HomeMy WebLinkAbout4.0 Buffalo Valley Apartments Extension Request 03.07.2016MEMO TO: Board of County Commissioners FROM: Tamra Allen, Planning Manager DATE: March 7, 2016 RE: Buffalo Valley Apartments Limited Impact Review Partners III, LLC applied to the County for a Limited Impact Review the development of Multi-Unit Dwellings known as the Buffalo Valley Apartments located at 3637 Highway 82. The Board conditionally approved the limited impact review via Resolution 2015-18 at a hearing held on March 16, 2015. The Applicant is now requesting a one-year extension to complete the conditions of approval of which 10 of 29 total conditions were required to be completed prior to the issuance of a Land Use Change Permit. In accordance with Section 4-101.H of the Land Use and Development Code, the Applicant has 1 year from the date of approval to satisfy any remaining conditions precedent to issuance of a Land Use Change Permit. Failure to meet all conditions will result in the expiration of the approval unless the Applicant requests, prior to expiration, an extension. Section 4-101.I of the LUDC allows for the first extension to be granted for a period of one year, pending the review and approval by the Board of County Commissioners provided that the Applicant supply a written explanation of the reasons why the conditions have not been met and the estimated timeframe in which the conditions will be met or completed. The Applicant has supplied a written explanation of the status of the conditions that require action prior to the issuance of the Land Use Change Permit, as attached. The Board should review this letter of request and motion to either deny the request or approve the requested extension for a period of up to one year.
