Dear Kathy,
On behalf of the Rockford Ditch Association (RDA) and at Mr. Badgett's request, I am writing to inform you
that he has been diligent in his efforts to obtain permission from the RDA to modify the lateral that traverses his
property. Furthermore, for your information, I believe there is a high likelihood that such permission will be
granted as his engineers have so far been responsive to our requests. Please do not hesitate to contact me with

Good afternoon Alpen,
On September 18, 2015 you submitted a Land Use Change Permit application for an ADU. A letter regarding technical
deficiencies was provided to you on September 25, 2015 with a requirement to resolve the technical deficiencies within
60 days (November 25, 3015). You were unable to resolve the technical issues by that date and therefore requested,
and were granted, a 90 -day extension to February 26, 2016.
The County has not heard from you since the extension was granted in November. If you are unable to meet the
deadline of February 26, 2016 you may either request a withdrawal of the application or request an additional extension
of time. If you request additional time you will need to clearly show that you have made progress in resolving the
technical issues. Pursuant to the land use code you must request an extension prior to the expiration of the timeframe.
Please be aware that our office is closed on Friday February 26th so you will want to resolve this issue prior to that time.

Kathy,
In response to the letter you sent on Sept. 25 referencing the Badgett Accessory Dwelling Unit - File
Number GAPA-09-15-8389, we would like to request an extension of the 60 -day period to address
the remaining issues required for approval. We are currently in the process of finalizing an
agreement to pipe the section of Rockford Ditch affecting our setbacks. I would anticipate that this
requirement and the others referenced will be completed within the next 45 days.

some of the identified issues will take some time to resolve, however our land use code allows a 60 -
day period to address those issues.
I have only heard from the irrigation company related to their review of your request to amend the
ditch on your property. They said that they were working with you to resolve this issue. However, I
have not heard from you on your ability to work through the issues nor have I been informed on any
progress made to bring the application into technical completeness with our land use code
requirements.
The 60 -day time frame will expire on Wednesday November 25th. If you would like to keep your
application in the County review process you will need to respond to the letter that I provided to you
on September 25th and let us know what progress you have made on addressing the issues. In
addition we would expect you to request an extension of the 60 -days by providing us an anticipated
time in which you will address all the issues so that we can move forward with the actual review of the
application.
For your convenience I've attached a copy of the letter sent to you. I look forward to hearing from
you, however if I do not hear from you prior to next Wednesday your application will be withdrawn.
