B 3- 45 RESOLI.ITICL{ CTCNCERNED WITII A GAI.TI OF A SUBDIVISION SKEf,CH PIAN H(E{PTION TO IRCDI MqJIITAIN IN\IESIMENIS WHEREAS, Iron l,lountain fvestnents has filed a petition with the Boardof County Conrnissioners of Garfield County, Colorado, for approval of a sketch plan ard exemption from further subdivision prrceedings in accordarce with Section 3.02 and 3.02.01 of the Garfield County Subdivision Regulations of 1978, as amended; WHEREAS, Section 2.02.21(a) of the C,arfield County Subdivision Regulations, in reliarce uFon Section 30-28-101 (10) (a) , C.R.S. 1973, as amended, defines a division of land to irclude any parcel of land which is to be used for condominiums; WHEREA.S, a Fetitioner has requested that its conversion from apartments to condominiums be exempted from full subdivision review; WHEREA.S, based upon the evidence, testimony, exhibits, study of the Master PIan for the unircorporated area of the 6unty, connents of the C,arfield County Planning Departnrent, comnents of prblic officials and agercies, conrnents from all interesteo parties, this Board firds as fol-lows: I. That the pblic meetirrg before the Board was extensive and complete, that all pertinent facts, matters and issues were sukxnitteo, and that all interested parties rnere heard at the p:bIic meeting; 2. That the C,arfield County Planning Conrnission has reconrnended tothis Board that the sketch plan be approved, and that the petitioner be exempted from further subdivision review, provioed that certain conditions be addressed prior to the recording of a final plat; 3. That the proposed subdivision is in general compliarce with the reconrnendations set forth in the Master Plan for the unircorporated area of the County; 4. That the proposed land use will be compatible with the existing land uses in the nearby areai 5. That the requested subdivision neets all requirenents of the Zoning Resolution of C,arfield County, and further, that the requested subdivision is suitable and appropriate for the subject property corcerning the location, condition and circumstarces of said property, and that said subdivision implenents the Frrposes and meets the stardards ard requirernents of the Garfield County SuMivision Regulations; 6. That for the above-stated and other reasons, the proposed subdivision sketch plan is in the best interest of the health, safety, nrcrals, convenj.erce, order, prosperity and welfare of the citizens of C,arfield County; ard WHEREAS, as a condition of approval, the Board hereby finds as foll-ows: l. That a septic system has been installed on the subject property, which has been engineered by a registered professional engineer and isproperly permitted ard inspected in accordarce with the C,arfield County Regulations and Folicies; 2. That the utility company serving the subject property has submitted written confirmation of the provision of utility services to the proposed subdivision. That prior to final plat approval, the Division of Water Resourcesshall irdicate approval of the water source for the proposed suMivision. 2. That the county road rlght-of-way shal-l be shown on the final, p1at. 3. That prior to final p1at, the applicant shall prepare a site planat a scale adeqr.rate to evaluate the following: a. Iandscapirg; b. Parking (ircluding delineation of the access points and theelimination of the continuous drive per the reconrnendation of the County Road Supervisor) ;c. The screening of the trash receptacle and verification Lhatreceptacle is located outside the County right-of-way; andd. The applicant shalI investigate an alternate parking area. 4. That prior to final plat approval, this matter shall be referredto the c,arfierd county Planning conmission for their review.
