I. GENERAL PROJECT DESCRIPTION The Applicant is proposing a new onsite waste water treatment system (OWTS) on Lot A of the Amended Snobble Subdivision Exemption Plat. The proposed location is within the mapped 100 year flood plain for the adjacent Crystal River. The Applicant anticipates use of an engineered system with the elevation of the infiltrative area of the mound system. Elevation is planned to keep the system above the 100 year flood elevation. Protection of the mound system from erosion by flood waters is also proposed. A flood plain development permit is required for the system based on the location within the flood plain and the placement of material -fill necessary for the system. II. REGULATORY PROVISIONS APPLICANT IS REQUIRED TO ADDRESS Garfield County Land Use and Development Code, as amended (LUDC) including the following Sections: • Section 3-301 -Floodplain Overlay Regulations • Section 4-109 -Development in the 100 Year Floodplain • Table 4-102-Common Review Procedures and Required Notice • Table 4-201 -Submittal Requirements • Section 4-203 -Submittal Requirements as appropriate • Section 4-203 (0) -Flood Plain Analysis Ill. REVIEW PROCESS The Floodplain Development permit will be processed pursuant to Section 4-103, Administrative Review Process and consistent with Table 4-102 Common Review procedures for Floodplain Development, summarized as follows: A. The Flood Plain Analysis needs to be completed by a qualified licensed professional engineer and needs to include the engineer's stamp. E. The Flood Plain Analysis will need to specifically address standards for placement of fill within the floodplain including any analyses needed to demonstrate code compliance. F. Information needs to be provided on the OWTS design to ensure that the system is protected from flood waters. Issues including high ground water, waterproof utility facilities, and protection from any infiltration and/or contamination during flooding events should be addressed. G. The submittals need to address compliance with the Review Criteria contained in Section 4-109 as applicable. An additional pre-application meeting with staff is an available option to address submittal requirements and preview how key topics are addressed. The Application submittal needs to include 3 hard copies of the entire Application and 1 Digital PDF Copy of the entire Application (on a CD or USB Stick). The Kistlers’ did assign rights on their death to Marjorie Dunn. Greg Forbes obtained these rights in a Treasurer’s Deed in 2006. As you may remember, I did speak to Mr. Forbes about the situation and he was not sure where any of this property was located, just that some of it was in Satank and that is where he lived at the time. He was informed of the matter. In addition, my research included meetings with surveyors to try to determine the specific location of these properties. The conclusion was that the properties lay north and east of the Crystal River – the Snobble property is west of the Crystal River, and thus was not an issue. In more closely examining the current title commitments for the properties (issued May 2014) and the Clerk & Recorder’s records, I have found the following: • Deed from Frank & Leanna Kistler to Harold (Harald) Pabst excepting and reserving to sellers an undivided ½ interest in oil gas and other minerals (Rec 163910 on 2-28-1948) • Oil and Gas lease Frank & Leanna Kistler, Pabst and Dodge Drilling & Development for the property – Rec 175039 on 2/8/1951) • Assignment of lease from Pabst and Kistler to Mt. Sopris Petroleum Co., Rec 175098 on 2/13/1951) • After that date, Mt. Sopris Petroleum only assigned one lease – and that was to John Mulford (Rec 189046 on 3/28/1955). That assignment did not include the subject property. No other assignments or deeds were tendered by Mt. Sopris Petroleum according to County Records. • Then, further review showed that Mt. Sopris Petroleum was no longer a functioning entity (1964) • The estate of Kistler did grant all rights of oil, gas and other minerals at time of death to Marjorie Dunn. This parcel is located within FEMA panel 0845C1611E dated Oct 26, 2011, and FEMA panel 080205 1856 B dated January 3, 1986. This area is a part of a delineated floodplain area and requires a Special Use Permit in accordance with Section 6 of Garfield County Zoning Resolution. The purpose of county floodplain regulations is to permit only such uses that will not endanger life, health, public and private properties due to flood conditions. HCE has utilized the most recent preliminary study dated 2011 that is currently in review. This study appears to have more detail within this area and has a cross section just upstream of this property. HCE compared the floodplain elevations with the study that is currently in effect from 1986 and appears to be similar 100 year flood elevations when the Datum is converted to the NAD 1929 datum that is referenced on the 1986 mapping. There also appears to be greater detail identifying the floodway from the floodplain. It is clear from the 2011 document that the proposed OWTS area is significantly out of the floodway. The property was shown on FEMA panel 0845C1611E dated Oct 26, 2011 Flood Insurance Study of Unincorporated Garfield County produced by the Federal Emergency Management Agency (FEMA) is determined to be located in Zone AE of the floodplain. The area is classified as Base Flood Elevation Determined. There is a pond located just upstream of the OWTS which is believed to create the “hook” in the floodplain. This feature will help slow the velocities in the proposed area of the OWTS, however HCE utilized data from the upstream cross-section to determine velocities to establish appropriate protection to the OWTS. The mean velocity reported for Section D was 8.3 feet/second. The proposed erosion protection North American Green Vmax SC250 is rated up to 15 feet per second with vegetation or 9.5 feet per second without vegetation. Erosion blanket coverage is conservatively placed to cover all disturbed areas below the 100 year floodplain elevation plus 1’. Review of the site and available floodplain information has indicated that the impact of a small OWTS at this location would be negligible and can be protected from flooding, if inundated. Development in the floodplain per definition of the floodplain and floodway is anticipated and elevations of the floodplain are anticipated based on development occurring. The 2.438-acre property is located outside of Carbondale, in an area where OW TSs are and wells necessary. High Country Engineering has completed a report dated February 19, 2016, Grading and Erosion Control for Floodplain Development, Project Number 2161012.00. Any previous ALL SERVICE septic design should be discarded and replaced with ALL SERVICE septic design documents dated March 18, 2016. Legal Description: Section: 28 Township: 7 Range: 88 Subdivision: SNOBBLE EXEMPTION Lot: A AMENDED Parcel ID 2939-283-18-001 SITE CONDITIONS A 5-bedroom, single-family residence currently exists on the property and is served by an existing OWTS. There is a desire to remodel the residence, and to upgrade the existing OWTS. A private well exists on the property. The well is located a minimum of 50-feet from the proposed septic tank and a minimum of 100-feet from the proposed soil treatment area (STA). An unlined pond exists to the east of the proposed STA. The pond is located a minimum of 50-feet from the infiltrative area of the proposed STA. A portion of the STA will be located in the flood plain. The infiltrative area will be mounded. Please refer to High Country Engineering report dated February 19, 2016, Grading and Erosion Control for Floodplain Development, Project Number 2161012.00. The proposed STA is relatively flat and is in a natural clearing with native grasses and a few large trees (spruce and cottonwood) located to the south of the proposed STA. Page 2 SUBSURFACE The subsurface was investigated on December 13, 2015 by digging one soil profile test pit excavation (Test Pit). Only one Test Pit was excavated due to the presence of groundwater in the Test Pit. A visual soil analysis was completed by Carla Ostberg at the time of excavation.1 The soil was very wet to saturated, and the existing soil treatment area was encountered. The materials encountered in the Test Pit consisted of dark brown, moist, organic topsoil to 1.5-feet, underlain with medium brown, moist, loamy sand to 3-feet, underlain by a gray, moist to saturated organic horizon (which is likely the existing STA) to 4-feet, underlain by gravel and cobbles to a maximum depth explored of 6-feet. Groundwater entered the pit at approximately 3-feet below grade at the time of excavation. Given the location of the flood plain, the proximity to the river, and time of year, we estimate high seasonal groundwater at the ground surface. STA sizing is based on sand filter material (unlined sand filter). A long term acceptance rate (LTAR) of 1.0 gallons per square foot will be used to design the OWTS, in accordance with Section 43.11 C.c. presented in the Garfield County On-Site Wastewater Treatment System Regulations, adopted April 14, 2014. The OWTS will be sized based on 6-bedrooms. Design Calculations: 3 bedrooms x 75 gallons/person/day x 2 people/bedroom = 450 + [3 x 75 gal (4th – 6th bedrooms)] = 675 gal/day Septic Tank sizing for 6 bedrooms = 1750 gallons minimum + 250 gallons for pump Sand Filter Material = 1.0 gallons/ SF / day Approximate footprint of infiltrative area = 12’ x 57’ Height of mound = 18” replacement of topsoil layer with sand filter material + 3’ sand filter material + 1’ pipe and gravel + 1’ topsoil = 5’ Approximate footprint of basal area of mound based on height to infiltrative area of 5’ = 27’ x 87’ The installation will include one 2000-gallon septic tank with an Orenco® Biotube Pump Vault and an Orenco® PF5005 pump in the second compartment of the septic tank. The floats should be set to dose approximately 90 gallons each pump cycle. The control panel for the pump must be located within line of sight of the septic tank. Page 4 Effluent will be pressure dosed through a 1.5-inch diameter pump line to a mounded unlined sand filter. The mound will be positioned against the existing 6-foot high bank to blend the mounded area into the topography on the property. The topsoil horizon (18-inches) must be scraped from the base of the 12’ x 57’ mound and replaced with sand filter material. The mound will consist of a minimum of 3-feet of sand filter material above native grade. Sand filter material must be clean, coarse sand, all passing a screen having four meshes to the inch. The sand must have an effective size between 0.25 and 0.60 mm. The uniformity coefficient must be 4.0 or less. Material meeting ASTM 33, for concrete sand, with one percent or less fines passing 200 mesh sieve may be used. Pipes used to disperse the effluent must be surrounded by washed coarse screened gravel or crushed stone. All of the gravel or stone must pass a 2 ½-inch screen and must be retained on a ¾-inch screen. The manifold must be 1.5-inches in diameter. Laterals must be 1.25-inches in diameter with 1/8-inch diameter orifice holes facing down, spaced 3-feet on center. Each 1.25-inch diameter lateral must end in a sweeping ell facing up with a ball valve for flushing. A soil separation fabric should be placed over the gravel layer followed by approximately 1-foot of topsoil or other suitable soil able to support vegetative growth. The mound must have a minimum 3:1 slope (horizontal: vertical); therefore, the basal area will extend 15- feet beyond the sand filter on all sides, with the exception of the side of the mound bordered by the existing bank. Proposed disturbed areas below elevation 6088’ are to be armored with All American Green SC250 erosion fabric covered with 3-inches of topsoil and reseeded with native grasses. Reference High Country Engineering report dated February 19, 2016, Grading and Erosion Control for Floodplain Development, Project Number 2161012.00. The component manufacturers are typical of applications used by contractors and engineers in this area. Alternatives may be considered or recommended by contacting our office. Construction must be according to Garfield County On-Site Wastewater Treatment System Regulations, the OWTS Permit provided by Garfield County Building Department, and this design. REVEGETATION REQUIREMENTS An adequate layer of good quality topsoil capable of supporting revegetation shall be placed over the entire disturbed area of the OWTS installation. A mixture of native grass seed that has good soil stabilizing characteristics (but without taproots), provides a maximum transpiration rate, and competes well with successional species. No trees or shrubs, or any vegetation requiring regular irritation shall be placed over the STA. Until vegetation is reestablished, erosion and sediment control measures shall be implemented and maintained on site. The owner of the OWTS shall be responsible for maintaining proper vegetation cover. OPERATION INFORMATION AND MAINTENANCE The property owner shall be responsible for the operation and maintenance of each OWTS servicing the property. The property owner is responsible for maintaining service contracts for manufactured units, alternating STAs, and any other components needing maintenance. Geo-fabrics or plastics should not be used over the absorption area. No heavy equipment, machinery, or materials should be placed on backfilled STAs. Livestock should not graze on the STA. Plumbing fixtures should be checked to ensure that no additional water is being discharged to OWTS. For example, a running toilet or leaky faucet can discharge hundreds of gallons of water a day and harm a STA. Page 5 If an effluent filter or screen has been installed in the OWTS, we recommend this filter or screen be cleaned annually, or as needed. If the OWTS consists of a pressurized pump system, we recommend the laterals be flushed annually, or as needed. The homeowner should pump the septic tank every two years, or as needed gauged by measurement of solids in the tank. Garbage disposal use should be minimized, and non-biodegradable materials should not be placed into the OWTS. Grease should not be placed in household drains. Loading from a water softener should not be discharged into the OWTS. No hazardous wastes should be directed into the OWTS. Mechanical room drains should not discharge into the OWTS. The OWTS is engineered for domestic waste only. ADDITIONAL CONSTRUCTION NOTES If design includes a pump, weep holes must be installed to allow pump lines to drain to minimize risk of freezing. The pump shall have an audible and visual alarm notification in the event of excessively high water conditions and shall be connected to a control breaker separate from the high water alarm breaker and from any other control system circuits. The pump system shall have a switch so the pump can be manually operated. Excavation equipment must not drive in excavation of the STA due to the potential to compact soil. Extensions should be placed on all septic tank components to allow access to them from existing grade. Backfill over the STA must be uniform and granular with no material greater than minus 3-inch. INSTALLATION OBSERVATIONS ALL SERVICE septic, LLC must view the OWTS during construction. The OWTS observation should be performed before backfill, after placement of OWTS components. Septic tanks, distribution devices, pumps, dosing siphons, and other plumbing, as applicable, must also be observed. ALL SERVICE septic, LLC should be notified 48 hours in advance to observe the installation. LIMITS: The design is based on information submitted. If soil conditions encountered are different from conditions described in report, ALL SERVICE septic, LLC should be notified. All OWTS construction must be according to the county regulations. Requirements not specified in this report must follow applicable county regulations. The contractor should have documented and demonstrated knowledge of the requirements and regulations of the county in which they are working. In reference to the floodplain Datums- All of the site plans and mapping associated with the proposed OWTS location are referenced to the 2011 FEMA Mapping which uses the North American Datum 1988. The 1986 mapping references the 1929 North American Datum. There is approximately 4’ difference between the datums. The surveyed elevations on the site plan and contours reference the 1988 datum. Specifically to section 4-109 items C 1-10 we have the following comments following each item from the code. 1. The danger to life and property due to flooding or erosion damage; The OWTS is located accessed via the hillside and is elevated out of the floodplain. We have protected the slopes that project into the floodplain with a permanent erosion control fabric. The danger to life and property should be no more or less than the current danger living next to a floodplain. 2. The susceptibility of the proposed facility and its contents to flood damage and the effect of such damage on the individual owner; If flooding reaches the OWTS it will be approaching 100 year flooding some surface damage down to the erosion fabric may occur, and would also occur with native grade. Minor surface grading and re-vegetation may be required. This would also be required without the addition of the OWTS. 3. The danger that materials may be swept onto other lands to the injury of others; The erosion control fabric will protect the field components from being swept away. 4. The compatibility of the proposed use with existing and anticipated development; The OWTS is in a location where additional development is not anticipated. 5. The safety of access to the property in times of flood for ordinary and emergency vehicles; The location of the floodplain development does not impact access. The costs of providing governmental services during and after flood conditions, including maintenance and repair of streets and bridges, and public utilities and facilities such as sewer, gas, electrical, and water systems; No governmental services would be impacted. 7. The expected heights, velocity, duration, rate of rise, and sediment transport of the flood waters and the effects of wave action, if applicable, expected at the site; The extent of the 100 year flooding would create velocities less than 10 feet per second at the edges of the floodplain where this impact is located. The duration of the impact is likely less than 24 hours, but could occur daily for many days at some level. During this period with velocities and wave action there likely will be erosion of the soil above the erosion fabric. 8. The necessity to the facility of a waterfront location, where applicable; The necessity of placing the OWTS at this location is due to the size of the property and the limited options for locating the system out of the floodplain. 9. The availability of alternative locations, not subject to flooding or erosion damage, for the proposed use; and 10. The relationship of the proposed use to the Comprehensive Plan for that area. The necessity of placing the OWTS at this location is due to the size of the property and the limited options for locating the system out of the floodplain. The Comprehensive Plan for this location is residential medium density and there is very little impact to development with the placement of an OWTS. From Section 3-301 Section B 8. On-site waste disposal systems shall be located to avoid impairment to them or contamination from them during flooding. The OWTS has been located as far out of the floodplain as possible maintaining the proper setbacks. We are also proposing that the elevation of the infiltrative surface be 1.2’ above floodplain elevation. The system is also located downstream of an elevated area out of the floodplain that will create an eddy which will slow the velocities significantly at the OWTS location. Effectively the OWTS will be completely out of the floodplain after it is constructed. From Section 3-301 Section E 3. Adequate drainage paths around structures are required to guide flood waters around and away from proposed structures. Drainage shall not adversely impact adjacent properties. The location of the OWTS essentially removes a small section out of the floodplain and would potentially slow the velocities just downstream and on the adjacent property. Redirected drainage around the OWTS flows onto the applicants’ property and into the floodplain. There are no expected impacts to adjacent property. From Section 4-203 Section O: 1. Floodplain Specific Site Plan. The Applicant shall submit a Site Plan with specific information pertaining to the SFHA and shall include the following elements. The Floodplain Administrator may require, or the Applicant may choose to submit, a more detailed version of all or part of the Site Plan. Any elevation information shall be provided in the North American Vertical Datum of 1988. a. Base Flood boundary and water surface elevations; Shown on GR Sheets. b. Floodway boundary; Shown on GR Sheets. c. Channel of water course; Shown on GR Sheets. d. Existing and proposed topographic contours shown at vertical intervals of no greater than 2 feet; Shown on GR Sheets. e. An engineer’s report completed by a qualified professional engineer experienced in hydrology or hydraulics, using a methodology acceptable to FEMA or the CWCB, that address the standards in section 3-301.B-G. of this Code.
