Dear Ms. Evans;
This letter is being provided to you as the authorized representative for Ursa
Operating Company LLC and Thomas Tompkins in regard to the General
Administrative Review Application for a Small lnjection Well, known as the
Tompkins lnjection Well. The proposed use is located 0269 CR 309 and the
proposed propefiy also known by Assessor's Parcel No. 2407-054-00-085.
The Director's Decision on the Application is based on the following findings and
subject to the Applicant's representations and conditions of approval.
1. That all representations made by the Applicant in the application shall be
conditions of approval unless specifically altered by the conditions of approval
of the Board.
2. That the Tompkins lnjection Well shall be operated in accordance with all
applicable Federal, State and local regulations governing the operation of this
type of facility.
3. The Applicant shall maintain all required CDPHE permits for the facility
including any applicable air quality APEN permits including as may be
required for the storage tank batteries.
4. The facility shall maintain compliance with CDPHE Storm Water Management
Permits, Drainage and Grading Plans, and Reclamation and Erosion Control
Plans for the site.

The Applicant shall remain in compliance with the Watershed Permit issued
by the Town of Parachute.
The Applicant shall maintain all required COGCC permits and forms for the
facility and shall comply with all conditions or requirements of said permits
and forms. Copies of COGCC permits and forms shall be provided to the
County once issued.
The facility shall maintain compliance with COGCC Noise
Standards/Regulations and the facility shall be required to utilize an electric
pump as represented. lf future compliance issues are identified, the Applicant
shall provide noise mitigation in order to achieve compliance along with a
technical evaluation by a qualified professional to confirm compliance.
Should transfer pumps for distribution of water between well pads be
constructed on the site as part of the injection well operation, said pump shall
be tested for noise compliance with noise mitigation installed if necessary to
include the potential for housing in a sound mitigation structure.
8. The facility shall have only termporary lighting for unscheduled night time
maintenance. All lighting shall comply with Section 7-304, Lighting
Standards, with all lighting to be directed inward and doward toward the
interior of the site. Facilities and storage tanks shall be painted a non-glare
neutral color to lessen any visual impacts.
9. The Applicant shall comply with the Battlement Mesa Wildlife Mitigation Plan -
Agreements between Ursa Operating Company and CPW which includes
limitations on trucking to between the hours of 10 a.m. and 3 p.m., when and
where possible, compliance with noise regulations and use of bear proof trash
containers for all food related trash.
10.The Applicant shall comply with the recommendations of Geologic and Soils
Hazards Report related to the Potts-lldefonso Soils present on the site.
These recommendations include the use of coated steel or appropriate
cathodic protection, as well as the use of corrosion resistant concrete.
11.The Applicant shall comply with the access representations and Traffic Report
including use of designated haul routes and maximum estimated traffic
generation. The daily trucking estimates may be applied based on a weekly
average to account for minor operational variations. Trucking of water to the
site shall utilize watertight tanks and shall comply with all COGCC or CDOT
requirements for hauling of production water. The Applicant shall provide the
County with updates on the progress toward implementing pipelines for

transportation of water to the injection well. Said updates shall be provided
on an annual basis and include assessment of and mitigation for any
unanticipated traff ic impacts.
This Director's Decision will be fonryarded to the Board of County Commissioners
for a period of 10 days so that they may determine whether or not to call up the
application for further review. Once this time period has passed with no request
for review or public hearing, and provided all relevant conditions of approval have
been resolved the Land Use Change Permit will be issued.

The proposed facility is known as the Tompkins lnjection Well and will be utilized for disposal of water
classified as exploration and production (E&P) waste from Ursa Operating Company gas production
facilities in the vicinity of the site. Equipment associated with the facility will include:
o One injection well;
o One Battery of Storage Tanks with an approximate total volume between 1,800 and 3,000 barrels
to be dedicated to storage of water to be disposed via injection;
o One Combuster;
o A Valve SeU
o Electric pump with an associated pump house of approximately L,000 square feet;
o Associated piping and equipment for offloading water at the site;
o Overall site will is proposed to have a minimum 2' high containment berm.
Produced water from local Ursa facilities will be transported to the site by truck and by pipeline. Traffic
generation projections and a Traffic Analysis have been provided which include the proposed haul routes.
A dust mitigation plan will be implemented for the site and Colorado Department of Publlc Health and
Environment (CDPHE) Air Quality permits will be obtalned if required (may be required for the storage
tanks). A Storm Water Management Plan has been prepared with storm water management
improvements and Best Management Practices already implemented and/or planned for the site. The
Application also includes a Spill Prevention Control and Countermeasures Plan (SPCC), Grading and
Drainage Plans, Noxious Weed Management Plan, and Reclamation Plans.
The site is subject to a Town of Parachute Watershed Permit conditionally issued by the Town. The
Applicant has stated that they will maintain water quality in the watershed protection area.
Monitoring, alarm, and remote shut down controls are planned for the facility and include the following:
o Bradenhead Pressure Alarms
o WirelessCasing Pressure Monitor/Transmitter
o WirelessTubing Pressure Monitor/Transmitter
o Remote Shutdown Controls
o Programmable Logic Controls on Pumps that monitor pump package and pressures.
. Low Oil Level alarms on pumps.
o High and low tank alarms.
o Flow rate monitors for maximum daily pressure/volume.
The injection water storage and the overall tank storage on the site is less than the maximum 5,000 barrels
for a small injection well site. A Geologic and Natural Hazards Report was included in the Application.
The Report was expanded to include a section specifically on Seismic Hazards and lnjection Wells including
I njection control activity.
The site is covered by the COGCC with a bond for reclamation.

The proposed 2.95-acre site is located
within a 35-acre parcel and is currently a
developed COGCC well pad. The site is
surrounded on three sides by the
Battlement Mesa PUD and is zoned Rural.
Land uses within 1,500 ft. include
agricultural uses, residential and ranching
uses, natural gas extraction and pipelines,
and developed areas within the
Battlement Mesa PUD.
Native vegetation near the pad is

communities and pinyon-juniper

Public Notice was provided for the Director's Decision in accordance with the Garfield County Land Use
and Development Code as amended. Notice included mailing notice to all property owners within 200 ft.
andanymineralrightsownersontheproperty. TheApplicanthasprovidedevidenceofcompliancewith
the notice requirements. Comments from referral agencies are summarized below and attached as
Exhibits.
1. Mountain Cross Engineering, Exhibit H: Chris Hale questioned the noise study, particularly other
noises from the well pad that are not related to the injection well.
2. Grand Valley Fire Protection District, Exhibit G: Rob Ferguson had no objections to the plan.
3. CDPHE, Environmental Protection Specialist, Exhibit F: Kent Kuster had no comments other than a
requirement that the Applicant comply with all state and federals rules and regulations.
4. Garfield County Vegetation Management, Exhibit l: Steve Anthony commented that the Noxious
Weed lnventory and Management plan was acceptable.
5. Garfield County Oil and Gas Liaison, Exhibit J: Kirby Wynn responded that based upon similar projects
the noise generated should be within acceptable limits. Mr. Wynn also stated that piping and injection
can serve to reduce long-term traffic impacts.
6. Colorado Parks and Wildlife, Exhibit K: Scott Hoyer commented that the site is subject to an agreement
between Ursa Operating Company (formerly Antero Resources) and Colorado Parks and Wildlife, an
agreement that was intended to provide guidance in the development of natural resources in the
Battlement Mesa area. Mr. Hoyer listed those areas of the agreement that were to be applied to this
site.

ln accordance with the Land Use and Development Code, the Applicant has provided detailed responses
to the Submittal Requirements and applicable sections of Article 7, Divisions 1.,2, and 3, including Section
7-!00L lndustrial Use Standards. The application materials include an lmpact Analysis and related
consultant reports, technical studies, and plans.
The following standards apply to all proposed Land Use Changes, including divisions of land, unless
elsewhere in this Code a use is explicitly exempt from one or more standards.

7.1CI1. ZONE DISTRICT USE REGULATIONS.
The Land Use Change is permitted by Administrative Review in the Rural zone district and it appe;lrs that
the site is otherwise compliant with the zoning regulations.
7-102. COMPREHENSIVE PLAN AND INTERGOVERNMENTAL AGREEMENTS.
The site is designated on the Future Land Use Map as Residential Medium High. The Comprehensive Plan,
appears to meet the goals and policies with regard to natural resource extraction. These include Chapter
3 - Plan Elements, specifically Section 9 on Mineral Extraction which discusses encouraging extraction
with mitigation of negative impacts on air quality, water quality, wildlife habitat and visual resources. lt
appears that the proposed injection well is in general conformance with the Garfield County
Comprehensive Plan.
7.103. COMPATIBILITY.
The nature, scale, and intensityof the proposed use are compatible with adjacent land uses.
7.104. SOURCE OF WATER.
Due to the nature of the activity there is no provision of potable water for the site. Employees will not be
stationed at the site and any employees utilized in the monitoring of the site will carry their own water
supplies. Operation of the facility does not require the use of water.
The produced water to be injected into the well originates in the Williams Fork Formation which is
classified as a non-tributary formation
7.105. CENTHAL WATER DISTRIBUTION AND WASTEWATER SYSTEMS.
The water to be injected into the well will be delivered via truck as well as pipeline, the Tompkins Pipeline,
from the originating wells. The site will not be subject to provision of potable water due to the lack of
permanent on-site employees.
Wastewater for the site will be provided via porta-johns through Redi Services or Western Colorado
Waste.
7.106. PUBLIC UTILITIES.
Holy Cross Energy provides electricity to site, therefore it appears that required utilities are available to
serve the site.
7.107. ACCESS AND ROADWAYS.
The site has access directly onto CR 309. Road & Bridge did not respond to the request for referral, but it
appears that the site has an existing drlveway sufficient to serve the needs of the injection well.
The application states, page one of the Project Description that "Fluids will be delivered to the facility via
the Tompkins Pipeline which was approved by GarCo November 1,6, 2015." However the traffic
application, page 3 of the Project Description states that "Trucks may be use to haul water to the injection
well for no longer than three months, if the pipeline is not completed prior to the injection well coming
online." The application then states that if here is insufficient water volume for piping of the fluids then
the water would be trucked to the injection well. The traffic study provided includes the traffic that would
result in the circumstances which include:

1,. Prior to completion of the Tompkins Pipeline; and
2. When insufficient volume of water needs do not permit use of the pipeline.
The county road system, both within and outside of Battlement Mesa, will be utilized to deliver produced
water to the site in the above circumstances, as shown on the map below. The red circle appears to
indicate the originating source of the water therefore it appears that county roads 300N and 300 S, CR
3Ol-, CR 303, CR 307, and CR 308 will be utilized internal to the operation. The upper and lower haul
routes appear to be the route the empty truck would take to the site to pickup water, then the referenced
county roads utilized to deliver the water to the injection well, and then the upper and lower haul routes
utilized by the empty truck to exit the project area.
No referral comments were received that indicated any concerns regarding use of these roadways.

7.108. USE OF LAND SUBJECT TO NATURAL HAZARDS.
A Geologic Hazards Report was prepared by Olsson Associates and no hazards were found to exist, with
the exception of slope hazards. These hazards were mitigated during the construction of the original
wellpad.
7.109. FIRE PHOTECTION.
The site is located within the Grand Valley Fire Protection District who responded that they had no
objections to the land use permit for the injection well.
The following resource protection standards apply to all proposed Land Use Changes, including
divisions of land unless elsewhere in this Code a use is explicitly exempt from 1 or more
standards.
7-201. AGHICULTURAL LANDS.
Nodomesticanimalsarepermittedwithintheareaofthelandusepermit. Fenceswillbeerectedallwell
including eh injection well to discourage livestock and wildlife from entering the area. The application
does not indicate whether any irrigation ditches exist on the subject site, however the application states
that the grading and drainage plan, as well as the Stormwater Management Plan, will assure that any
ditches will not be impacted by the facility.
7.202. WILDLIFE HABITAT AREAS.
Westwater Engineering prepared a Wildlife and Vegetation Report for the site. They cite lndirect
Construction Effects as additional human presence and activity related to construction, operation and
maintenance of the injection well. The injection well is an addition to an existing wellpad it was stated
that additional disturbance from the injection well would be low.
Colorado Parks and Wildlife (CPW) responded to the request for referral, Exhibit K that the site lies within
area mapped as severe winter range for both mule deer and elk, and within a%mile from the Colorado
River which is an area of critical habitat for four federally listed fish species. CPW indicates that the site
is within the Battlement Mesa Wildlife Mitigation Plan which provides guidance in development of natural
gas resources in the Battlement Mesa area and recommends that this plan be utilized in the project.
Concerns include increase in disturbance to wildlife, particularly during the winter and adhere to the
above-mentioned agreement of limiting truck traffic to the hours of 10 a.m. to 3 p.m. Also recomnrended
are the use of bear-proof dumpsters and trash receptacles for the site.
CPW requests that the County apply COGCC Rule Series 802 standards regarding noise to mitigate impacts
to wildlife.
7.203. PROTECTION OF WATERBODIES.
The site is subject to a Stormwater Management Plan and is not located proximate to any waterbodies.
7.204 DRAINAGE AND EROSION.
A Grading and Drainage Plan (including Stormwater Management Plan), prepared by Westar Engineers,
has been submitted. Westar discusses the grading and drainage of the existing wellpad, including runoff

and detention volumes and capacity. Mountain Cross Engineering, reviewing the application on behalf of
Garfield County, had no comments on this aspect of the application.
7.205. ENVIRONMENTAL QUALITY.
A. Air Quality.
The injection well itself does not require air permits and the electric pump is exempt from these permits.
The condensate tank battery will require an Air Pollution Emission Notice (APEN). Ursa has 30 days in
which to evaluate the potential to emit quantities prior to submitting the application. The application was
referred to the Colorado Department of Public Health and Environment (CDPHE), Air Quality Division, and
no response was received.
B. Water Quality.
A Spill Prevention and Countermeasures Plan (SPCC) will be in effect for the tank batteries associated with
the injection well.
The City of Parachute has issued a Watershed Permit with conditions of approval in order to protect the
Town's water supply. A condition of compliance with the condition of this permit has been added to the
land use permit.
Ken Kuster from the Colorado Department of Public Health and Environment (CDPHE) Water Quality
Control Division responded to the referral request, Exhibit F, and recommends that the Applicant obtain
permits for regulated activities prior to emitting or discharging a pollutant into the air or water.
7.206. WILDFIRE HAZARDS.
Non-combustible materials will be utilized in the construction of the pump house and the site is not
located in a high wildfire hazard area.
7.207. NATURAL AND GEOLOGIC HMARDS.
A Natural and Geologic Hazards Assessment Report was completed by Olsson Associates for this site. This
report makes recommendations with regard to Potts-lldefonso complex soils which are listed as highly
corrosive to steel, but the potential of corrosion in concrete is low.
The report does not indicate under what circumstances coating of steel or use of cathodic protection or
corrosion resistant concrete may be necessary therefore a condition of approval is recommended
regarding compliance with the corrosive soils recommendation.
7-208. RECLAMATION.
The site is subject to a COGCC reclamation bond. A revegetation bound is not necessary for this project.
Vegetation Man
Unless a use is explicitly identified elsewhere in this Code as being exempt from 1 or more standards, the
following standards shall apply to all uses, divisions of land and PUDs. Single-family dwelling units, are
specifically exempt from these Division 3 standards.

7.301. COMPATIBLE DESIGN.
Operation of the proposed facility is consistent with nearby uses including other oil and gas development
in the area.
7.302. OFF-STREET PARKING AND LOADING STANDARDS.
Operation, inspection and maintenance of the facility will result in personnel at the site. Adequate parking
will be made available.
Off-loading of the produced water for injection require adequate traffic circulation patterns on the well
pad, which have been provided. The unloading of the produced water is not anticipated to impact CR
309.
7.303. LANDSCAPING STANDARDS.
This use is exempt from the landscaping standards.
7-304. LIGHTING STANDARDS.
The application states that the facility will comply with this standard and a condition of approval is
recommended.
7.305. SNOW STORAGE STANDARDS.
The snow storage area indicated on the site is within a vacant section of the wellpad.
7,306. TRAIL AND WALKWAY STANDARDS.
Not applicable.
7.1001. INDUSTRIAL USE.
These standards shall apply to all industrial uses:
A. Residential Subdivisions.
The site is not located within a residentialsubdivision.
B. Setbacks.
The site is located at least 100 feet from any adjacent residences.
C. Concealing and Screening.
A pump house will conceal much of the equipment associated with the injection well and will
minimize potential visual impacts.
D. Storing.
Storage of all products and chemicals will be in compliance with allfederal, state and localcodes
and will be more than 100 feet from the adjacent property lines.
E. lndustrialWastes.
Ursa has a Waste Management Plan and all industrial wastes will be disposed of in a manner
consistent with federal, state and local regulations.

F. Noise.
The application includes a Sound Study conducted by Olsson Associates. This study includes
review of data collected at a similar facility during operation of the injection well. Noise
generating equipment will be located inside of a fabricated metal building. Utilizing COGCC Rule
802, which allows for residential noise standards to 50 dB(A), the study concludes that the 44
dB(A) would allow the site to operate in compliance with COGCC noise standards.
G. Ground Vibration.
No ground vibration is anticipated from the proposed use.
H. Hours of Operation.
The site will operate 24 hours a day, seven days a week and most activities will occur during
daylight hours
l. lnterference, Nuisance, or Hazard.
The application states that the injection well activity will not impact adjacent lands. BMP's and
mitigation will be used to accommodate potential impacts.
1. That proper public notice was provided as required for the hearing before the Board.
2. The hearing before the Board was extensive and complete, that all pertinent facts, matters and
issues were submitted and that all interested parties were heard at a the meeting.
3. For the above stated and other reasons, the proposed Land Use Change Permit for the Ursa
Watson Ranch B lnjection Well is in the best interest of the health, safety, convenience, order, prosperity
and welfare of the citizens of Garfield County.
4. That, upon compliance with conditions of approval, the application is in general conformance with
the 2030 Comprehensive Plan, as amended.
5. That, upon compliance with conditions of approval, the application has adequately met the
requirements of the Code.
The following recommended conditions of approval are provided for consideration by the Director of
Community Development regarding approval of the Land Use Change Permit request for the Tompkins
lnjection Well.
That all representations made by the Applicant in the application shall be conditions of approval

That the Tompkins lnjection Well shall be operated in accordance with all applicable Federal, State

9. The Applicant shall comply with the Battlement Mesa Wildlife Mitigation Plan - Agreements between
Ursa Operating Company and CPW which includes limitations on trucking to between the hours of L0
a.m. and 3 p.m., when and where possible, compliance with noise regulations and use of bear proof
trash containers for all food related trash.
10. The Applicant shall comply with the recommendations of Geologic and Soils Hazards Report related
to the Potts-lldefonso Soils present on the site. These recommendations include the use of coated
steel or appropriate cathodic protection, as well as the use of corrosion resistant concrete.
11,. The Applicant shall comply with the access representations and Traffic Report including use of
designated haul routes and maximum estimated traffic generation. The daily trucking estimates may
be applied based on a weekly average to account for minor operational variations. Trucking of water
to the site shall utilize watertight tanks and shall comply with all COGCC or CDOT requirements for
hauling of production water. The Applicant shall provide the County with updates on the progress
toward implementing pipelines for transportation of water to the injection well. Said updates shall

Quite late but I have no specific issues or recommendations for the Tompkins Pad lJ Well application. According to the
sound study and observations of similar electric pump equipment used on other lJ facilities by Ursa, the noise generated
should be within acceptable limits. Piping and injection of waste fluids can serve to reduce long-term traffic impacts.
Potential induced seismicity is a topic that comes up for injections wells. A few notes on that topic are below:
Current seismic monitoring and observed seismic activity in western Colorado
Western Garfield County is not prone to seismic activity based on discussions with and data provided in 2014 by Anne
Sheehan, Professor of Geophysics at CU Boulder. Dr. Sheehan is the lead researcher conducting investigation of the 2014
seismic events near Greeley Colorado. Received similar information from COGCC and Paul Earle, Geologic Hazards Team
at the USGS National Earthquake lnformation Center.
Drs. Sheehan and Earle indicate our area is currently monitored for earthquake activity at a resolution to note
earthquakes of minimum 2.5 magnitude event with a location determination of +/- 6 miles.

Thank you for the opportunity to comment on the proposed Tompkins injection well
facility to be located 0.50 miles east of the Battlement Mesa Community off of Garfield
CR 309. Colorado Parks and Wildlife (CPW) has a statutory responsibility to manage all
wildlife species in Colorado; this responsibility is embraced and fulfilled through the
CPW's mission to protect, preserve, enhance, and manage the wildlife of Colorado for
the use, benefit, and enjoyment of the people of Colorado and its visitors. We encourage
Garfield County to afford the highest protection for Colorado's wildlife species and
habitats through the development and implementation of management actions combined
with the use of best management practices (BMPs) to protect wildlife and their habitats.
The project location is utilized year-round by many species of game and non-game
wildlife. The site lies within an area mapped by the CPW as severe winter range for both
mule deer and elk. Additionally, the proposed site lies less than a l/2 mlle from the
Colorado River in an area of critical habitat for four federally listed fish species.
In June 2011, Ursa Operating Company (formerly Antero Resources) entered into an
agreement with the Colorado Parks and Wildlife (CPW) known as the Battlement Mesa
Wildlife Mitigation Plan (BMWMP). This document was intended to provide guidance
in the development of the Antero's natural gas resources in the Battlement Mesa area so
that impacts to local wildlife would be minimized or mitigated.
Since the proposed site is within the boundaries of the established BMWMP, the CPW
recommends that the 2011 WMP is utilized during the planning and development of this
project. The CPW's chief wildlife concern is the increase in disturbance to wildlife
(particularly during the winter months) caused by water trucks visiting the facility. By
adhering to the agreed upon Best Management Practice (BMP) of limiting truck traffic to
the hours of 10 am - 3 pm, negative impacts to big-game can be greatly reduced. Also,
by following the recommended BMP of utilizing buried waterlines to transport fluids to
the facility, traffic disturbance concerns can be virtually eliminated. Also, in accordance
with COGCC Rule l2O4 a-1, the CPW recommends that bear-proof dumpsters and trash
receptacles be utilized for all food-related trash on location to minimize nuisance bear
issues in the area.

Lastly, while COGCC does not have noise regulations specifically related to impacts to
wildlife, CPW recommends that Garfield County apply COGCC Rule Series 802
standards that are applicable to the situation. CPW recognizes that the standards are
designed to protect human health, safety and welfare and we believe that the protection
standard will also aid, to some degree, in the reduction of noise impacts to wildlife as
well. Because of the operational nature of an injection well CPW encourages Garfield
County and Ursa to apply noise mitigation to this permit.
