I. BACKGROUND
1 -year extension to file a Final Plat
Application for the Mahan Subdivision

As you will recall, on Tuesday, September 5, 2006, the Board of County
Commissioners (the Board) approved the Preliminary Plan Application for the
Mahan Subdivision which entailed subdividing the 20 -acre property in the lower
Four Mile drainage into 2 residential lots with conditions. This approval provided
the Applicant, Mahan Properties, 1 year to file a final plat application to Garfield
County which will expire on September 5, 2007.
II. REQUEST
The property owner requests the Board grant a 1 -year extension to file the Final
Plat which would expire on September 5, 2007. (See the letter attached to this
memo from the Applicant's representative.)
III. AUTHORITY
Section 4:34 of the Subdivision Regulations of 1984, as amended provides the
Board the authority to grant such extensions for no more than 1 -year so long as
the request for the extension is requested prior to the initial 1 -year deadline
expires.
IV. STAFF RECOMMENDATION
As the Board is aware, there are no specific standards or criteria to judge this
request with the exception of the code language listed above and that this
decision is solely at the discretion of the Board. Staff recommends since the
request wasro d well before the initial 1 -year deadline expired, the Board
ran wear extenia to the pro rty owner to file the Final Plat prior to
ptember 5, 2008.

Dear Fred:
The purpose of this correspondence is to request the extension of the Preliminary Plan
approval of the Mahan Subdivision for one year, as described in Section 4:34 of the
Subdivision Regulations.
The date of expiration was to be September 5, 2007. This request would change that date to
September 5, 2008. Thanks in advance.

comments.
