November 13th,2O!2, Resolution# 2A12-93. This approval requires an engineered and accepted plan to
address how our plan interfaces with the Basin Ditch. We are modifying our existing design concept to
better meet the needs of the Ditch Company and therefore will need more time to complete the
engineering as well as schedule the required Basin Ditch Company meetings in order to seek acceptance.

I am writing this letter at the request of Western Slope Aggregates to confirm they have been working
on various designs for the relocation of the Basin Ditch within their mining envelope and have been in
contact with us in regards to setting up appropriate meetings.
The initialdesign proposed was not found to be suitable by some of the shareholders and Western Slope
Aggregates has told me they have re-designed it and will be presenting for reconsideration of the
shareholders this fall in anticipation of the upcoming construction season.

H. The Board of County Commissioners closed the public hearing on the l3th day of

I. The Board on the basis of substantial competent evidence produced at the
hearing has rnadc the following detenninations of fact:
l. That the proper public notice was provided as required for the hearings before the
Planning Commission and Board of County Commissioners'
?. That the hearings before the Planning Commission and Board of County
Commissioners were extensive and complete, that all pertinent facts, matters and issues
were submitted or could be submittcd and that all interested parties werc heard at those
rneelings.
3. That for the above stated and other reasons thc proposed Land Use Change Permit for
Gravel Exhaction in the "Blue Pit" is in the best interest of the health,. safety,
convenience, order, prosperity, arrl welfare of the citizens of Garfield County'
4. That with the adoption of conditions, the application is in general conformance with the
2030 Cornpretrensive PIan.
5. That wirh the adoption of conditions, the apptication has adequatcly met the
requirernents of the Carfield County Unified land Use Resolution of 2008, as the same
had been amended at the time the application was deerned by thc Building and Planning
Deparhnent to bo technically complete.
6, The requested modification of Dryland Slope standards fronr a slope of 5:l to 3:l is in
conformance with the purpose statement of Section 7'840.

THEREFORE, BE IT RESOLVED by the Board of CountyComrnissioners of Garfield
ty, Colorado, that:
A. The forgoing Recitals are incorporated hy this reference as part of the resolution.
B. The Land Use Change Permit for Extraction related to "Blue Pit" is hereby approved
subject to compliance with the following conditions:
1. That all representations made by the Applicant in the application, and at the public
hcaring bcfore the Board of County Commisioners, shall be conditions of approval,
unless spcifically altered by the Board of County Commissioners.
2. The operation of the facility shall be in accordance with all applicable Federal, State,
and local rcgulations govcming thc opcration of this typc of facility'
3. Thc facility shall bc opcratcd so that the gfound vibration inhcrently and recurrently
generated is not pcrccptible. without inslruments, at any point of any boundary line of
the property on which the use is located.
4. AII industrial wastes shall be disposed of in a manner consistent with statutes and
requirements of CDPHE.
5. Prior to the issuance of a Land Use Charrge Permit, the Applicant shall submit the
following information to the Building and Planning Department:
A revised *Weed Control Plan Map" identifying the locations of Musk Thistle,
Plumeless Thistle, Houndstongue, and Common Burdock'
The Colorado Division of Reclamation, Mining and Safety ("DRMS") Final
Reclarnation Plan. This shall be the only Reclamation Plan used by both the
County and DRMS.
Proof of a bond" calculated to cover the DRMS Final Reclamation Plan, and secured
with theDRMS.
d. A copy of the final DRMS Perrnit.
e. A *Will Serve" letter from Mountain Roll Offs, [nc. or other similar service
provider.
f. An Emergency Preparedness Plan.

g. Drainage calculations for the sizing of an infiltration pond to be constructed in the
bottom of the pit including runoff volume, surface areas, depths, and predicted
infiltration rates of the site,
6. Prior to the mining of Phase 2, Applicant shall:
Plant one hundred and forty (140) trees on the screening berm on the north side of
the project and install an eight (8) foot tall fence around the trees for wildlife
proteaion.
Relocate the existing farrn road along the west and north property lines.
Provide the Building and Planning Departrnent with an approvcd and stamped plan
and agrecment with the Basin Ditch Company to reroute the Basin Ditch.
7. Siteoperations shall not emit heat, glare, radiation, dust or furnes which substantially
interfere with the existing use of adjoining and nearby property or which constirutes a
nuisance or hazard.
8. All equipment and structures associated with this permit shall be painted with non'
reflective paint in neutral colors to reduce glare and rnitigate any visual impacts.
g. All lighting associated with the propeny shall be dircctcd inr.uard and dorunward
towards the interior of the property.
10. All fabrication, service and repair operations shal] be conducted within an enclosed
building or obscured by a fence, natural topography or landscaping.
ll. AII buildings and equipment shall be screened orobscured from viewof the Wooden
Deer SuMivision by installation of berms and planting of trees (cottonwood, pine or
their equivalents) which trees, at the time of planting, shall be at least ten (10) feet in
height and spaced upon len (10) foot centers-
12. Atl noxious weeds as listed by County Vegetation Manager shall be controlled in any
areas of the property not being actively mined at that time, including top soil piles and
areas where mining has been discontinued for more than thirty (30) days.
13. The Reclarnation Plan and Landscape Plan for the site shall show areas seeded using
hydro-seeding with hydro-mulching using tackifier for all slopes greater than 5:l as
required by Section 7-840 of the ULUR.
14.The dryland seede<i areas shall be irrigated to assist in the establishrnent of this seed
rnix.

lS. The County acknowledges that the State Division of Reclamation, Mining and SafeU
(i.DRlvfs')will reguire a reclamation bond for the operation. The County will nol
require a ieparate bond; howerrer, the County reserves thc rlht to require a bond in the
fluture in the event the County determines the bond held by DRMS is inadequate orlras
been released prior to complaion of adequate reclamation. The County shall be inv-ited
to any bond reiease inspection of the Stati Division of Reclamation, Mining and Safety.
The County will have the opportunity to demonstrate that any item ofthe permit has-not
been comptied with and t'-hat bond should not be released. Specifically, thc Final
Reclamation plan (Reclamation Plan Map) shall include tlrc followittg components:
a. When reclaimed, Phases 2, 3, and 4 shall be constructed to a minimum 3:l slope.
Sec the Reclamaiion Plan Map of the application for the layout of these areas. This
shall be rcquired to be shown on the Final Reclamation Plan approved hercin and
tendered to the DRMS.
b- The Applicant shatl use "contemporaneous reclamation" as discussed in the
applicaii'on. [f the rectamation does not follow the Mining Plan.or has not been
clmpleted within eighteen (18) months, all mining operations on the property shall
be halted unril the reelamation and revegetation has occurred to the satisfaction of
the County. Completion shall include but not be limitcd to recountering, top-
soiling, seeding, and rnulching.
16. The Applicant to adhere to the Wildlife Mitigation report conditions, see attached
Exhibit t.
17. The Applicant shal! either replace or upgrade the existing ISDS to serve 20 to 30
employees upon the issuance of a building permit for a ncw scale house.
lg. The gravel pit shatl be atlowed to operate Monday - Saturilay, with crushing, digging
and f,eary irauling only occuning between 7:00 AM lo 5:00 PM Monday through
iriday; heavy haufng from 7:00AM to 5:00PM on Saturday; and cnrshing and digging
from 8:00 AM to S:O-O ptvt on Saturday. There shall be no operations on Sunday except
in the case of an emergency or for standard maintenance purposes.
19. All noise generated from construction at the pit (including cotrstruction ofacccss roads,
;p soii ,frooruf and storage, set up $ationary equipment such as crusheru, screens, and
engine generators, installition of utilities, and conslruclion of earthen noise banier
beims) ihull not exceed the Industrial T:r,ne noise standands defined in the CRS such
that noise shall not exceed S0 dB(A) from 7:00 AM to 5:00 PM and 75 dB(A) from
5:00 PM to 7:00 AM when measured 25 feet outside of the Property Boundary'

materials)

21. The Concrete Plant shall remain in its current location in the bottom of the pit on the
eastem end ofPhase l.
22.Primuy Crusher:
The primary jaw crusher shalt be tocated at all times on the pit floor and as close as
is practicabli to the noflhem-most slope. If the primaU l1w cnrshgr. cannot be
rccitea adjacent to the toe of the northern slope, then sound shall be mitigated with
a 30 feet berm of material left in place or a sound wull system; and.
Owner or Operator shall use reasonable efforts and implementable technolory to
minimize sound emanating from the primary uusher.
23- All in-pit haul trucks ard excavating equipment used by Owner or Operator instant lo
rniningoperations shall be equippcd with "white noisc" or similar backup alarms or no
bss ehective alarm equipment. Standard backup alanns, as to the above identified
equipment shall not be utilized-
24. Applicant shall adhere to the following recommendations of the Garf,reld County Road
and Bridge DePartment:
A stop sign shall be required at the entrance to the County Road 104. The sign and
instaliatiJn shall be as rcquired in the MUTCD (Manual oo Unifotrn Traffic Control
Devices) per the cunent edition as adopled by Garfreld County.
The owners of the gravel pit may be asked in the future to contribute to a road
repair or improremJnt project for County Road 104. Such contribution shall be
determined based on thi Appticant's proportionate share of average daily vehicle
trips as measured on County Road 104 at thc intersection of County Road 104 and
County Road 103, not to exceed 75Yo of the overall cost of the project. -S-uchr.qu*i for contribution shall occur during the applicable term of the Land Use
Change Permit.
All vehicles using CR 103 and CR 104 to access the gravct pit shali abide.by
Carfield Countyls oversizey'overweight system. All vehicles requiring
oversize/overweiiht permits shall apply for them at Garfield County Road and
Bridge Department.
25. All trucks operating in the pit (including third-party (rucks not operated by the Owner
or Operator, shall be subject to the following:

27.T\e Owner or Operator shall submit an annual report to the County Building and
Planning Department with GPS measurements shown on a map showing the cuffent
disturbaircc, what areas have been backfilled, where topsoil stockpiles are located, all
site structures, what areas have been secded, rnulched, and what is plannbd for lhe
.nrring l2 months. This annual report shall also includc: l) an updated estimate of
gravel reserves remaining wirhin the permitted boundaries and within each Phase; and

28. The County can request a site inspection with twsnty four (24) hour's notice to the
Operator oi froperff Owner. Full access to any part of the site will be granted'
29. A full list of all other permits and any paperwork necessary to demonstrate compliance

be providei to the County within twenty four (24) hours of a requesl by the.County'
