HomeMy WebLinkAbout4.0 Directors DeterminationGaffield Couln$ April27,2016 Divide Creek Builders c/o Dean Filiss 1531 County Road 342 sitt, co 81652 RE: PUD Minor Amendment - Preshana Farms PUD Text Amendment (File No. PUAA-03-16-8434) Dear Mr. Filiss: This letter is provided to you as the authorized representative for the Aspen Valley Polo Club, LLC application for a PUD Text Amendment of the Preshana Farms PUD. The Application has been reviewed in accordance with the Land Use and Development Code including Section 6-203 PUD Zoning Amendment. Said provisions require a Decision by the Director of the Community Development Department on whether to approve, approve with conditions, or deny the request. The Director's Decision on the Preshana Farms PUD Text Amendment is based on the following findings: 1. That proper public notice was provided as required for the Director's Decision. That consideration by the Director was extensive and complete, that all pertinent facts, matters and issues were submitted or could be submitted and that all interested parties were provided the opportunity to have input on the request. That for the above stated and other reasons, approval of the Minor PUD Modification request by the Aspen Valley Polo Club, LLC is in the best interest of the health, safety, and welfare of the citizens of Garfield County. That the Minor PUD Modification has been determined to be in general conformance with the Comprehensive Plan 2030, as amended. 2. 3. 4. 5. That subject to compliance with conditions of approval the Minor PUD Modification is in conformance with the Review Criteria contained in Section 6-203(C), Review Criteria of the Garfield County Land Use and Development Code, as amended. The Director's Decision is hereby issued approving your Application for a Minor PUD Modification for a PUD Text Amendment of the Preshana Farms PUD subject to the above findings and the following conditions: 1. That all representations made by the Applicant in the Application shall be conditions of approval unless specifically altered by the conditions of approval contained herein. 2. The amended PUD Plan and all associated documents shall be recorded with the Garfield County Clerk and Recorders Office within 30 days from this approval. The Land Use and Development Code requires notification to the Board of County Commissioners for their review and potential call-up of the Director's Decision. The Board review is for a period of 10 calendar days commencing on the date of the Director's Decision. The call-up period shall expire on Saturday May 7,2016 (Effectively Monday May g, 2016). Following the expiration of the call-up period you can proceed with meeting the conditions of approval and the recording of the amended PUD Guide. The amended PUD Guide needs to be recorded within 30 days of the date of the Director's Decision. Please contact the Community Development Depaftment if you have any questions regarding the Director's Decision and the next steps for finalizing your Minor Modification to the PUD.
