It has been brought to the homeowner’s at- tention that the existing roadway may cross a small strip of BLM land before connecting to the county road but it is unclear on the current survey. If the fi ndings that the existing roadway cross BLM land hold true, no easement to the best of homeowner’s knowledge currently exist, but the access road has been in this location for over 50yrs (see pics above) as one of three original homesteads in the Main Elk Creek valley, and therefore, this would be considered a prescriptive easement (if and only if the presumption that the existing road crosses BLM land holds true) The surveyor’s, Bookcliff surveyor’s, are currently double checking their survey points to confi rm where exactly the country road starts and stops and where if any, the BLM land sits, as it relates to the existing driveway in place.
