Dear Ken,
On Monday, March 16, 1998, the Garfield County Board of Commissioners granted conditional
approval in the above -referenced matter. The conditions that shall govern this approval are as follow:
1. That all representations of the applicant, either within the application or stated at the meeting
before the Planning Commission, shall be considered conditions of approval.
2. A Final Plat shall be submitted, indicating the legal description of the property, dimension and
area of the proposed lots, access to a public right-of-way, and any proposed easements for
setbacks, water supply, drainage, irrigation ditches, access, utilities, etc.
3. The applicant shall prepare and submit a Subdivision Improvements Agreement addressing
all on-site improvements, prior to the submittal of a final plat.
4. That the applicant shall submit school site acquisition fees, for the creation of the additional
subdivision parcel, prior to authorization of a final plat. The applicant shall be notified of the
actual fee that will be applicable at time of submittal of the final plat.
5. That the following plat notes shall be included on the final plat:
"The minimum defensible space distance shall be 30 feet on level terrain, plus appropriate
modification to recognize the increased rate of fire spread at sloped sites. The methodology
described in "Determining Safety Zone Dimensions, Wildfire Safety Guidelines for Rural
Homeowners," (Colorado State Forest Service) shall be used to determine defensible space
requirements for the required defensible space within building envelopes in areas exceeding
five (5) percent grade."
"Soil conditions on the site may require engineered septic systems and will require engineered
building foundations based on site-specific soils testing."
"The individual lot owners shall be responsible for the control of noxious weeds."

6. That the final plat submittal include a copy of a computer disk of the plat data, formatted for
use on the County Assessor's CAD system.
7. That all proposed lots shall comply with the Garfield County Zoning Resolution of 1978, as
amended, and any building shall comply with the 1994 Uniform Building Code, as adopted.
8. The water rights associated with the Ponderosa Spring #2, together with the well permit(s),
shall be transferred by the developer to a homeowner's association which shall have the
power and the duty to enforce compliance by lot owners with the terms and conditions of
the well permit. Appropriate Protective Covenants shall further require compliance with
the terms and conditions of the well permit.
That the following provisions be included in the protective covenants governing the
subdivision:
One (1) dog will be allowed for each residential unit within this subdivision and the dog shall
be required to be confined within the owner's property boundaries. Enforcement provisions
shall be developed for allowing the removal of a dog from the area, as a final remedy in worst
cases.
No open hearth solid -fuel fireplaces will be allowed anywhere within this subdivision. One
(1) new solid -fuel burning stove as defined by C.R.S. 25-7-401, et. seq., and the regulations
promulgated thereunder, will be allowed in any dwelling unit. All dwelling units will be
allowed an unrestricted number of natural gas burning stoves and appliances.
All exterior lighting shall be the minimum amount necessary and all exterior lighting shall be
directed inward, towards the interior of the subdivision, except that provisions may be made
to allow for safety lighting that goes beyond the property boundaries.

Dear Mr.. McCafferty:
We have reviewed the December 10, 1997 report by Zancanella and Associates, Inc., concerning the
above referenced proposal to create two single family lots on a parcel of 8.56 acres. The proposed water supply
is to be provided through a shared well (permit no. 46729-F) and two springs, one of which has been improved.
The springs were decreed in consolidated case nos. 95CW11/96CW166. Irrigation is to be treated as a
supplemental demand.
As noted in our previous letters, permit no. 46729-F was issued pursuant to a water allotment contract
with the West Divide Water Conservancy District, and allows the well to be used for ordinary household
purposes inside two single family dwellings, the irrigation of a total of 24,000 square feet of lawns and garden,
and the watering of domestic animals. However, a previous report by Zancanella and Associates, Inc.,
indicates that the well has not been able to provide an adequate supply for the existing home, thus requiring
the establishment of the springs as an additional water supply for the proposed use.
The December 10, 1997, report concludes that in a dry year the production of Spring No. 2 may be
reduced to 500 gallons per day which would require the development of Spring No. 1 (conservatively estimated
at 250 gallons per day) to provide for in-house uses for the two dwellings. The report further concludes that the
combined production of the springs would be adequate to supply the 700 gallons per day for in-house uses.
Mr. Rose also has an agreement with the Bureau of Land Management (BLM) wherein the BLM agrees to
subordinate a portion of the BLM water rights decreed in consolidated case no. 95CW11/96CW166 to Mr.
Rose's water rights decreed in the same case. Per discussion with Janet Maddock of the District, depletions
from the springs are covered under the existing water allotment contract.
Therefore, pursuant to Section 30-28-136(1)(h)(I), C.R.S., based on the above information it is our
opinion that if sufficient storage is provided the proposed water supply is adequate for in-house uses and will
not cause material injury to decreed water rights. Water for other uses may not be available in dry years due to
reduction in spring flows. If you or the applicant has any questions concerning this matter, please contact

The Letter from the Colorado Geological Survey and the geologic mapping for the area
identify all of Lot #1 as Tying within an alluvial fan deposit. We have concluded that the
Building Envelope as stated on the Preliminary Plat is acceptable. No building should
be permitted within 25 feet of the existing drainage on Lot 1 as shown by the building
envelope.

At your request and in accordance to Senate Bill 35 (1972) this office has reviewed the geologic
hazard report for the Ponderosa Subdivision. The CGS previously reviewed this property in a letter to you,
dated October 30, 1997. The subdivision contains two proposed lots.
Lot #1
As stated in the earlier letter, the biggest concern the CGS has with this subdivision is debris flow
and flash flooding. The lower small basin behind the subdivision property, which drains between the two
lots, will ultimately capture the higher main drainage way that leaves the steep basin within the hogback.
Presently a very narrow, very short saddle or barrier of soft claystorie separates the higher and larger
drainage channel from the lower drainage basin. It is the CGS's opinion that this narrow saddle will not
last long and the main drainage flow will soon be redirected. That `stream capture' will result in larger
storm flows toward the two lots. The recent Geologic Hazard Report from Zancanella and Associates, Inc.
does not address this stream capture eventuality. We believe that the southeastern portion of the building
envelop, as currently shown on the preliminary plat, lie within a flash flood and debris flow hazardous
area. A suitable building envelope must be restricted to the western half of the lot.
Lot #2
We do not recommend acceptance of the northern portion of the building envelope as shown in
the geologic hazard report without additional geotechnical data. The steeper grades of that portion of the
lot #2, north of the power line easement, lie within the mapped landslide. The existing location of the
trailer home on this site is suitable but consideration of siting a new structure lower in the lot must factor
in the flooding potential stated above.

Dear Eric:
We have prepared this letter to address two concerns raised by the Colorado
Geological Survey (CGS) pertaining to the above referenced project.
Debris Flow Flooding - Currently the majority of runoff near the subject site flows
towards and crosses Highway 13 at a point northwest of the proposed subdivision. The
CGS has identified a critical channel reach above the property which is at risk of
redirecting flood runoff and debris flows towards the existing channel which currently
runs through the proposed Lot 1 of the subdivision This channel currently serves a
minor basin area above the subdivision. Assuming a large flood event (100 yr+) would
be redirected to the existing channel on Lot 1 from the larger basin to the northwest, we
have further limited the building envelopes on the two lots to offer additional protection
for habitable structures. The recommended building envelopes are identified on the
attached Figure 1.
The proposed building envelopes are located at least 4 feet above the existing channel.
The capacity of the channel at this depth is approximately 1,500 cubic feet per second
(cfs). The 100 year flood flow rate was conservatively estimated to be 450 cfs. The
100 year flood was calculated using piuuedures outlined in the Soil Conservation
Service Technical Release 55 and takes into account the steep rocky terrain of the
Hogback area. The tributary area for the flood was measured to be 245 acres (0.38 sq
mi) and assumes the all up gradient lands have flows redirected to the subject channel.
The existing channel has enough capacity to carry flows significantly greater than the
100 year flood for all of the potential contributing up gradient basin.
Landslide Deposits lot 2 - We do not believe the landslide is active. We recommend
that site specific soil test be conducted at any future proposed house site. To expend
funds on soil test at general locations is not prudent at this time.

INTRODUCTION
The purpose of this report is to identify general geologic conditions and hazards and to
recommend a plan for minimizing these hazards at the proposed Ponderosa
Subdivision.
Ponderosa Subdivision is located in the Southwest 1/4 of the Southwest 1/4 of Section 5,
Township 5 South, Range 93 West of the 6th P.M. as shown on the attached Figure 1.
Access to the site is via Highway 13 .
Vegetation in the area consists of wheatgrass, sagebrush, needle & thread, Indian rice
grass, rabbitbrush and an overstory of pinyon, cedar and juniper. Most of the site
appears to be in native condition.
GEOLOGIC SETTING
The study area is located on the southwestern edge of the Grand Hogback geologic
feature. The Hogback forms the geologic boundary between the Rocky Mountains and
the Colorado Plateau, it is made up of a thick section of formations which become
increasingly younger toward the west. The Eastern sections of these formations have
been uplifted and eroded away. Included in the visible section are the Wasatch
Formation, and the Mesa Verde Group. This site is underlain by Cretaceous aged Mesa
Verde Group. Site observations indicate that these rocks are dipping towards the
southwest at an approximate dip angle of 50 degrees or less.
Overlying the bedrock are surficial deposits which include alluvial fan deposits,
colluvium, and landslide or debris flow deposits. Interpreted geologic units are shown
on the enclosed Geologic Map, Figure 2.
Mesa Verde Group
The Mesa Verda Group and related beds overlying the Mancos Shale are not visible on
this property. This sequence of rock consists of thin and thick beds of yellowish brown
carbonaceous mudstone and fine to medium sandstone, conglomeritic sandstone, and
pebble and cobble conglomerate. This is underlain by the Mancos Shale Formation
consisting of thin beds of dark gray fossiliferous limestone and very fine silicious silty
sand stone.
Surficial Deposits
During post glacial and recent geologic times, the uplifting of the Grand Hogback and
the down carving of the Colorado River and its tributaries have produced the broad

valley of Rifle and the surrounding area. This weathered and eroded bedrock surface
has been covered by younger, surficial deposits producing the present surface
topography. The site has been identified on the "Preliminary Geologic Map of the Horse
Mountain Quadrangle" as containing both Quaternary alluvial fan deposits and landslide
deposits. The onsite investigation indicated that the landside material is not active.
Vegetation and existing power lines across the mapped landside material do not reveal
movement of the landslide has occurred in recent times. We believe with proper
foundation design the soils will allow for building development. We recommend that
engineered foundations be required based on site specific soils testing for any
proposed building foundations.
Bedrock and Soil Conditions
The present topography at the site developed slowly over the context of geologic time.
Post glacial erosion has occurred over the past 10,000 to 20,000 years. Recent erosion
produced the present configuration of the surface drainage in the Rifle area. We
anticipate that site excavations will encounter areas of conglomerate and alluvial
deposits. Some of the silt deposits may be subject to compression when wetted. This
process called hydrocompaction, affects the soils ability to maintain the distribution of
bearing loads. Compactive characteristics of the silty soils can be mitigated by proper
design and construction techniques. These issues can be addressed on a site specific
basis and can be accounted for in the foundation design.
Slope Stability
As discussed above, deep seated slope failures associated with bedrock orientation do
not appear to be a significant factor on this site. Slopes on site vary across the tract in
a southeasterly direction, slopes in the eastern portion of the project are in excess of 40
degrees. However, most of the slopes on this site are between 2 and 25 percent,
typically 15 percent within building envelopes.
Debris Flows
Due to the large percentage of bedrock which comprises the steeper slopes
surrounding the property, there is the potential for debris flow to occur in the existing
drainages. Direct construction of habitable dwellings should be avoided in the bottom
of these drainages. The building envelopes have been selected to provide the best
possible locations away from potential hazards. The recommended building envelopes
are shown on the attached Figure 3. Due to the relative small drainage basin above the
property the debris flows associated with any localized flooding should be re!a ively
minor. Figure No.3 also shows a minor drainage path shown through the Lot 2 building
envelope. Any future development which disturbs this drainage path should be required
to have a drainage plan prepared prior to any building permit approval.
