2. The Applicant understands and agrees that Garfield County Resolution No. 2014-60, as
amended, establishes a fee schedule for each type application, and the guidelines for the
administration of the fee structure.
3. The Applicant and the County agree that because of the size, nature or scope of the
proposed project, it is not possible at this time to ascertain the full extent of the costs
involved in processing the application. The Applicant agrees to make payment of the Base
Fee, established for the Project, and to thereafter permit additional costs to be billed to the
Applicant. The Applicant agrees to make additional payments upon notification by the
County, when they are necessary, as costs are incurred.
4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of
consulting service determined necessary by the Board of County Commissioners for the
consideration of an application or additional County staff time or expense not covered by
the Base Fee. If actual recorded costs exceed the initial Base Fee, the Applicant shall pay
additional billings to the County to reimburse the County for the processing of the Project.

SPECIAL WARRANTY DEED

Mineral Rights Owners
We searched the available records at the County Assessor's Office.
What we discovered was one major rights (1/2 of all rights and an
additional 117th of the other half). The other 6/7th of the half has
been split between many other relatives and these rights are not
recorded because of the change in county recording requirements.
We visited the only available mineral owner in Fruita, CO, who
provided the attached letter of consent. At this point all other owners
are non -traceable due to the change in county recording
requirements.

Building and Septic Permits
Septic Permit:
There will be no septic permit required. We have chosen an
alternative waste water management plan. As explained in the
Waste Water Management Section to follow.
Building Permit:
The building is in the developmental phase. The architect is working
on the plans for submittal. He is fully aware of the A-3 Occupancy
classification and the Garfield County Building Codes. He is
designing to these specifications. We are requesting that this permit
be granted conditional upon passing our final building inspection.
This was the suggested approach at our pre -application conference.

TYPE OF APPLICATION: Administrative Review — Community Meeting Facility
I. GENERAL PROJECT DESCRIPTION
The Applicants are requesting a land use permit for special events, including weddings, to be held
on their property located just north of Harvey Gap on a 12.79 -acre parcel located at 4450 CR 245.
The property is described as Lot 1, Harvey Gap Subdivision. No improvements currently exist on
the site.
Community Meeting Facility is defined as:
Community Meeting Facility. A facility for public gatherings including, but not limited to,
recreation halls and auditoriums, and holding events such as weddings, wedding receptions,
community meetings, and meetings and events sponsored by neighborhood groups, religious
groups, philanthropic organizations, etc
A detailed site plan of the development proposal and a description of the property subject to the
permit is required. A project narrative is required to describe (in detail) how the facility would
function, such as location of temporary improvements, how fire protection would be provided (such
as extinguishers) This narrative should provide as much detail as possible including all the
potential ways in which this use would function.
Water and sanitation is proposed via a vault and haul system, Applicant should clearly describe
how this would function on the site. Access to the site, both legal and physical access needs to be
described in writing and graphically.
The property is zoned Rural and the Comprehensive Plan designates the area as Residential
Medium High. The character of the area will remain primarily agricultural and residential in nature
with special events occurring mainly during the summer months.
Code Requirements
Site Plan — Locate where particular improvements will occur within the site, including access,
parking areas, location of water and sanitation. The site plan shall also include the physical
characteristics, slope and vegetation as an example, of the property in order to evaluate potential
impact of the proposal. Please see Section 4-203 D. for the details of what is required on this plan.
Water — provide a Water Supply Plan (see 4-203.M.). Proposal for hauled water should be detailed
including type of water storage, where the hauler gets the water, hauler affidavit regarding where
the water is purchased, etc. Locate these facilities (trucks or tanks) on the site plan.
Sanitation — provide a Wastewater Management Plan. This will include sanitation as well as
information related to food service. Hauler information should be provided as well as where these
facilities will be located on the site.
Traffic impact — A basic traffic analysis is required. This will include information regarding the
existing county road conditions (vehicles per day, road width, grade, etc) as well as proposed traffic
generated by the proposal. This document should analyze the ability of the existing road system to
handle the additional traffic generated by the proposal. The traffic generated by the proposal will
also be used to determine the on-site road improvements that will be required.
Parking — Parking locations and area must demonstrate compliance with Garfield County parking
standards in Section 7-302.
Food and Beverages — Describe how food service would occur as well as whether alcohol, if any,
will be handled. Will the caterer be responsible? Applicant should consult with the Clerk &
Recorder to determine if liquor license permits are required.
The applicant shall demonstrate conformance with the standards in Article 7, Divisions 1, 2, and 3 -
including legal and physical water supply to serve the use, adequate wastewater disposal, legal and
physical access, adequate parking, noise compliance with state statutes, Please respond to each of
the standards in Divisions 1, 2 and 3 and supply supporting documentation regarding the response.
II. REGULATORY PROVISIONS APPLICANT IS REQUIRED TO ADDRESS

• Garfield County 2013 Land Use and Development Code, as amended (LUDC);
a Section 4-101 - Common Review Procedures
o Section 4-103 - Administrative Review
o Section 4-201-203 — submittal requirements

a Section 4-202 — Waiver of Submission Requirements, if applicable
III. REVIEW PROCESS
This land use request requires submittal of a Land Use Change application that will be reviewed
through an Administrative process pursuant to the Garfield County Land Use and Development
Code, as amended (LUDC).
A. Pre -application Conference.
B. Application Submittal. Three paper copies and one CD.
C. Determination of Completeness.
D. Once complete a Director decision date will be scheduled.
E. Provide applicant documentation regarding notice requirements.
F. Request additional paper copies of applications, if necessary.
G. Evaluation by Staff resulting in a Report to the Director with a recommendation of
approval, approval with conditions or denial of the request based upon compliance
with standards.
H. Director Decision issued.
I. Decision provided to Applicant and to Board of County Commissioners for call-up
determination. if no call-up received within 10 -days the decision is final.
J. If approval is conditional the Applicant must satisfy conditions of approval.
K. Once conditions are satisfied the Land Use Change Permit can be issued and the
use commence.
IV. PUBLIC HEARINGS AND NOTICE
The Applicant is responsible for Public Notices which shall be mailed to adjacent owners within 200'
of the subject property and to all mineral owners of the subject property pursuant to Section 4-101.E.
No public hearing is required, unless called -up to the Board of County Commissioners.

General Application Processing
Planner reviews case for completeness and sends to referral agencies for comments. Case planner
contacts applicant and sets up a site visit. Staff reviews application to determine if it meets
standards of review. Case planner makes a recommendation of approval, approval with conditions,
or denial to the appropriate hearing body.
