Slbsequent to our brief conversation on Monday, August 4th, I felt iE
appropriate to clarify further some of the trrctentiaI problems with the
Rando Airport Hanger Condominium PIat Phase I, as have arisen through
review by the Planning Departrnent and discussions with the County
Attorney's office.
Initially, there may be a problem with the long term lease between the
County and the tenant from a subdivision sLandtrnint. Tbchnically, the
creation of any long term interest in land is required to receive approval
from the Board for either a subdivision or be exempted from the definition
of subdivision per C.R.S. 30-28-10I (I0).
In regards to the protrrcsed condominiumizaEion of the leased property, any
trnrcel of land to be used for condominiums is considered subdivided land
in C,arfie1d County, in accordance with the sarne State Statute. Review and
approval through the County's Subdivision Regulations is required for the
creation of condominium units.
