WHEREAS, a Petition for Disconnection was filed rvith the City in August 2015 by the Board of County Commissioners of Garfield County, Colorado, the sole owner of the territory hereinafter described (*Owner" or the "County'), excluding streets and alleys; and WHERIAS, the County's acquisition of certain real property adjacent to the Garfield County Airport and thb Garfield County Road and Bridge Facility comprises territory owned by the County but in the City's jurisdiction and to be used in conjunction with property in the County's jurisd i ction, creating und esirabl e mixed jurisdi ction; and \VHEREAS, C.R.S. $31-12-501, et seq., sets forth the procedure required to disconnect a kact of land within and adjacent to the boundary of a city; and WHEREAS, the Rifle City Council does hereby find and determine approval of the Petition for Disconnection of said tenitory to be in the City's best interest. NOW, THEREFORE, BE IT ORDAiNED BY THE CITY COLINCIL OF THE CITY oF RIFLE, COLORADO, THAT: 1. The foregoing recitals are incorporated herein as if set forth in full. 2. That the tracts of land described in the Petition for Disconnection and further described as Airport Parcel A, Airport Parcel B, Airport Parcel C and Boot Parcel A on the Land Survey Plat attached hereto as Exhibit A is hereby disconnected from the boundary of the City of Rifle in accordance with C.R.S. $31-12-501 3. The Rifle City Clerk is hereby directed as follows: a. To file one copy of this ordinance along with the Land Survey Plat in the office of the City Clerk of the City of Rifle. b. To certify and file two 2 copies of this ordinance and the Iand Survey PIat with . the Clerk aad Recorder of the County of Garfield, State of Colorado. c. A de-annexation process occurred and the site is now in unincorporated Garfield County, therefore county zoning is required to be applied to the parcel. This request is to zone the site as the adjacent Airport lndustrial PUD, which would allow the property to revert to that zoning designation assigned to the site prior to the annexation of the property to the City of Rifle. The Airport lndustrial PUD documents from 2011 indicate that the site is contained within the Commercial/Airport Services zone (C/A S)within the PUD. ln order to add this property to the Official Zoning Map, a request must be made for zoning the parcel. Community Development is acting on behalf of the Board of County Commissioners to accomplish the act of assigning zoning to the property and adding that designation to the zoning map. Adjacent zoning includes Public Airport and Planned Unit Development. The 2013 Land Use and Development Code, as amended (LUDC) contains regulations regarding rezoning of property within the County in Section 4-113. This zoning action must be reviewed by the Planning Commission for recommendation and a decision issued by the Board of County Commissioners. 4-113. REZONING. A. Overview. 1. Applications for rezoning shall be reviewed and a recommendation made by the Planning Commission, and decided by the BOCC. 2. Rezoning may be initiated by the BOCC, the Planning Commission, the Director, or the owner of the subject property. 3. The rezoning request may be processed concurrently with a Land Use Change application and review process. B. Review Process. Applications for rezoning shall be processed according to Table 4-102, Common Review Procedures and Required Notice. C. Review Criteria. An application for rezoning shall demonstrate with substantial evidence that an error exists in the Official Zone District Map, or meet the following criteria: 1. The proposed rezoning would result in a logical and orderly development pattern and would not constitute spot zoning; 2. The area to which the proposed rezoning would apply has changed or is changing to such a degree that it is in the public interest to encourage a new use or density in the area; 3. The proposed rezoning addresses a demonstrated community need with respect to facilities, services, or housing; and 4, The proposed rezoning is in general conformance with the Comprehensive Plan and in compliance with any applicable intergovernmental agreement. The Board of County Commissioners has requested Park PUD Commercial/Airport Services (CA/S). That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted or could be submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons the request to rezone the property is in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the application has met the requirements of the Garfield County 2013 Land Use and Development Code, as amended. 5.
