1. Adjacent Property:
All adjacent property owners within 200' have been verbally notified
(see Property Neighbors Section).
2. Mineral Owners:
After searching records at the County Assessor's Office we contacted
the only available mineral owner, who provided the attached letter of
consent. At this point all other owners are non -traceable due to the
change in county recording requirements. (See Mineral Rights Owner
Section)
3. Adjacent Land Use:
Adjacent land is either agricultural or recreational. Farmer's Irrigation
has a lease with the State of Colorado for Grass Valley Reservoir
(fishing, boating and picnicking) and Sam Bryan, Grand Hogback
LLLP and Open Heart LLLP are all agriculture. There will be no
noticeable impact or change to the agricultural and recreational uses
of the land.
4. Site Features:
We will minimally be changing site features on this property. There
are no streams, the area is not a flood risk (see Site Plan), and the
facility location has at feast a 35' setback from the high water level of
Grass Valley Reservoir (See Site Plan). Where the agricultural
building will be constructed we are removing only the necessary
number of trees to allow for the building's footprint. Specifically
related to this special use permit request all trees within 50' will be
trimmed to 3-4' off the ground for fire mitigation along with other
preventative measures (see attach: 3- Fire Mitigation Plan).
5. Soil Characteristics:
Soil characteristics are applicable to the project where the sanitation
holding tank will be placed, the type of tank and the engineering of
the foundation to obtain the required building permit to satisfy
requirements for this application. Soil samples will be tested for the
building permit. For the waste water holding tank our engineer has

recommended a minimum 2000 gallon concrete tank, tar -coated, if
required. (see attach: 10- Web Soil Survey and Site Plan)
6. Geology and Hazard:
We plan to construct a perimeter fence of non -climbable v -wire
approximately 20 feet from the east and west sides of the building
and 40 feet from the south side. This fence will define the boundary
for the special use property. The area will be clearly marked with
signage and enforced by our personal representative. We plan to
also continue grazing the area outside the fence for fire mitigation.
The building itself is sufficiently located back from the high water
mark of the reservoir (see Site Plan). As evidenced by the
topographic survey map and the Google Maps picture there are no
geological hazards and the land is relatively flat.
7. Groundwater and Aquifer recharge areas:
Not applicable to this project. There are no waterways and we are
not putting in a septic system. Our vault and haul waste
management as seen on our site plan is setback more than 100' from
the high water mark as necessary for any waste management
system.
8. Environmental Impacts:
As discussed throughout this document we are striving to limit the
environmental impact of the special use of our agricultural building.
All impact will be handled readily and conscientiously. We are
attaching an expert's opinion from the District Wildlife Manager, Brian
Gray of Colorado Parks and Wildlife (CPW) (see attach: 6- CPW
Letter.) Brian's statement addresses flora & fauna, critical wildlife
habitat and any impact on wildlife and migration patterns. There are
no wetlands present on this site.
9. Nuisances:
A nuisance to adjacent landowners that we consider a possibility is
dust. If it is a very dry year and dust becomes an issue that gravel
does not control, we will also water the access road if necessary. We
already own a spray rig.
Another nuisance is noise and Tight impact. Noise and light impact
from this facility will also be minimal due to the location of the

building. The site is surrounded on 2 sides by Grass Valley Reservoir
and the other sides by our own private land and the nearest
residential house is about a half mile away. This location is perfect
for having low impact. Any outdoor lighting on the building will be
aimed downward with the exception of the building egress lighting on
the paths. Outdoor lighting will be limited to the Christmas light type
or solar path lighting. All lighting and activity will be confined to the
fenced in area and the parking area. Generators will be housed in an
enclosed/insulated and ventilated trailer to minimize noise and fumes.
Also, noise will be limited by requiring all events be moved inside the
building by 10 p.m. and kept within state specifications. Event
planners will be signing a rules contract that reserves us the right to
shut down an event if these rules are not followed. Unruly behavior
will be addressed. Each event will have a supervising representative
present. Also, this will be a non-smoking facility, which will also help
with fire mitigation. Hours of operation are projected to run with set-
up, event, and clean-up between noon and midnight: noting once
again that all activity will be inside after 10 p.m. Impact from
headlights leaving after dark should not be too concentrated, because
people usually leave these types of events at staggered intervals.
