agencies,
• Site safety/evacuation plan, and
• Other written response plan for potential emergencies at the Site
Identification of dates, including:
• Final date of Facility installation,
• Date of Removal of the Facility, and
• Total number of days that the Facility will be installed at the Site.
Emergency Notification. All emergency situations requiring action by any government agency or district
shall be documented in writing and presented to the Planning Department and Garfield County Sheriff's
Office within 24 hours of the occurrence. Failure to report such emergency situations shall be deemed a
violation of the 2013 Land Use and Development Code.
As an authorized representative of the Garfield County Sheriff's Office(S.O}, I verify that the 5.0. has
received adequate submittal information to carry out emergency response in regards to the
aforementioned Minor Temporary Employee Housing Facility. It is understood that the S.O. is not
obligated to sign-off on this form if further information, either in terms of quality or quantity, is necessary
to carry out the S.0.'s purpose and mission.

I. GENERAL PROJECT DESCRIPTION
Caerus Oil and Gas would like to request a permit for the location of 6 trailers to house up to 16
workers for the drilling of Savage Pad 17L-794. A Minor Temporary Employee Housing permit is
required for facilities that are 1) completely contained on a COGCC well pad, 2) that will be located
on the site less than 1 year, and 3) have occupancy of 9 to 24 people who are supporting the drilling
operation. Caerus estimates they will need to trailers in place for a minimum of 3 months during
these 24-hour operations.
II. REGULATORY PROVISIONS APPLICANT IS REQUIRED TO ADDRESS
Garfield County Comprehensive Plan 2030
Garfield County Land Use and Development Code, effective July 15, 2013
Section 4-107 Minor Temporary Employee Housing Facility
Section 4-301. Minor Temporary Employee Housing Submission Requirements.

III. REVIEW PROCESS
The review process shall follow the steps as contained in Table 4-102 with modifications to
call-up procedures as noted in Section 4-107 (see attached flow chart and below outline).
Pre-Application meeting;
Submittal of Application (3 copies and one CD);
Completeness Review;
Submittal of additional materials (if needed)
Setting a date for the Directors Determination;
Public Notice 15 days prior to the Director’s Decision to property owners within 200 feet
and mineral rights owners on the subject property;
Directors Decision including any conditions;
A 10 day Call-up Period after Director’s Decision is made.
IV. SUBMITTAL REQUIREMENTS
In accordance with Section 4-301, Applications for a Minor Temporary Housing Facility must include the
following:
1. General application materials pursuant to 4-203.B.
2. A Vicinity Map presented on a USGS 7.5-minute series quadrangle at a scale of 1 inch
equals 2,000 feet or equivalent, with a topography depicted at a minimum of 40 -foot
intervals, and that indicates the following:
a. The section, township, and range of the subject parcel and the location of
Minor Facility within the subject parcel and the Permitted Site;
b. General relation to surrounding public roads, private roads, adjacent utility
systems, residential development, other actively permitted Minor and Major
Facilities, natural drainage courses, and municipalities within 1 mile of the
proposed Minor Facility;
c. North arrow and scale; and
d. GPS coordinates and current surface ownership of the subject lot.
3. Site Plan consistent with section 4-203.D. and including the following information:
a. The proposed location and anticipated layout for the Facility.
b. Site specific, surveyed maps depicting the location of the Facility, located
within the Permitted Site within the subject parcel.
c. The dates of installation and removal for the Facility. The list shall also include
the estimated total cumulative length of time that the Facility is anticipated to
be installed at the proposed location.
d. The sewage and wastewater disposal, trash receptacles, potable water
storage, all other associated infrastructure, and all other equipment located
within the Permitted Site.
e. Identification of the private and public roadways accessing the Facility.
Roadways shall be marked as open, gated, and/or locked (include
combinations). Detailed directions, with mileage, shall be given from the
nearest town within the County, nearest County Sheriff’s Office dispatch
location, and responsible fire district headquarters to each Minor Facility

along each roadway.
f. The name, address, and phone number of surface owner of the subject lot or
the Permitted Site if the Permitted Site is within the Resource Land Zone
Districts.
g. The name, address, and phone number, including a 24-hour emergency
response number of at least 2 persons responsible for the Operator’s
emergency field operations; contact numbers for local Hospitals, emergency
response, fire protection districts, the County Sheriff’s Office, Life/Care Flight,
and applicable regulatory agencies; site safety/evacuation plan; and any other
written response plan for potential emergencies at the Permitted Site.
4. Sign-offs from the County Sheriff’s Office, relevant fire protection district(s), and
Community Development Department consistent with the requirements of this Code.
5. Use and Occupancy Certification.
a. A legible photo of the State Division of Housing Seal certifying the housing unit
that will be used meets the use and occupancy per Building Code; or
b. Stamped certification by the State Department of Housing that the use and
occupancy of the housing unit will meet the building and fire code
requirements.
6. A description of infrastructure and services that will be provided at the site.
7. Evidence of the physical and legal water supply and a general description of the water
system planned for potable water, along with details regarding number and volume of
potable water tanks; source of water; name of hauler; hauler’s CDPHE identification
number; and copy of hauler’s CDPHE certification, frequency of delivery, calculation
of water demand, and demonstration of adequate capacity.
8. A general description of the system planned for collection and storage of sewage and
wastewater, along with details regarding number and volume of sewage and
wastewater vaults; name of hauler; frequency of pickup; identification of sewage
disposal site; calculation of sewage and wastewater treatment demand; and
demonstration of adequate storage and/or treatment capacity.
9. A general description of the system planned for collection and disposal of refuse,
including number, type, and volume of collection containers; name of hauler;
frequency of collection; and identification of refuse disposal site.
10. A list of adjacent surface owners, as identified in the records of the County Assessor
or the Clerk and Recorder’s Office, located within 200 feet of the subject parcel or 200
feet from the Permitted Site if the Permitted Site is within the Resource Land Zone
Districts, and a list of separated mineral estate owners in the subject lot or the
Permitted Site if the Permitted Site is within the Resource Land Zone Districts.
11. The name, title, address, phone number, and email address of the Operator’s
Compliance Officer or other authorized representative who is in charge of ensuring
that the Minor Facility is in compliance with the standards outlined in this Code.
12. A form provided by the Community Development Department and signed by the
Operator’s Compliance Officer, indicating that the Minor Facility will be installed in
accordance with all applicable County, relevant fire district, State, and Federal
regulations.
13. A form, provided by the Community Development Department and signed by the

Operator’s Compliance Officer, indicating that the Operator submits to the
enforcement provisions identified within this Code
14. A copy of the permit from the State or Federal agency regulating the Permitted Site,
identifying the location, conditions of approval, time period for which the permit is
valid, and the parameters for reclamation, and revegetation of the Minor Facility once
the State or Federal permit for the Permitted Site has expired or is otherwise
terminated

Caerus provides electricity for lights and heat from the rig generators, potable water
from tanks, and drinking water from bottles, television, and bunks for sleeping. A 10 x
20 trash receptacle will be located east of the rig. The waste hauler, Western Colorado
Waste will pick‐up daily and take all trash to the Garfield County Landfill.

List of Performance Standards for Minor Temporary Employee Housing Facility
A. Federal, State, and Local Laws and Regulations.
Minor Facilities must comply with all applicable Federal. State, and local laws and
regulations.
B. Notification of Facility Installation and Removal.
The Sheriffs Office and relevant fire protection district(s) must be notified at least
24 hours prior to installation and removal of each Minor Facility. The Community
Development Department shall be copied on all such notification, whether hard
copy or electronic.
C. Water Systems.
Water systems shall comply with standards set forth in section 7-705.B. (as
excerpted below):
Water Systems.
1. Water systems must comply with all applicable State and local laws and
regulations.
2. All potable water systems must include a meter and the Operator must
keep a record of the daily usage.
3. For sites to which potable water is hauled, Operators shall:
a. Keep appropriate records, to be provided to the County upon
request, to demonstrate that water supplied to a site is from an
approved source and that wastewater is disposed at an approved
facility.
b. For water facilities not permitted by the CDPHE, the Operator
must conduct monthly tests (or quarterly if an on·site disinfection
system is installed) and maintain records of potable water samples
specific for coli form. Any tests indicating coli form contamination
must be disclosed to the County Public Health Department.
c. Water systems facilities permitted by the CDPHE must obtain all
necessary State permits or demonstrate that applications for any
necessary permits have been submitted prior to a determination by
the County that an application is complete.
d. Maintain compliance with State regulations at all times during
operation.
4. In no case shall unsafe water be used for drinking nor shall raw sewage
or used water be discharged onto the ground surface.

D. Wastewater Systems.
Wastewater systems shall comply with standards set forth in section 7-705.C. (as

Wastewater Systems.
1. Wastewater systems must comply with all applicable State and local
laws and regulations.
2. Wastewater may be disposed of using either an owrs or a vault-and-
haul system. A vault-and-haul system must demonstrate the following:
a. Year-round access is available and maintained for safe and
regular access for sewage hauling vehicles;
b. The Operator can demonstrate and guarantee an arrangement
for hauling sewage;
c. The Operator will maintain all records, including but not limited
to, trip logs/reports and landfill receipts;
d. The sewage disposal records will be maintained as public
records to be available to the County upon request;
e. The facility will not exceed a cumulative of 1 year at the
approved location; and
f. The facility has been designed to accommodate 75 gallons of
wastewater per person per day or an amount derived from
engineered calculations taken from metered usage rates at a
similar facility that has been reviewed and approved by the County.
E. Clean, Safe, and Sanitary Condition.
Minor Facilities shall be maintained in a clean, safe, and sanitary condition, free of
weeds and refuse. Any hazardous or noxious materials that must be stored at the
Minor Facility for operational or security reasons must be managed in accordance
with all applicable Federal, State, and local laws and regulations.
F. Trash and Food Storage.
Wildlife-proof refuse containers must be provided for trash. Outdoor food storage
is prohibited unless facilities are provided that prevent the attraction of animals to
the Major Facility site.
G. Fire Protection.
1. Provisions for giving alarm in case of fire and fire suppression must be
installed per fire codes and as required by the fire protection district.
2. Single-station carbon monoxide alarms must be placed in each
Manufactured Home or Recreational Vehicle unit.
H. No Domestic Animals Allowed.
Domestic animals are prohibited.
I. Removal of Facility.
Within 1 O days following the expiration or other termination of the Land Use
Change Permit or represented date of removal identified within the Land Use
Change Permit, all housing structures, foundations, and associated infrastructure
shall be completely removed. The Operator shall provide the Director with photos,
dated and signed by the Operator's compliance officer, indicating that all housing
structures, foundations, and associated infrastructure have been removed within
the specified timeframe.

Operator must ensure secondary containment for any volume of fluids contained at well
site during drilling and completion operations (as shown on the Construction Layout
Drawings, Facility Layout Drawing, Proposed BMPs, and Location Drawing
attachments); including, but not limited to, construction of a berm or diversion dike,
diversion/collection trenches within and/or outside of berms/dikes, site grading, or other
comparable measures (i.e., best management practices (BMPs) associated with
stormwater management) sufficiently protective of nearby surface water. Any berm
constructed at the well pad location will be stabilized, inspected at regular intervals (at
least every 14 days per CDPHE requirements and after precipitation events), and
maintained in good condition.
The access road will be constructed and maintained as to not allow any sediment to
migrate from the access road to nearby surface water or any drainages leading to
surface water.
Strategically apply fugitive dust control measures, including encouraging established
speed limits on private roads, to reduce fugitive dust and coating of vegetation and
deposition in water sources.
The location is in an area of moderate to high run-on/run-off potential; therefore
standard stormwater BMPs must be implemented; prior to, during, and after
construction, as well as during drilling, completion, and production operations; at this
location to insure compliance with CDPHE and COGCC requirements and to prevent
any stormwater run-on and /or stormwater run-off.
Berms or other containment devices shall be constructed to be sufficiently impervious
(corrugated steel with poly liner or equivalent) to contain any spilled or released material
around permanent crude oil, condensate, and produced water storage tanks.
The moisture content of drill cuttings managed onsite shall be kept as low as practicable
to prevent accumulation of liquids greater than de minimis amounts. After drilling and
completion operations have been completed, the drill cuttings that will remain on the
well pad location (cuttings management area, the cut portion of the pad, cuttings trench,
dry cuttings drilling pit), must meet the applicable standards of Table 910-1. After the
drill cuttings have been amended (if necessary) and placed on the well pad, sampling
frequency of the drill cuttings (to be determined by the operator) shall be representative
of the material left on location. No offsite disposal of cuttings to another oil and gas
location shall occur without prior approval of a Waste Management Plan (submitted via
a Form 4 Sundry Notice) specifying disposal location and waste characterization
method. Commercial disposal of drill cuttings will only require notification to COGCC via
a Form 4 Sundry Notice.
Flowback and stimulation fluids must be sent to tanks, separators, or other
containment/filtering equipment before the fluids can be placed into any pipeline,
storage vessel, or lined pit (only if an amended Form 2A has been submitted/approved
and a Form 15 Earthen Pit Permitted has been submitted/approved) located on the well
pad; or into tanker trucks for offsite disposal. The flowback and stimulation fluid tanks,
separators, or other containment/filtering equipment must be placed on the well pad in
an area constructed to be sufficiently impervious to contain any spilled or released
material.
Potential odors associated with the completions process and/or with long term
production operations must be controlled/mitigated.
Operator shall pressure test pipelines in accordance with Rule 1101.e.(1) prior to
putting into initial service any temporary surface or permanent buried pipelines and
following any reconfiguration of the pipeline network.

3 Wildlife March 2015 - Caerus Piceance LLC (Caerus) formally requested and received
authorization from Colorado Parks and Wildlife (CPW) to transfer the Noble Energy,
Inc. (Noble) Wildlife Mitigation Plan Agreement (WMPA) to Caerus’ existing WMPA.
Caerus is currently adhering to all aspects of both WMPAs through Caerus’ current
best management practices.
All garbage and any food items will be placed in bear proof trash containers.
4 Storm Water/Erosion
Control
Stormwater is addressed under a field-wide Stormwater Management Plan (CDPHE
Certification #COR039527).
Run-on protection and run-off controls will be installed prior to the beginning of
construction activities, as practicable, with consideration given to worker safety,
wildlife, and site access.
Best Management Practices
Approval of this Form 2A and the Form 2 for the injection well (Form 2# 400854939)
does not authorize operator the right to inject. Authorization to inject into the selected
Formation(s) requires approval of both the Form 31 and the Form 33.
Operator will use qualified containment devices for all appropriate chemicals/hazardous
materials and injection equipment (pumps) used onsite during the operation of the
injection well.
All tanks and aboveground vessels containing fluids must have secondary containment
structures. All secondary containment structures/areas must be lined. Operator must
ensure a minimum of 110 percent secondary containment for the largest structure
containing fluids within each bermed area at the facility during operations. The
construction and lining of the secondary containment structures/areas shall be
supervised by a professional engineer or their agent.
Operator shall equip and maintain on all tanks an electronic level monitoring device.
Unless otherwise determined by COGCC staff (Bob Koehler) that a water sample of the
proposed injection formation is not required, before hydraulic stimulation of the injection
well, operator shall collect a groundwater sample from the Cozzette-Corcoran
Formation and the Ohio Creek Formation and analyze for total dissolved solids (TDS);
submit laboratory analytical results to COGCC (emails: bob.koehler@state.co.us and
arthur.koelspell@state.co.us).

5 Construction Stockpiles for topsoil and excess cut material will be located in work areas surrounded
by a BMP.
Stormwater BMPs will be installed per details in the Stormwater Management Plan
(SWMP).
Disturbed area of site will be left in a surface roughened condition when feasible.
BMPs will be protected, inspected and repaired as necessary.
Dust mitigation practices will be utilized.
New flowline installations will be performed in accordance with new flowline guidance
provided by the COGCC concerning Rules 1101 and 1102.
Berms or other containment devices shall be constructed to be sufficiently impervious
(corrugated steel with synthetic liner) to adequately contain any spilled or released
material around crude oil, condensate, and produced water storage tanks, while also
ensuring the adequate prevention of significant adverse environmental impacts.
6 Drilling/Completion
Operations
Closed loop system will be used. No pits will be built.
Completion operations will be performed to ensure adequate prevention of significant
adverse environmental impacts.
Caerus will ensure 110 percent secondary containment for any potential volume of
fluids that may be released.
7 Interim Reclamation Once all topsoil has been distributed across the site, the location is then seeded by
drill seeding methods or broadcast seeding. All reclaimed areas except areas needed
for production will comply with the landowner’s requested seed mix containing grasses
“be planted for elk in the area”; or the recommend BLM seed mix that will be used is
“Mixed Mountain Shrubland, including Oakbrush”.
Re-vegetation is accomplished as soon as practical following the preparation of a site
for final stabilization. Seeding will be done when seasonal or weather conditions are
most favorable.
On terrain where drill seeding is appropriate, seed may be planted using a drill
equipped with a depth regulator to ensure proper depth of planting.
8 Final Reclamation Re-contouring: Unless an agreement is made with the landowner to keep the road
and/or pad in place, the disturbed areas surrounding the well location, including the
access road will be re-contoured to blend as nearly possible with the natural
topography. Final grading of back-filled and cut slopes will be done to prevent erosion
and encourage establishment of vegetation. Existing drainages will be re-established.
Re-vegetation: The long term objective is to establish a self-perpetuating plant
community that is compatible with and capable of supporting the identified land use.
Noxious weeds will be treated in accordance with applicable COGCC rules.

OGLA LIST OF PROJECT RULISON RECOMMENDED COAs BASED ON THE RULISON
SAMPLING AND ANALYSIS PLAN:
Comply with all DOE Office of Legacy Management requests for sampling and
analysis of natural gas and other materials associated with drilling and production.
Operator must ensure 110 percent secondary containment for any volume of fluids
contained at well site during drilling and completion operations. If fluids are
conveyed via pipeline, operator must implement best management practices to
contain any unintentional release of fluids.
Flowback and stimulation fluids must be sent to tanks, separators, or other
containment/filtering equipment. The flowback and stimulation fluid tanks must be
placed on the well pad in an area with additional downgradient perimeter berming.
The area where flowback fluids will be stored/reused must be constructed to be
sufficiently impervious to contain any spilled or released material.
Produced water from this location may not be transported to or re-used at another
location without specific written approval from COGCC and only after analysis
confirms compliance with the Rulison SAP.
Drill solids and cuttings from this location may not be transported to, disposed of or
re-used at another location without specific written approval from COGCC and only
after analysis confirms compliance with the Rulison SAP.
A closed loop mud system shall be utilized to ensure containment of all materials
that have been in contact with downhole strata and fluids. All cuttings and fresh
make up water storage pits shall be lined to ensure containment. Contour features,
french drains and other stormwater bmps as necessary shall be employed to ensure
site integrity.
No individual operator shall utilize more than one rig within one mile of the project
rulison blast site at any given time and no individual operator shall utilize more than
two rigs within a three mile radius of the site at any given time. The total number of
rigs allowed by all operators within three miles of the site shall be limited to five at
any given time.
Operator shall comply with all provisions of the most recent COGCC approved
revision of the Rulison sampling and analysis plan. In addition to the produced water
sampling and analysis outlined in section 5.8 of the plan the operators shall also
obtain and analyze produced water samples on wells described in the plan for
constituents listed in the plan using the specified method where applicable.
The moisture content of any drill cuttings in a cuttings pit, trench, or pile shall be as
low as practicable to prevent accumulation of liquids greater than de minimis
amounts. At the time of closure, the drill cuttings must also meet the applicable
standards of table 910-1.
No portion of any pit that will be used to hold liquids shall be constructed on fill
material, unless the pit and fill slope are designed and certified by a professional
engineer, subject to review and approval by the director prior to construction of the
pit. The construction and lining of the pit shall be supervised by a professional
engineer or their agent. The entire base of the pit must be in cut.

with all the rights, privileges, immunities, and appurtenances, of whatsoever
nature, thereunto belonging~ unto the said Joan L. Savage, her heirs and
assigns, forever; and '
EXCEPTING AND RESERVING TO THE UNITED STATES:
1. A right-of-way thereon for ditches and canals constructed by the.
authority of the United States. Act of August 30, 1890 (26 Stat. 391;
43 u.s.c. 945).
2. All the oil, gas, and oil shale deposits in the lands so patented
and to it, its permittees, licensees and lessees, the .;right to explore
for, drill for, mine and remove the minerals owned by the United States
under applicable law and such regulations as the Secretary of the Interior
may prescribe. This reservation includes necessary access and exit rights
and the right to conduct all necessary and incidental activities '
including, without limitation, all drilling and surface mining operations,
storage and transportation facilities deemed reasonably necessary.
Unless otherwise provided by separate agreement with the surface owner,
permittees, licensees and lessees of the United States shall reclaim
disturbed areas to the extent prescribed by regulations issued by the
Secretary of the Interior •

All causes of action brought to enforce the rights of the surface owner
under the regulations above referred to shall be instit11ted against
permittees, licensees and lessees of the United States; and the United
States shall not be liable for the acts or omissions of its p2rmittees,

The Minor Temporary Employee Housing “sign‐off” sheet was hand delivered to Orrin Moon on April 28th. Orrin is the
Acting Division Chief/Fire Marshall at the Colorado River Fire Rescue in Rifle, CO.
We are waiting for Orrin to sign this document and email to you.
The “public records” were search by Caerus Piceance LLC to determine mineral ownership.

2. OWNER understands and agrees that Garfield County Resolution No. 98-09, as
amended, establishes a fee schedule for each type of subdivision or land use review applications,
and the guidelines for the administration of the fee structure.
3. OWNER and COUNTY agree that because of the size, nature or scope of the proposed
project, it is not possible at this time to ascertain the full extent of the costs involved In processing
the application. OWNER agrees to make payment of the Base Fee, established for the PROJECT, and
to thereafter permit additional costs to be brlled to OWNER. OWNER agrees to make additional
payments upon notrfication by the COUNTY when they are necessary as costs are incurred.
4. The Base Fee shall be In addition to and exclusive of any cost for publication or cost of
consulting service determined necessary by the Board of County Commissioners for the
consideration of an application or additional COUNTY staff time or expense not covered by the Base
Fee. If actual recorded costs exceed the Initial Base Fee, OWNER shall pay additional billings to
COUNTY to reimburse the COUNTY for the processing of the PROJECT mentioned above. OWNER
acknowledges that all billing shall be paid prior to the final consideration by the COUNTY of any land
use permit, zoning amendment, or subdivision plan.
