The facility was conditionally approved by the Board of County Commissioners by Resolution No. 2014-42 (see attached). The one year time frame to meet the conditions of approval has expired. The extension request letter is attached with this memo and provides background on the circumstances associated with the need for the extension. The Applicant has submitted copies of the documentation required by the remaining conditions of approval. Staff has reviewed the documentation and had follow-up meetings with the applicant to review the conditions. The documents provided have been determined to satisfy all remaining conditions. The facility is an existing Compressor - Pipeline Pump Station (not subject to Article 9). A vicinity map and site plan are attached. The properly is a developed oil and gas site with previous county approvals for the site including a pipeline development permit. The extension request is being submitted to the Board in accordance with Section -101 (l) of the Land Use and Development Code. Subject to the Board's approval of an extension the Land Use Change Permit is ready to be issued. APPLICABLE CODE PROVISIONS In accordance with Section 4-101(lX4) the Board of County Commissioners "may grant an extension of an otherwise expired approval upon a finding by the BOCC that the failure to file for an extension was due to extenuation circumstances and that it benefits the public interest to grant the extension." The Board opened a public hearing on the 2l* day of July, 2014 for consideration of whether the proposed Land Use Change Permit should be granted or denied, during which hearing the public and interested persons were given the opportunity to express their opinions regarding the request. G. The Board closed the public hearing on the 2l't day of July, 2014 to make a final decision. H. The Board, on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determinations of fact: 1. That proper public notice was provided as required for the hearing before the Board. 2. The hearing before the Board was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. Prior to the issuance of the Land Use Permit, the Applicant shall provide confirmation that the Station site is covered by COGCC Bonding or other security acceptable to the County Attorney's Office for site reclamation. Prior to issuance of the Land Use Change Permit the Applicant shall update the site plan to show all easements including pipeline easements accessing the facility. The Applicant shall also provide information on pipelines serving the facility confirming that they are properly permitted or exempt from permitting in accordance with the Code. The Applicant shall maintain proper pemritting and compliance with CDPHE Air Quality Regulations and Stormwater Discharge Regulations- Compliance with the Storrnwater Management Permit and Best Management Practices for the site shall be required. The Applicant shall complete the recommended upgrades and repairs to the drainage system as recommended in the Drainage Report (dated 5l23ll4) completed by River City Consultants. Both the high and low priority items shall be completed and notification provided to the Garfield County Community Development Departrnent upon completion. The improvements shall be completed within 90 days of approval of the Land Use Change Permit. The Applicant shall comply with the wildlife habitat mitigations recommendations contained in the report by Westwater Engineering Inc. A waiver from the access standards contained in Table 7-lO7 is granted for maximum road grade and curve radius consistent with the Applicant's Report on Policy 04-01 Roadway Waivers completed by River City Consultants (dated 614/14) and the roadway alignment surveys submitted with the Application The Applicant's Noise Analysis estimates that the Station will operate in compliance with COGCC Noise Standards. Should noise issues be raised in the future, the Applicant shall complete a supplemental noise test to confirm compliance. Pursuant to said results, if additional noise mitigation is required to achieve compliance with COGCC standards, the Applicant shall complete said additional mitigation. Noise control packages including hospital grade mufflers and soturd attenuating baffles shall continue to be used on equipment at the Station. All equipment and structures associated with this permit shall be painted with non- reflective paint in neutral colors to reduce glare and mitigate any visual impacts. Portable toilet facilities will be provided for employees in accordance with OSHA requirements including during construction and for operations persoru:el. All exterior lighting shall be the minimum amount necessary or required by the building code or industry standards, and shall be directed inward and downward on the site. Lighting shall be shut off during nighttime hours, except as necessary for operations, service activities or building code requirements. The Applicant shall continue weed management on the site and comply with County Weed Control Regulations and the noxious weed management plan. Weed management shall include disturbed areas ofthe site outside the security fencing. 14. The Applicant shall comply with the Dust Control Plan as represented in the Application, including mitigation for the access roadway including sections located off- site. The Applicant shall comply with all SPCC Plan provisions and shall keep the plan current and updated for any changes to the facility. Tamra Allen has indicated that we should address only the extension at that time and subject to the Board's direction put your permit sign-off on their next consent agenda. That would be March 21't. That is consistent with our typical processing. Your documentation on conditions is very complete. I have one question on the drainage improvements. One of the engineers recommendations was the replacement of an 8" culvert with a 15 " culvert. ltem #6 on the Top Gun Energy Services Task Order is "Replace Culvert at the back entrance to correct drainage issues". Please confirm that is the 15" culvert replacement reflected in the engineering recommendation. On your status letter you also indicated that you were still researching the High Mesa Discharge 8" pipeline. Since the line is less than 12" in diameter it would not trigger a pipeline development permit. I am comfortable that you have met the pipeline easement - site plan update condition of approval. The packet information for the March 14th meeting will include your extension request letter and supporting information on the conditions of approval. Input and Results The model input and results are as follows: . A composite SCS Curve Number was derived based on cover conditions within each basin (see attached model printout for specifics) . The model consists of 5 basins, 9lintr<s (ditches and culverts), and 1 storage node (sediment basin/detention pond). . The facility was analyzed using a SCS Type II 24hour storm. Total rainfall values used were: 100 year = 2.6 incll.es; 50 year :2.4inches;25 year = 2.2 inches; 10 year = 1..8 inches; 5 year = 1.6 inches; and Zyear = 1.2 inches. Rainfall values were derived from the rain{all desigrrer within Autodesk Storm and Sanitary Analysis. . Basin sizes ranged from 0.9 acres to 0.1 acres. . Model continuity for runoff (hydrology) was 0.0% and less than 0.5% for routing (hydraulic). These values are fully within the acceptable range. IV. CONCLUSIONS AND RECOMMENDATIONS The policy, design criteria, design constraints, methods of analysis, recofiunendations, and conclusions presented in this report are in conformance with standard engineering practice and Article VII Standards Section 7-207 Stormwater Runoff of Garfield County Unified Land Use Resolution of 2008, as amendedT-79. The High Mesa Compressor Station existing drainage system is capable of effectively conveying stormwater runoff from an SCS Type Il2year 24hour storm. The on-site visit that was conducted as part of this report identified the following high priority maintenance items: . Slope erosion on the north end of the internal bench. The Compressor Station is situated on pads set at different elevations. Stormwater currently flows from the upper pad to the southwest end, is concentrated and flows down the bench to the lower pad. The bench is approximately a 2H:1Y earthen slope and the stormwater flowing down this slope has eroded a channel down the bench. . Slope erosion on south end of internal bench. The erosion situation here is the same as described above, but is located on the south end of the bench. Culvert plugged with sediment. The south culvert is an B inch diameter steel pipe. Tl-ris culvert collects stormwater from the upper bench and eastern portion of the lower bencl'r. The sediment transport from the two erosion issties noted above have lead to sedirnent being deposited within the culvert to the point where it is now plugged. The stormwater now flows across the access road, which is causing additional erosion and sediment deposition. These l'righ priority items have been cliscussed with and communicated in writing to Summit Midstream Partners. The recommended solution to tl'ris issue is the installation of 8" HDPE pipe slope drains and armoring/energy dissipation within the charurel at the toe of the bench. It is recommended the B" culvert be replaced with 15" Class V RCP. This larger pipe will be much easier to clean and will increase capacity (see lolv priority recommendations below). The Summit Midstream Partners Operations Group has put tl-ris work on it's project list and will complete said work as soon as possible. Lower priority recorunendations/maintenance iten's identified are: . Lower sediment basin/detention pond cleaning. Any erosion within the site ultimately transports sediment to the lower basin. As such, this basin has received signification sediment. Removing sediment from this basin and creating a retention area of 2 or more feet below the outlet pipe would ircrease rvater quality capture volume (i.e., treatment in the form of retention for the first flush). Increasing the pond volume would also help retard released flows thus helping to reduce downstream peak flow values. o Replacement of the south 8" steel culvert with 15" Class V RCP. Upsizing this pipe would facilitate easier cleaning and increase capacity from the Zyear storm to the 100 year storm. These lower priority recommendations ancl maintenance items are not immediately needed, but if or when done will benefit and add to the longevity of the facility. This letter covers the private access roads required to reach the High Mesa Compressor Station. These private roads start at the end of County Road 304 (aka Richardson Road per Garfield County's GIS website) and go through various private parcels owned by Larry and Karen Klebold and Encana Oil & Gas (USA) Inc. The posted speed limit on the route varies between 15 and 25 mph and is strictly enforced. Those who violate traffic rules (including speed limits) can be removed from the site and banned from returning (typically resulting in employment termination). Accordingly traffic violations are rare on these roads. These access roads have existed since the 1980s. These roads are private low speed access roads that serve the Oil and Gas Industry and are not intended to be public roads or highways. Over time these private roads have been improved by Encana and others to provide better and safer service. These improvements have included widening, alignment adjustment (e.g., placement of switch backs to decrease vertical grades), and drainage improvements. These roads are located with challenging hilly terrairy accordingly switchbacks and steep grades are required on portions of the road. However these features have been implemented and constructed such that the functionality and safety of the roads are acceptable given the low speeds and vehicle types. Policy 04-01 requests a description of how said road does not meet the design standards in Table 7-107 and a map of the road. Table 7-707 of the Garfield County Land Use and Development Code provides design standards for various types of public roads (i.e., Collectors, Secondary and Rural Access, Semi Private, Primitive/Drivewa!, and Public Land Access). It is my professional opinion that the access roadways to the High Mesa Compressor Station do not "fit" irfto any of the generic road categories in Table 7-107. However, for the purpose of this exercise the column for a Garfield County "semi primitive" roadway was retained for comparison purposes. This does not imply that "serni primitive" design standards apply to this road but rather, they are included for reference purposes only as per the Policy 04-01 guidance documents. A map of the road is attached, as well as a table of cross section data. Based on historical use of these roads the horizontal and vertical elements of the road are adequate for all vehicles using the road (including large rig moving and similar sized vehicles). Observations in regards to this letter were taken along the roads on May 28,201,4. The cross sectional geometry data was collected at locations that were representative of that section of road and at critical sections/locations. The roads were driven and cross sections were taken along each section of road that was determined to vary from the typical roadway standard (i.e., different width, different grade, etc.). The collection of cross section data consisted of measuring total width (edge of gravel to edge of gravel), determining cross slopes using a hand level, and longitudinal slope using an inclinometer. The road corridor in general was observed during the collection of this data. No obvious safety issues or signs of strucfural failure were observed on any portion of road. Encana has various contractors it uses to maintain and improve these private roads. Regular maintenance operations include, but are not limited to: . Grading: this removes washboard, re-establishes crown & cross slopes, maintains ditches, and removes any potholes or low spots than collect water. o Watering: this helps with dust control and helps keep the road material compacted to an optimal density. . Magnesium Chloride Treatment this helps bond the road material and creates a much more desirable surface. This treatment helps with dust control, reduces sediment transport from the road surface, and reduces the need for other maintenance activities such as grading. Traffic counts on these roads vary significantly depending on the exploration activities taking place within the area. The estimated current traffic count is approximately 100 vehicles per day. Approximately 75 of the 100 are large trucks (mostly water trucks) and the remaining25 per day are pickup sized vehicles. Larger vehicles such as rig moving trucks will use the road when moving onto/off of pads in the area. Typically these large vehicles have escort vehicles to ensure safe passage. In summary: . The horizontal and vertical geometry of these private roads is adequate for the purpose of servicing the High Mesa Compressor Station. . No obvious structural or safety issues were observed during the field visit on }l{.ay 28th,2014. Section 4-203.E of the Description of Submittal Requirements of the Land Use and Development Code (LUDC) requires Grading and Drainage Plans as part of the matedals required for all land use change permits. A waiver request shall be considered based on the following criteria: 1. The Applicant shows good cause for the requested waiver; Response: Good cause for the waiver request is demonstrated via previous details provided in the LIR application and the information that follows. The HMCS is a previously constructed compressor facility with eight existing compression units. This includes seven skid mounted compressor units and one compressor located inside a building. GRG acquired significant midstream assets in the Piceance Basin in 201 1. Some of the associated facilities in Garfield County did not have a Land Use Change Permit (LUCP). ln a good faith effort GRG has been obtaining LUCPs for their facilities such as HMCS. However no new land disturbance is planned or anticipated. The site was constructed before the current code requirements for a LUCP for these types of facilities. Additionally, the site was constructed according to the typical Colorado Oil and Gas Conservation Commission (COGCC) natural gas development criteria which emphasize retention of stormwater. Consequently the site plan details did not include calculations to accommodate the Garfield LUDC requirement for comprehensive stormwater detention. A grading permit was issued by Garfield County in 2011 for the addition of the latest compression unit that is located inside the boundary of the site plan submitted with the application. At that time a Final Drainage Report was developed by River City Consultants. This report examined the site and a drainage system of earthen ditches, culverts, a sediment basin, and other stormwater BMPs including revegetation, check dams in the ditches, rip-rap and vegetative buffer zones was designed. ln addition, no issues related to ;;;;*sed men ;-;;;''"."::: ::::'l#k, Grand River Gathering High Mesa Compressor Station 2. GRG acquired the facility shortly after the addition of this final compressor unit. Since the acquisition of the facility by GRG it has incorporated this facility into their SWMP and CDHPE permit. A Spill Prevention Control and Countermeasure Plan (SPCC) was developed for the site. The project area is stabilized and stormwater inspections are regularly performed. The stormwater inspections are intended to assure repairs to the BMPs are implemented to control erosion as needed. Requiring a comprehensive stormwater detention plan for an existing facility will require modification and disturbance of a stabilized site and is an overly burdensome requirement that does not provide value to the public. The project size, complexity, anticipated impacts, or other factors support a waiver; Response: The project area contains an existing compressor facility. No new land disturbance is planned or anticipated. No change in the volume or quality of water leaving the site is anticipated. The request does not create any additional impacts on the adjacent properties or areas downstream of the facility. The waiver does not compromise a proper and complete review; and Response: This waiver does not compromise a proper and complete review. GRG has provided the 2011 grading permit and associated Final Drainage Report prepared by River City Consultants, an assessment of that report prepared by a professional engineer, the SWMP, CDPHE permit, and SPCC for the facility. The information is not material to describing the proposal or demonstrating compliance with approval criteria. Response: Compliance with the intent of the Land Use and Development Code drainage criteria is demonstrated by the grading permit obtained during the latest compressor installation, the Final Drainage Report associated with this grading permit, the incorporation of the site into GRG's SWMP, adherence to the CDPHE stormwater permit, and the SPCC developed for the facility. Downstream properties are thus protected from any erosion or sediment impacts associated with this facility. nrrf'ilf 4. Pursuant to Section 4-118 of the Garfield County Land Use and Development Code, GRG requests a waiver for the following standards for Drainage and Erosion for the HMCS. Given the Average Daily Traffic of 101-200 vehicles per day, this road would be equivalent to a Rural Access Road as described in Table 7-107 of the Land Use and Development Code. The Rural Access Road standard requires a chip-seal or gravel surface, crowned surface with a 2-percent cross slope, 3-percent sloped shoulder, ditches on both sides of the roads, and no more than a 12 percent grade. The impact this project would have on public roads and adjacent properties is minimal at most and likely non-existent. The project or roadway is not part of a subdivision process, does not result in a significant change in population density of the county, and does not does create any significant impact on the surrounding area or community. The project is in support of a mineral extraction operation and is located on an approved well location. 3. The waiver does not compromise a proper and complete review; and Response: The review of the compression facility application is not compromised by not providing the information requested in Policy 04-01. Other information provided by GRG, including this waiver request, demonstrates compliance with the intent of the code. 4. The information is not material to describing the proposal or demonstrating compliance with approval criteria. Response. The intent of the criteria found in Table 7-107 is to provide for safe and adequate access to a property. The design standards found in this section are obviously intended for roads providing access to residential and non-residential uses open to the public. The project area is located on a relatively remote parcel that can be only accessed via this private road. Use of this road by the public is prohibited. Pursuant to Section 4-118 of the Garfield County Land Use and Development Code, GRG requests a waiver for the following standards for Access and Roadways for the HMCS. Section 7-107 Access and Roadways A waiver of standards request shall be considered based on the following criteria: 1. Achieves the intent of the subject standard to the same and better degree than the subject standard: Response: The intent of the roadway standard is to provide safe and adequate access to a development. The HMCS Facility will be accessed from CR304 and then the private road. This road was designed and built by an oil and gas producer to provide exclusive access to the natural gas operations in the area and it is not designed for or open to public use. Given the average daily traffic (ADT) that this road services, it should most closely correspond to the Rural Access road standard of Table 7-107 of the Land Use and Development Code. This standard would require this road to have a slope no greater than 12-percent, ditches located on both sides of the road and a chip seal or gravel surface. Waiver Requests- Addendum Page 3 Grand River Gathering High Mesa Compressor Station This private roadway has sections that may exceed a 12-percent grade and much of the surface is made from native materials. Road base has been applied to some sections to improve the surface. ln some locations in lieu of a roadside ditch, a compacted berm has been placed on the downslope side of the roadway to control stormwater, limit erosion and provide a barrier for greater safety. This road receives daily attention and is inspected on a regular schedule for safety related issues. This road is also inspected regularly and after major precipitation events for erosion issues. Erosion control BMPs are maintained on a daily basis. A maintainerlroad grader is used as needed to maintain the roadway. A20 mph speed limit is enforced. The roadway is treated with a dust palliative, either water or magnesium chloride, as needed. Signs are posted near the CR304 entrance/egress to restrict unauthorized persons from traveling on the road. This roadway provides a safe access to the site for the GRG and other authorized personnel. lmposes no greater impacts on adjacent properties than would occur through compliance with the specific requirements of this Code. Response: This private road system does not provide access to residential uses nor is it used by the general public.
