The augmentation plan was originally approved in Case 82CW45 and was first amended in Case 82CW96. In 90CW102 the case was amended to replace depletions resulting from full build out of 17 lots having estimated in-house diversions of 350 gpd plus an additional 115 gpd for one caretaker unit on each lot and the watering of four horses per lot. Lawn irrigation from well diversions provided for 5,000 square feet per lot under the amended augmentation plan Hawk Ridge Well #1 was awarded an absolute water right for the diversion of 0.022 cfs of water (approximatelyl0 gpm). In addition, the Hawk Ridge subdivision is served by the Keller Well. The proposed maximum pumping rate for the Keller Well is estimated to be 30 gpm. Zancanella and Associates, Inc. currently operates the Hawk Ridge water system as a non -community water system. As a non -community water system, there are no requirements for state monitoring. As a routine portion of our operation services, we provide monitoring of the chlorination and ultraviolet disinfection systems for Hawk Ridge. As their operator we also provide monthly monitoring of total coliform bacteria, and annual monitoring of nitrate and nitrite levels. For your review, we have attached two years of monitoring summaries. As we stated, there is currently no requirement for inorganic testing, however, we have attached two test results of inorganics from 2000 and 2005 from our files. Finally, we have also provided diversion records for the Keller Well and the Hawk Ridge Well #1 showing their ability of the wells to successfully to meet the needs of the subdivision. Such adjudication of historic consumptive use credit remains but is deleted from this plan for augmentation as the Applicant does need such credits and is otherwise fully augmented. B. In Case No. 82CW096, the Applicant obtained a decree allowing for the t:se of the Hawkridge Pond No. 1 as an additional source of augmentation water for the development. In Case No. 82CW096, the Court decrecii a now water right for 5.0 acre-feet, conditional, to the reservoir and also allowed for a change of water rights decreed to the C&it4 Ditch and to the C&F Enlargement of the C&I.4. titch for storage in and subsequent release from the Hawi ridge -Pond No. 1. The C&N1-Ditch and the C&F Enlargement of the CdtM Ditch water' rights are more particularly described as follows: c: HLES';AWX.IRU SgYdet 15.,992 (1) CFcM Ditch, awarded 6.0 c.f.s. with an appropriation date of June 25, 1885, in District Court for Garfield County, Colorado, in Civil Action No. 132, on May 11, 1889, for irrigation purposes. Applicant's share of this water right is 1.0 c.f.s. The decreed point of diversion is a headgate -3- Case No. 90CW102 Page 4 located on the South Bank of Cattle Creek approximately eight and one- half miles above the mouth of said creek in Section 9, Township 7 South, Range 87 West of the 6th P.M. (2) C&F Enlargement of the C&M Ditch, awarded 8.0 c.f.s, with an appropriation date of September 2, 1902, in District Coat for (la -Meld County, Colorado, in Civii Action No. 1075, on May . 31, 1905, for irrigation purposes. Applicant's share of this water tight is 1.3 c.f.s. The decreed point of diversion is a hcdgate located on the South Rank of Cattle Creek approximately eight and one-half miles abuve the mouth of said creek in Section 9, Township 7 South, Range 87 West of the 6th P.M. The Hawkridge Pond No. 1 water right is mere parucelarly described as follows: (1) The center of the abutment of the dam for said s!rueture is tocated in Section 13, Township 7 South, -Range -88 West of the 6at• P.M. whence the -South -114 Corner of said Section 13 beats South 87°25'15° West a distance of 1,080 feet. Total capacity of the reservoir i 2.9 acre-feet, with an active capacity.of 2.1 acre-feet and diad storage of 0.8 acre-feet. The source of water for the reservoir is Cattle Creek through the C&M Ditch, tributary to the Roaring Fork River, tributary Gi t e Colorado River. In Case No. 82CW96, the Court quantified that, based upon 1.5 acre-feet of consumptive use per acre, the drying up of five aces will make available 7.5 acre-feet of consumptive use which can be used for augmentation purposes during the historic non -irrigation season (November to April). The donee allowed the Applicant to store 4.5 acre-feet of the 7.5 acre-feet of available consumptive use in Hawkridge Pond No. 1 and allowed the Applicant to divert 0.075 c.f.s. through the C&M Ditch to fill the Hawlridge Pond No. 1. The deem: specifies that, at such time as the pond is filled, said rate of flow shall continue to be diverted to the pond and released on a flow-through basis to the Crystal ;;piing drainage. 7. The historic use of the water "rights "to be used for augmentation were fully described in Case Nos. 82CW045 and 82CW096 and in the engining reports dared € ctober 27, 1989, March 20, 1990, and March 22, 1990, attachotl to the application as exhibits. 8. This amendment to the augmentation plan is proposed by the Applicant to: (1) Account for the change in wastewater treatment facilities; (2) to claim red& itional historic consumptive use credit associated with additional land removed from irrigation to augment additional uses; and (3) to allow direct flow irrigation use by diversion from Cattle Creek through the Park Ditch of a portion of the Applicant's augmentation water previously committed to euggmentation. B. In Case Nos. 82CW045 and 82CW096, the decrees were issued upon the assumption that evapotranspiration wastewater trealmeat facilities were necessary for this development. The augmentation pians decreed in Case Nos. 82CW045 and 82CW096 are based upon 100 percent consumptive use of alt in-house diversions. The estimated consumptive use rate for septic ianW leachfield systems is IS percent of all in-house diversion, and the Applicant wishes to take advantage of the decrease in the amount of consumptive use. C. The Applicant requested the following changes in its application: (1) Increase the diversion of water per lot to 350 gallons per day .for the main residence plus 115 gallons per day per guest house; and (2) Increase the amount of irrigation from 1,000 square feet to 5,030 square feet per lot; and (3) Increase the number of livestock for each lot from two to four. D. The amount of land dried up that was originally irrigate( by the C&M Ditch and C&1' Enlargement of the C&M Ditch water rights has been recalculated to be 6.5 acres rather than 5 acres. The additional 1.5 acrn of dry.aro (total of 6,5 acres) results in a total of 9.75 acraefeet cf consumptive use crudites available rather than the previously adjudicated 7.5 acre-feet. This calculation is me& upoa the same basis as act forth in Case No. 82CW096, This 935 acre-feet of consumptive tiSe-' credit will be used to augment for depiction as set forth in the previous cases sad as referenced herein. B The subdivision as currently planned will experien a 6.80 acre-feet of dplcdons per year and 1.30 acre-feet of pond evaporation per year. The total amount of depletions is 8.1 acre-feet per year. However, the Applicant hereby commits 8.25 acre-feet of historic consumptive use credits to this plan. F. The fiawkridgc Pond No. 1 fill rate will remain at 0.025 c.f.s. and as more fully set forth in Case No. 82CW096. O. This amended plan for augmentation does not contemplate use for aug:nentation of the 3.99 acre-feet of consumptive use credit adjudicated in Case No. 82CW045 for the Park Diteli and Reservoir Company water rights owned by the Applicant. The Applicant proposes to use such water for irrigation through the Park Ditch with this right to irrigate Lots 7, 8 and 9 in the ilawk Ridge Subdivision. The headgate of the Park Ditch is located on the Southwest' bank of Cattle Crcek in the Northwest 1/4, Southwest 1/4, Southeast 1/4 of Section 7, 'Township 7 South, Range 87 West of the 6th P.M. No Stipulation with the Objector Park Ditch and Reservoir Company has been reached ccncertirng this claim. This claim remains open and is subject to litigation in this case. RIJLI D_Q TIIE 8F R RR The amendments to the Augmentation Plan decreed in Case Nos. 82CW45 and 82CW96 as more fully set forth in Paragraph 8, above, are hereby granted. Specifically, such amendments are as follows: 1. Individual sewage disposal systems or septic tank/ieachfie!ds will be used in the Subdivision. The consumptive use associated with use of such disposal system is 15 percent for all in-house diversions. The consumptive use of all ir.-house diversions calculated as 100 percent of diversions in Case No. 82CW45 and 82CW96 is hereby amended to be 15 percent. 2. The amount of water that can be diverted for use by each lot is increase to 350 gallons per day for the main..idence and !IS gallons per day for each guest touts:. 3.- Lawn and garden irrigation speeified m 1,000 square feet per lot in Case elo. 82CW45 is hereby amended and increased to 5,000 square feet per lot, with the wells only. Such amendments change the augmentation requirements adjudicated in Case Nos. 82CW45 and 82CW96. The following changes to the augmentation requirements are hereby approved.
