Description Category: SOI
This deep, well -drained soil is on side slopes and foot slopes. It formed in colluvium
derived dominantly from mixed sedimentary rocks. The surface layer is loam 8 inches
thick. The subsoil is clay loam about 55 inches thick. The substratum to a depth
of 70 inches or more is clay loam. Permeability is moderate. Available water capacity
is high. Effective rooting depth is 60 inches or more. Runoff is rapid, and the hazard of
water erosion is very high.

ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT
CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit
does not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested
water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval
of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation
Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-92-602(3)(b)(I) and the policy of the State Engineer for appropriation of ground water
tributary to Crystal Springs and Roaring Fork River system.
4) The use of ground water from this well is limited to drinking and sanitary facilities as described in CRS 37-92-602(1)(c),
for a commercial business, Bed and Breakfast. Water from this well shall not be used for lawn or landscape irrigation or
for any other purpose outside the business building structure.
5) Approved for the change in use of an existing well, permit no. 79109. The issuance of this permit hereby cancels permit
79109 (79109-A). Any and at other existing wells located on this parcel of 6.81 acres must be plugged and sealed
according to the Water Well Construction Rules within ninety (90) days of completion of the new well. The enclosed Well
Abandonment Report form must be completed and submitted to affirm that the old well was properly plugged and sealed.
6) The maximum pumping rate of this well shall not exceed 15 GPM.
7) The maximum annual amount of ground water to be diverted by this well shall not exceed 1/3 acre-foot (108,600 gallons).
8) Approved as the only well on a tract of land of 6.81 acre(s) described as SE1/4, SE1/4 section 14, twp. 7 south, rng. 88
west, 6th P.M., Garfield County, reference attached exhibit "A".
9) The return flow from the use cf this well must be through an individual waste water disposal system of the
non -evaporative type where the water is returned to the same stream system in which the well is located.
10) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all
diversions must be maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon
request.
11) This well shail be constructed not more than 200 feet from the location specified on this permit.

Pursuant to County Regulations, this letter provides documentation that the new ISDS system recently
installed is in general compliance with the permitted design. Sopris Engineering has performed site visits
to measure, inspect, and document the as built conditions of the constructed system. We have coordinated
our efforts with the owner and contractor that built the system. The system was inspected prior to
backfilling and after all installations were completed. The as -built conditions and installation of the new
ISDS components is in compliance with the permitted design specifications for the system. The as -built
size and location of the new ISDS system is as delineated on the record drawing.
A 1500 gallon dual compartment septic tank was installed with 4" tee baffles and an effluent filter.
Inspection ports were installed on the ends of the trenches. The absorption field was constructed as
•delineated on the site plan. The four 3' x 69' trenches were installed level utilizing specified materials
installed according to design. The minimum setback distances have been maintained.

The septic tank, distribution pipe, and installation are in accordance with Garfield County Regulations, the
design presented in the Sopris Engineering Report, dated June 12, 2001 and the design drawing, dated June
18, 2001.

Subject: Observation of Pit Excavation, Proposed Residence, 1213 County Road
112, Carbondale, Colorado
Dear Mr. Park:
As requested, a representative of Hepworth-Pawlak Geotechnical, Inc. observed the pit
excavation at the subject site on April 3, 2001 to evaluate the soils exposed for
foundation support. The findings of our work and recommendations for the foundation
design are presented in this report. The work was done in accordance with our
agreement for geotechnical engineering services to you, dated April 2, 2001.
• The proposed residence will consist of 11 story log and wood frame construction above
•
a walkout basement level. Ground floor will be slab -on -grade.
At the time of our visit to the site, a pit had been dug 4 feet below the adjacent ground
surface. We understand that the pit was originally due last year. The soils exposed in
the pit consisted of about 2 feet of topsoil overlying clayey sandy gravel with cobbles.
Results of a swell -consolidation test performed on a sample taken from the pit, shown
on Fig. 1, indicate the sandy clay matrix soils are slightly compressible under
conditions of loading and wetting. No free water was observed in the pit excavation
and the soils were moist.
Considering the conditions exposed in the pit excavation and the nature of the proposed
construction, spread footings placed on the undisturbed natural soil designed for an
allowable soil bearing pressure of 2,000 psf should be adequate for support of the
proposed residence. The matrix soils could tend to compress when wetted and there
could be some post -construction settlement of the foundation if the bearing soils become
wet. Footings should be a minimum width of 16 inches for continuous walls and 2 feet
for columns. Loose and disturbed soils in footing areas should be removed and the
bearing level extended down to the undisturbed natural soils. Voids created by boulder
removal should be backfilled with compacted soil or with concrete. Exterior footings
should be provided with adequate soil cover above their bearing elevations for frost
protection. Continuous foundation walls should be reinforced top and bottom to span
local anomalies such as by assuming an unsupported length of at least 12 feet.

Foundation walls acting as retaining structures should be designed to resist a lateral
earth pressure based on an equivalent fluid unit weight of at least 50 pcf for on-site soil
as backfill, excluding topsoil and oversized rock. A perimeter foundation drain should
be provided to prevent temporary buildup of hydrostatic pressure behind the walls and
prevent wetting of the lower level. Structural fill placed within floor slab areas can
consist of the on-site soils compacted to at least 95 % of standard Proctor density at a
moisture content near optimum. Backfill placed around the structure should be
compacted and the surface graded to prevent ponding within at least 10 feet of the
building.
The recommendations submitted in this letter are based on our observation of the soils
exposed within the pit excavation and do not include subsurface exploration to evaluate
the subsurface conditions within the loaded depth of foundation influence. This study is
based on the assumption that soils beneath the building foundation have equal or better
support than those exposed in the pit. The risk of foundation movement may be greater
than indicated in this report because of possible variations in the subsurface conditions.
In order to reveal the nature and extent of variations in the subsurface conditions below
the excavation, drilling would be required. It is possible the data obtained by
subsurface exploration could change the recommendations contained in this letter.

THIS agreement remade and entered into this 5th day
of December , 1979, by and between MARGARET W.
SAUNDERS, (hereinafter referred to as "first party") and
SUZANN L. RESNfCR and ROBERT REGULSXI, (hereinafter referred
to as "second parties"), WITNESSETH:
WHEREAS, by deed of even date herewith, first party has
conveyed to second parties 6.81 acres, more or less, as
described on Exhibit "A" attached hereto and incorporated
herein by this reference; and
WHEREAS, first party has retained and i9 now the owner
of that parcel of'real property described ori Exhibit "S";
and
wHEREAs, first party has drilled and constructed a
domestic water well on said retained parcel, which well is
described in Permit #79110 issued by the Colorado Department
of Water Resources on May 16, 1975; and
WHEREAS, the parties have reached an agreement with
regard to the ownership of the water rights in said well and
the sharing of the water therefrom and the maintenance and
operational costs incurred in .:onnection with said all, and
now wish to reduce their agreement to writing.
NOW, THEREFORE, for and in consideration of the covenants
and agreements herein contained, the parties hereto hereby
agree as follows:
1. Water System Ownership. The above described water
well to be utilized under said Permit #79110, together with
the water and water rights appurtenant thereto and the pump
and related equipment necessary to produce water from said
well, shall be owned equally, (each as to an undivided one-
half interest) by first party and second parties. The parties
shall equally share the cost cf installing a pump in said
well, which pump shall be installed upon the issuance of a

on either of the above referenced parcels, and srid pump shall be
of adequate size to supply the domestic water needs of a single
family residence on both of said parcels.
The parties shall cach bear the cost of installing water
supply lines from said well to their respective properties and
shall bear the cost of installing and operating water storage and
other facilities in connection with their utilization of said
water on their respective properties.
2. Maintenance Easement. By deed of even date herewith,
first party has granted to second parties an easement and richt
of way for the installation end maintenance of said well, pump .
and water supply line to second parties' above described property.
3. water. Meters. The owner or owners of each of the above
described parcels shall, prior to commencing use of water from
said well, install a volumetric water flow meter on their respective
property for the purpose of measuring the water delivered to each
of said parcels from said well.

volumetric water flow meters.
6. Disconnection From Water Supply. In the event the
owner or owners of either of said parcels desires to discontinue
the use of water from the above described well, such owner may
discoi.nect from said well and, upon giving written notice of such
disconnection to the owner,or owners of the other parcel, and upon
conveyance of the disconnecting owner's interest in said well and
water rights therein to the owner of the other parcel, said
disconnecting owner shall -be relieved of any further obligation

to pay the cost of maintaining and operating said well and pump;
provided, however, such disconnecting owner shall remain fully
liable for his share of any maintenance and operational expense:;
incurred prior to such disconnection, and such disconnecting
owner shall not thereafter be allowed to reconnect to said well
without having first obtained the written consent of the owner or
owners of the other parcel then utilizing said well. In the
event of the disconnection by the owner or owners of a parcel
from the well as provided in this paragraph, the maintenance and
operational expenses thereafter incurred in connection with said
well and water system shall be borne by the owner or owners of
the parcel utilizing the same.
7. Payment of Common Expenses. Any costs or expenses to
be -paid by the owner or owners of the real property, the subject
of this agreement, shall be paid by such owner or owners within
15 days after receiving notice of such cost or expense. In the
event an owner fails to pay any such cost or expensewithin said
15 day pa,:i nci, the owner or owners of the other

paid their share o' any such exp?nye, may discontinue the supply
of water to such non-paying owner or owners until payment is
received and may exercise such other legal and equitable remedies
as are available to enforce the said payment. Any provisions
herein to the contrary notwithstanding any cost or expenses
assessed pursuant to this agreement, together with recording
fees, court costs and reasonable attorney's fees incurred in the
collection thereof, shall be and become a lien against the
parcel owned by the tion -paying, owner or owners.
8. Covenant Running with Land. The terms and conditions
of this agreement shall be covenants running with the real
property hereinabove described, and shall continue in full force
and affect until amended or terminated by written instrument
executed by all of the owners of said real property.
