That all representations made by the Applicant in the application, and at the public hcaring bcfore the Board of County Commisioners, shall be conditions of approval, unless spcifically altered by the Board of County Commissioners. 2. The operation of the facility shall be in accordance with all applicable Federal, State, and local rcgulations govcming thc opcration of this typc of facility' 3. Thc facility shall bc opcratcd so that the gfound vibration inhcrently and recurrently generated is not pcrccptible. without inslruments, at any point of any boundary line of the property on which the use is located. 4. AII industrial wastes shall be disposed of in a manner consistent with statutes and requirements of CDPHE. 5. Prior to the issuance of a Land Use Charrge Permit, the Applicant shall submit the following information to the Building and Planning Department: A revised *Weed Control Plan Map" identifying the locations of Musk Thistle, Plumeless Thistle, Houndstongue, and Common Burdock' The Colorado Division of Reclamation, Mining and Safety ("DRMS") Final Reclarnation Plan. This shall be the only Reclamation Plan used by both the County and DRMS. Proof of a bond" calculated to cover the DRMS Final Reclamation Plan, and secured with theDRMS. d. A copy of the final DRMS Perrnit. e. A *Will Serve" letter from Mountain Roll Offs, [nc. or other similar service provider. f. An Emergency Preparedness Plan. b. 3 b. -c' g. Relocate the existing farrn road along the west and north property lines. Provide the Building and Planning Departrnent with an approvcd and stamped plan and agrecment with the Basin Ditch Company to reroute the Basin Ditch. 7. Siteoperations shall not emit heat, glare, radiation, dust or furnes which substantially interfere with the existing use of adjoining and nearby property or which constirutes a nuisance or hazard. 8. All equipment and structures associated with this permit shall be painted with non' reflective paint in neutral colors to reduce glare and rnitigate any visual impacts. g. All lighting associated with the propeny shall be dircctcd inr.uard and dorunward towards the interior of the property. 10. All fabrication, service and repair operations shal] be conducted within an enclosed building or obscured by a fence, natural topography or landscaping. ll. AII buildings and equipment shall be screened orobscured from viewof the Wooden Deer SuMivision by installation of berms and planting of trees (cottonwood, pine or their equivalents) which trees, at the time of planting, shall be at least ten (10) feet in height and spaced upon len (10) foot centers- 12. Atl noxious weeds as listed by County Vegetation Manager shall be controlled in any areas of the property not being actively mined at that time, including top soil piles and areas where mining has been discontinued for more than thirty (30) days. 13. The County acknowledges that the State Division of Reclamation, Mining and SafeU (i.DRlvfs')will reguire a reclamation bond for the operation. The County will nol require a ieparate bond; howerrer, the County reserves thc rlht to require a bond in the fluture in the event the County determines the bond held by DRMS is inadequate orlras been released prior to complaion of adequate reclamation. The County shall be inv-ited to any bond reiease inspection of the Stati Division of Reclamation, Mining and Safety. The County will have the opportunity to demonstrate that any item ofthe permit has-not been comptied with and t'-hat bond should not be released. Specifically, thc Final Reclamation plan (Reclamation Plan Map) shall include tlrc followittg components: a. When reclaimed, Phases 2, 3, and 4 shall be constructed to a minimum 3:l slope. Sec the Reclamaiion Plan Map of the application for the layout of these areas. This shall be rcquired to be shown on the Final Reclamation Plan approved hercin and tendered to the DRMS. b- The Applicant shatl use "contemporaneous reclamation" as discussed in the applicaii'on. [f the rectamation does not follow the Mining Plan.or has not been clmpleted within eighteen (18) months, all mining operations on the property shall be halted unril the reelamation and revegetation has occurred to the satisfaction of the County. Completion shall include but not be limitcd to recountering, top- soiling, seeding, and rnulching. 16. The Applicant to adhere to the Wildlife Mitigation report conditions, see attached Exhibit t. 17. The Applicant shal! either replace or upgrade the existing ISDS to serve 20 to 30 employees upon the issuance of a building permit for a ncw scale house. lg. The gravel pit shatl be atlowed to operate Monday - Saturilay, with crushing, digging and f,eary irauling only occuning between 7:00 AM lo 5:00 PM Monday through iriday; heavy haufng from 7:00AM to 5:00PM on Saturday; and cnrshing and digging from 8:00 AM to S:O-O ptvt on Saturday. There shall be no operations on Sunday except in the case of an emergency or for standard maintenance purposes. 19. Applicant shall adhere to the following recommendations of the Garf,reld County Road and Bridge DePartment: A stop sign shall be required at the entrance to the County Road 104. The sign and instaliatiJn shall be as rcquired in the MUTCD (Manual oo Unifotrn Traffic Control Devices) per the cunent edition as adopled by Garfreld County. The owners of the gravel pit may be asked in the future to contribute to a road repair or improremJnt project for County Road 104. Such contribution shall be determined based on thi Appticant's proportionate share of average daily vehicle trips as measured on County Road 104 at thc intersection of County Road 104 and County Road 103, not to exceed 75Yo of the overall cost of the project. -S-uchr.qu*i for contribution shall occur during the applicable term of the Land Use Change Permit.
