GENERAL PROJECT DESCRIPTION Applicant seeks to amend approvals granted by the Board of County Commissioners in Resolution 2011-44 for a gravel operation to be located on a property at the northeast corner of SH 82 and CR 103. The project is known as the Cerise Gravel Pit. Original approval was granted for the use (and related processing for crushing, washing and concrete batch plant) and specific mitigation measures were conditioned to bring the operation into compliance with the Garfield County Comprehensive Plan and Land Use regulations. The Applicant seeks to modify the existing approval and a determination has been made, pursuant to Section 4-106 of the 2013 Land Use and Development Code, as amended (LUDC), that the request is a Substantial Modification. This requires submittal of a new application for review. The new application is for a proposal that includes: 1. A six -phase mining plan to occur over approximately 18 years; 2. Limitations on the amount of disturbance at one time, along with interim reclamation occurring concurrent with phasing disturbance; 3. 375,000 to 500,000 tons of resource annually with an average of 437,000 tons/year; 4. An on-site work force averaging two full-time employees; 5. Mobile facilities to include crushing and washing of the resource — these activities would move with the proposed phases of development; 6. Stationary facilities to include an office, scale house, and porta-potties; 7. Berming sufficient to mitigate visual impacts from adjacent residential properties; 8. Industrial water use from a Basalt Water Conservancy District contract with water delivered via the Basin Ditch; 9. Potable water provided via bottled water delivered to the site. II. REGULATORY PROVISIONS APPLICANT IS REQUIRED TO ADDRESS Garfield County Comprehensive Plan 2030, as amended Garfield County Land Use and Development Code, as amended (LUDC) — Section 4-101 Common Review Procedures and Table 4-102 Section 4-105 Major Impact Review Section 4-106 Amendments to an Approved Land Use Change Permit Section 4-201 Application Materials and Table 4-201 Section 4-203 Description of Submittal Requirements Article 7 — Divisions 1, 2, and 3 and 7-1002 III. REVIEW PROCESS The process to accommodate these requests shall require submittal of a Major Impact Amendment — Substantial Modification pursuant to the LUDC. A. Pre -application Conference. B. Application Submittal. C. Determination of Completeness. D. Schedule Planning Commission Public Hearing, provide documentation regarding notice requirements. E. Additional Copies requested and sent to referral agencies. F. Evaluation by Director/Staff resulting in a Staff Report to the Planning Commission. G. Public Hearing before the Planning Commission, resulting in a recommendation to the BOCC for approval, approval with conditions or denial. H. Schedule BOCC Public Hearing, provide documentation regarding notice requirements. I. Public Hearing before the BOCC, resulting in a final approval, approval with conditions or denial. J. Resolution K. Land Use Change Permit (upon satisfaction of any conditions of approval). IV. SUBMITTAL REQUIREMENTS A. General Application Materials: Deed of property, owner authorizations; SOA's if owners or representatives are corporations, LLC or trusts; adjacent owners map; names/mailing addresses, etc. See 4-203 B B. As noted on the attached Table of Contents provided by the Applicant — for code specifics see Table 4-201 of the LUDC. VI. APPLICATION REVIEW FEES This application will be subject to the following fees and deposit requirements: Planning Review Fees: $ 400.00 + additional time charged at hourly rate of $40.50 Referral Agency Fees: $ TBD Total Deposit: $ 400.00 General Application Processing Planner reviews case for completeness and sends to referral agencies for comments. Case planner contacts applicant and sets up a site visit. Staff reviews application to determine if it meets standards of review. Case planner makes a recommendation of approval, approval with conditions, or denial to the appropriate hearing body.
