contractor's yard. Attached is the series of emails regarding his ability to maintain the ditch.
Aspen Glen Club is the majority shareholder of the Kaiser/Sievers ditch. The address is 0545 Bald Eagle
way; Carbondale, CO 81623.
The Aspen Glen HOA (80 Bald Eagle way, Carbondale, CO 81623) and the Roaring Fork Water and
Sanitation District (PO Box 1002 Glenwood Springs, CO 81601) are also shareholders.

Jake,
In the areas of storage, I would like to park small and medium sized vehicles, enclosed trailers, job materials and small
equipment. The trailers are all sized to be hauled by a pickup truck. Weights of equipment are as follows:
Pickup Truck GVWR 9200 Ib (4800 front/6084 rear)
Dump Truck GVWR 29369 Ib (10,860 front/18500 rear)
Mini Excavator 8200 Ib track machine
Case Skidsteer 10,000 Ib (5000 front/5000 rear)
20' Enclosed Construction Trailer GVWR 10,000 Ib (5000 front/5000 rear)
Dump Trailer GVWR 14,000 Ib (7000 front/7000 rear)
The parking area currently has 6' of structural fill on top of the corrugated metal pipe.
The boulder wall would tie into the existing 8'tall boulder wall on the south end and gaining to a peak elevation of 12'
and then tapering down to meet the existing 4' boulder wall at the north end.

Our engineer recommended the following:
For the proposed construction and use, we should require at least the following and record in an agreement:
•:• Description of max loads, actual materials and mobility of items to be stored and travel over ditch.
Minimum cover of 18" of class 6 aggregate or other quality structural material over ditch in parking/storage areas
:• 1:1 influence line from boulder wall should be at least 1' clear of ditch.
•:• Statement of actual Boulder wall height. (Impact if> 4'?)
•:• Assume ditch is soil —lined. Repair disturbed sections of ditch w/ bentonite amended clayey soil. Scarify, add > 4
lbs/sf bentonite, mix well and recompact to match ditch cross section.
Continued right to access and maintain.
Will any of these be a problem? If not, please provide a description of the items to be stored as well
as the info requested on the boulder wall. Thanks,

Jeff,
I will need our legal department to review it before I can send you a letter. As we discussed, I don't
think our access is going be an issue. I did send it to our engineer to make sure that we are OK with
the parking and storage areas on top of the pipe. He will probably make a recommendation on
minimum depth of fill over the pipe. As soon as I hear back from the engineer, I'll work on getting
approval from legal. I understand you want to get this done, I'll try to keep it moving as fast as I

Jake,
I talked to the Planner at the County and she is fine with just getting a letter from you. She is not needing any sort of
legal agreement, she just wants to know that what I am proposing does not interfere with your ability to maintain the
ditch. She did request that the letter be on Aspen Glen letterhead instead of just an email.
Is this something that you can do, or do you still want to run it through the legal? I am fine with you saying in the letter
that you are not waiving any rights that you currently have on the ditch.

After meeting with you on site today, it does not appear that your plans would impact our access to
operate and maintain the ditch. I will have to run this through our legal office before we can provide
the letter you requested. If approved, it will have some conditions, such as the ones you listed
below. Aspen Glen Club is the majority share holder of the Kaiser/Sievers ditch. Our address in
0545 Bald Eagle way; Carbondale, CO 81623. The Aspen Glen HOA and the Roaring Fork Water
and Sanitation District are also share holders. I'll look up their addresses and pass them on to you

Jake,
Thanks for coming to site today to look at the property and the available access to the irrigation
ditch. As discussed, there are a couple issues that I would like help with.
1. The county requires "Application for Division of Land or Land Use Change Permit that may affect
or impact any ditch right-of-way shall include the name and mailing address of the ditch
owner." Would you provide this information so that I may add it to my Contractor Yard permit
application?
2. Regarding the proposed use as a Contractor Yard the county is requesting a letter from the ditch
owner. They are specifically requesting that "The Applicant shall provide a letter from the ditch owner
accepting that the development proposal will have no impact on their ability to maintain the ditch and
that an adequate maintenance easement is possible." I am providing the .pdf of the survey/plans that
we went over this morning for the proposed use, showing the improvements that I am requesting
within the maintenance easement.

the ditch right away is subject to risk of removal/demolition, if needed, for servicing the ditch. If you
would please respond to this email with a summary of your thoughts on this issue it would be
helpful. I understand that it may take some time for a formal answer to be reviewed and provided by
