' below the top of the
well casing and then recovered to a depth of approximately 11'. As the test continued,
the water level dropped to up to 20' and recovered to a depth just over 14'. When the
hose was turned off the well was allowed to recover. The water depth within the well
was 10'-1" after 9 -min and the water level had fully recovered to its initial static level of
7' after only 13 -min.
During the test, the well produced approximately 1,140 gallons of water (4-gpm avg x
60 -min+ 5-gpm avg x 180 -min = 1,140 gallons); substantially more water than is required
for the existing residential use along with the additional uses for a bathhouse containing
bathrooms, showers, laundry, storage, fish cleaning, and related support amenities.
Although the water level in the well dropped during the 4 -hour test as the pump cycled
on and off, the long term use of the well indicates that the alluvial aquifer is recharging.
No impacts to surrounding groundwater resources are expected beyond historic
conditions.
The completion and analysis of the 4 -hour pump test satisfies Section 4-203(M)
(1)(b)(5)(a) in the Garfield County Land Use and Development Code.
Water Quality
The use of the well for the existing residential use and the addition of a bathhouse will
require compliance with Garfield County's water quality regulations. Therefore water
quality samples were retrieved from the hose that was attached to the pressure tank
and samples were sent to a testing laboratory for analysis.
The attached water quality laboratory results (Appendix C) show the results for all of
the contaminants outlined by the County in Section 4-203 (M)(1)(b)(5)(c) in the Garfield
County Land Use and Development Code.
Although the Colorado Department of Public Health and Environment's (CDPHE)
Colorado Primary Drinking Water Regulations (CPDWR) generally apply only to public
water systems and not to private water systems, the maximum contaminant levels
contained in the CPDWR were used for reference. All primary contaminants and water
quality parameters are within the State's established maximum contaminant levels as

outlined in the CPDVVR. The secondary contaminants and water quality parameters are
guidelines and generally affect aesthetic water quality. For those parameters that
exceed the secondary guidelines, Mr. Langegger may choose to provide treatment to
address the aesthetic issues, if desired.
The water quality testing completed satisfies Section 4-203(M)(1)(b)(5)(c) in the Garfield
County Land Use and Development Code.
It is our opinion that the water supply has adequate quality, quantity, and dependability

does not ensure that no injury will occur to another vested water right or preclude another owner of a vested water right from

of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation
Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-90-137(2), to change/expand the use of an existing well constructed under permit no.
77908-F, on the condition that this well is operated in accordance with the West Divide Water Conservancy District
Augmentation Plan approved by the Division 5 Water Court in case no. 02CW0123. If this well is not operated in
accordance with the terms of said decree, it will be subject to administration including orders to cease diverting water.
WDWCD contract #990527TCT(b). This well is known as the Wigger Replacement Well.
4) The issuance of this permit hereby cancels permit no. 77908-F.
5) The use of ground water from this well, in combination with Toler Well No.1 and the Wigger Well, is limited to ordinary
household purposes inside six (6) dwelling units, commercial, the irrigation of not more than 5,000 square feet of
landscaping, and water use for three (3) full service recreational vehicle (RV) hook-ups.
6) The pumping rate of this well shall not exceed 15 GPM.
7) The annual withdrawal of ground water from this well, in combination with Toler Well No. 1 and the Wigger Well, shall not
exceed 2.30 acre-feet.
8) The return flow from the use of this well must be through an individual waste water disposal system of the
non -evaporative type where the water is retumed to the same stream system in which the well is located.
9) The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court case
number(s) as appropriate. The owner shall take necessary means and precautions to preserve these markings.
10) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all
diversions must be maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon
request.
11) This well must be located not more than 200 feet from the location specified on this permit and at least 600 feet from any
existing well, completed in the same aquifer, that is not owned by the applicant (other than wells in which notification has
been received from this office, as indicated in the file).
12) The well was constructed and must be maintained in accordance with variance no. 2007-125A, granted by the Board of
Examiners of Water Well Construction and Pump Installation Contractors on September 21, 2007.

4) The combined average annual amount of ground water to be appropriated from Well Pond #1 (East) and Well Pond #2
(West) shall not exceed 1.76 acre-feet with the total surface area of Well Pond #1 (East) limited to 9,800 square feet.
5) The use of ground water, in addition to evaporation, is limited to piscatorial and recreation. No other use of water is
allowed unless a permit therefor is approved.
6) The owner shall mark the well (pond) in a conspicuous place with well permit number(s) and court case number(s) as
appropriate. The owner shall take necessary means and precautions to preserve these markings.
7) Pursuant to Policy 2014-1 of the State Board of Examiners of Water Well Construction and Pump Installation Contractors
(Board), the minimum construction standards in Rule 10 of the Water Well Construction Rules shall be waived for ground
water ponds, except, compliance with Rule 10.1 and its subsections 10.1.2, 10.1.4, 10.1,6 and Rule 10,2 and its subsection
10.2.1 is required. The owner of the ground water pond shall take necessary means and precautions to prevent
contaminants from entering the ground water pond.
The boundaries of the pond must be more than 600 feet from any existing well, completed in the same aquifer, that is not
owned by the applicant.

4) Approved for a change of use of, an existing well, constructed on September 30, 1999, to a depth of 26 feet and with a pump being installed
on November 30, 1999, all under permit no. 52376-F (Canceled), and later permitted for change of use of an exisiting well under permit no.
65799-F (Canceled). Issuance of this permit hereby cancels permit no. 65799-F.
5) The use of ground water from this well is limited to fire protection, ordinary household purposes inside one (1) single family dwelling, the
irrigation of not more than 5,000 square feet of home gardens and lawns, drinking and sanitary facilities for a commercial business; four (4)
cabins, a convenience store and 3 full-service RV hoop -ups. This well is known as Toler Well no. 1.
6) The pumping rate of this well shall not exceed 15 GPM.
7) The combined annual amount of ground water to be appropriated by this well (Toler Well no. 1) and Toler Well no. 2, Wigger Well (aka
Wigger_Original Well) and Wigger Replacement Well, shall not exceed 3.72 acre-feet.
8) The return flow from the use of this well must be through an individual waste water disposal system of the non -evaporative type where the
water is returned to the same stream system in which the well is located.
9) The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court case number(s) as

SUBJECT: Extension Request for the Langegger Amended Special Use Permit for a Resort
(File No. SUAA -7776, aka Turtle Tracks Riverfront Resort)
EXTENSION REQUEST
The Applicant Peter Langegger is requesting an extension on the time to complete all conditions
of approval for an Amendment to a Special Use Permit associated with an existing resort facility
located at 361 County Road 311, just south of the Town of Silt. The amended Special Use
Permit was approved by Resolution No. 2014-16 (see attached).
A copy of the extension request submitted by the Applicant's representative is attached with this
memo. The request was submitted in a timely fashion and meets the requirements of Section
4-101 for extension of conditional approval. The request outlines the status of work on the
conditions, including the County's approval of the flood plain development permit for the
proposed individual septic disposal system.
BACKGROUND
The Applicant's current Special Use Permit for the operation of the Resort includes a lodge
facility, cabins, a trout fishing pond, fish cleaning facility, laundry facility, campsites and related
support facilities and amenities on the approximately 6.87 acre property. The Special Use
Permit was originally approved by Resolution No. 2004-112.
The 2014 amendment request was for an expansion of the previous approvals that allowed for
the laundry building and fish cleaning facilities. The revision will allow addition of bathroom and
shower facilities. The Application also requested removal of a previous condition from the
original approval resolution that will now allow future modifications to be subject to the current
Land Use and Development Code provisions regarding minor modifications.
RECOMMENDATION
Staff supports approval of the extension request for an additional year to complete the
conditions of approval as requested by the Applicant. Subject to direction and a motion by the
Board, Staff will prepare an appropriate resolution for the Board's consideration.

Dear Glenn:
As you know, I represent Peter Langegger regarding the Land Use Change Permit approved on March 17, 2014
for Ruby River Resort nka Turtle Track Riverfront Resort. Please consider this Dr. Langegger's request for an
additional one year period to complete the approval conditions of the Permit.
Dr. Langegger has completed almost all of the approval conditions but needs more time to complete two
conditions related to the well water. Specifically, the status of each approval condition is as follows:
1) Amended Well Permits. Six of the seven amended permits have been issued by the Division of Water
Resources. One permit application did not receive the required 600 foot waiver from an adjacent
property owner (who is not local and does not live on the property). The Division of Water Resources
has issued a hearing notice. If no objection is formally made by March 18, 2015, the Division of Water
Resources will issue the pen -nit. If an objection is received, a hearing will be scheduled. Because of the
location of this well and the neighboring well (near the Colorado River) and the abundance of physical
supply of water, we do not believe that any challenge would be sustained at a hearing. Colorado River
Engineering is prepared is issue an opinion regarding the legal availability of water once the final well
permit is issued.
2) Pump Test and Water Quality Test. The 4 hour pump test and water quality test are completed.
Colorado River Engineering is prepared to issue an opinion regarding the physical availability of water
and the water quality (which will be done in conjunction with the opinion on legal availability).
3) Flood Plain Permit. The flood plain permit has been approved by County staff and the 10 -day call up
period has expired. Formal issuance of the permit should occur within the next week or two.
4) Driveway Permit and Required Improvements. Dr. Langegger indicates that Stampfel Construction
obtained the new driveway permit and completed the required improvements.
5) Pedestrian Access Bridge. The pedestrian access bridge has been relocated to Dr. Langegger's property.
6) Emergency Vehicle Access. Dr. Langegger indicates that Stampfel Construction has widened the road to
the required 20 feet and created a turnaround.

hereby requests permission and authority from the Board of County Commissioners to construct a driveway approach (es)
on the right-of-way off of County Road, 311, At Address At Address of 361 CR 311, located on the West side of road
for the purpose of obtaining access to property_
Applicant submits herewith for the consideration and approval of the Board of County Commissioners, a sketch of the
proposed installation showing all the necessary specification detail including:
1. Frontage of lot along road_
2. Distance from centerline of road to property line.
3. Number of driveways requested
4. Width of proposed driveways and angle of approach.
5. Distance from driveway to road intersection, if any.
6. Size and shape of area separating driveways if more than one approach.
7. Setback distance ofbuilding(s) and other structure improvements.
8. No unloading of equipment on county road, any damage caused to county road will be repaired at subdivision
expense.
9. Responsible for two years from the dale of completion.
General Provisions
1) The applicant represents all parties in interest, and affirms that the driveway approach (es) is to be constructed by
him for the bona fide purpose of securing access to his property and not for the purpose of doing business or
servicing vehicles on the road right of way.
2) The applicant shall furnish all labor and materials, perform all work, and pay all costs in connection with the
construction of the driveway(s). All work shall be completed within thirty (30) days of the pemvt date.
3) The type of construction shall be as designated and/or approved by the Board of County Corrunissioners or their
representative and all materials used shall be of satisfactory quality and subject to inspection and approval of the
Board of County Commissioners or their representative.
4) The traveling public shall be protected during the installation with proper warning signs and signals and the Board
of County Commissioners and their duly appointed agents and employee shall be held harmless against any action
for personal injury or property damage sustained by any reason of the exercise of the Permit.
5) The Applicant shall assume responsibility for the removal or clearance of snow, ice, or sleet upon any portion of
the driveway approach (es) even though deposited on the driveway(s) in the course of the County snow removal
operations.
6) In the event it becomes necessary to remove any right-of-way fence, the posts on either side of the entrance shall
be surely braced before the fence is cut to prevent any slacking of the remaining fence and all posts and wire
removed shall be turned over to the District Road Supervisor of the Board of County Commissioners.

Specifications
1. A driveway approach is understood to be that portion of the county road right -of way between the
pavement edge and the property line that is designed and used for the interchange of traffic
between the roadway and abutting property.
2. At any intersection, a driveway shall be restricted for a sufficient distance from the intersection to
preserve the normal and safe movement of traffic. (11 is recommended for rural residence
entrances that a minimum intersection clearance of 50 feet be provided and for rural commercial
entrances a minimum of 100 feet be provided.)
3. All entrances and exits shall be so located and constructed that vehicles approaching or using
them will be able to obtain adequate sight distance in both directions along the county road in
order to maneuver safely and without interfering with county road traffic.
4. The Applicant shall not be permitted to erect any sign or display material, either fixed or
movable, on or extending over any portion of the county road right-of-way.
5. Generally, no more than one approach shall be allowed any parcel or property the frontage of
which is less than one hundred (100) feet. Additional entrances or exits for parcels having a
frontage in excess of one hundred 100) feet shall be permitted only after showing of actual
convenience and necessity.
6. All driveways shall be so located that the flared portion adjacent to the traveled way will not
encroach upon adjoining property.
7. No commercial driveway shall have a width greater than thirty (30) feet measured at right angles
to the centerline of the driveway except as increased by permissible radii. No noncommercial
driveway shall have a width greater than twenty (20) feet measured at right angles to the
centerline cif the driveway, except as increased by permissible radii.
8. The axis of an approach to the road may be at a right angle to the centerline of the county road
and of any angle between ninety (90) degrees and sixty (60) degrees but shall not be less than
sixty (60) degrees, Adjustment will be made according to the type of traffic to be served and other
physical conditions.
9. The construction of parking or servicing areas on the county road right-of-way is specifically
prohibited. Conunercial establishments for customer vehicles should provide off -the -road parking
facilities.
10. The grade of entrance and exit shall slope downward and away from the road surface at the same
rate as the normal shoulder slope and fora distance equal to the width of the shoulder but in no
case less than twenty (20) feet from the pavement edge. Approach grades are restricted to not
more than ten percent (10%).
11. All driveways and approaches shall be so constructed that they shall not interfere with the
drainage system of the street or county road. The Applicant will be required to provide, at his
own expense, drainage structures at entrances and exits, which will become an integral part of the
existing drainage system. The Board of County Commissioners or their representative, prior to
installation, must approve the dimensions and types of all drainage structures.
Note: This permit shall be made avaIable at the site where and wben work is being done. A work
sketch or drawing of the proposed driveway(s) must accompany application. No permit will be
issued without drawing, blueprint, or sketch.

- 7) No revisions or additions shall be made to the driveway(s) or its appurtenances on the right-of-way without
written permission of the Board of County Commissioners.
8) Provisions and specifications outlined herein shall apply on all roads under the jurisdiction of the Board of County
Commissioners of Garfield County, Colorado, and the Specifications, set forth on the attached hereof and
incorporated herein as conditions hereof.
9) Final inspection of driveway will be required upon completion and must be approved by person issuing
permit or representative of person issuing permit.
The inspection and sign off must be done prior to any CO from the Building and Planning
Department being issued.
