GENERAL PROJECT DESCRIPTION Applicants seek to amend approvals granted by the Board of County Commissioners for a Concrete Batch Plant approved by Resolution 2OLL-77 and extended by Resolution 2OL2'96. A Land Use Change Permit was issued in 2013 and recorded with Reception No. 835254. The approvaland specificallythe resolution, permitted a concrete batch plant to be located and maintained within the reclaimed Powers Pit despite ektraction operations ceasing at this location. The Appticant has been awarded a contract to provide concrete material to the work being complete on the Grand Avenue Bridge. The Applicant is seeking to amend the condition of approval#5.h. that provides that the plarit operate only Monday through Saturday between 7.00 a.m. to 7.00 p.m. The Applicant has represented that the contract with CDOT will require the plant to run during nighttime hours and potentially 7 days per weeks. The gravel material will be able to be hauled to the site during the regular operating hours however, the concrete will be processed and exit the site during the night. REGUTATORY PROVISIONS APPLICANT IS REqUIRED TO ADDRESS The Land Use and Development Code requires any change to a specific condition of the approvalto be considered a Substantial Amendment pursuant to Section 106.A.3, therefore, the following provisions of the LUDC will apply: . Section -f:OG Amendments to an Approved Land Use Change Permit . Section 4-101 Common Review Procedures and Table 4-102 . Section 4-105 Major lmpact Review. Section 4-201- Application Materials and Table 4-2Ol . Section 4-203 Description of Submittal Requirement ' Article 7 - Divisions L,2, and 3 and 7-1002 III. SUBMITTAL REqUIREMENTS lf the Director determines that the proposed amendment constitutes a Substantial Modification, the change shall require a new application for a Land Use Change Permit. However, the Director shall determine the contents of the application submission requirements for a Substantial Modification. The following information shall be submitted as part of this application: A GeneralApplicationMaterials a. Deed; b. OwnerAuthorization; c. Copy of approval Resolution(s) , d. _CppySf.-apffqved Land Use Cha 2lP age e. Property owner name and mailing address with 200 feet and a map showing these adjacent ProPerties; f. List of names and mailing addresses of mineral owners of the subject site; g. Project Narrative, including estimate of average daily truck counts (day and night), discussion of compliance with state statutes related to noise, existing air permits, and any other relevant information describing proposed operations. Waiver request for Section 7-ilOOL H. regarding hours of operation and reason for waiver. Please respond to criteria in Section 4-118 of the LUDC (attached is a word version of this section of code); Vicinity Map; Site Plan; Proposed Lighting Plan, if applicable. IV. REVIEW PROCESS Though a new application is required, the review of the application may result in an approval, approval with conditions or denial of the amendment only. lf the amendment is denied, the Applicant's original approval is stillvalid. The process to accommodate this request shall require a Land Use Change Permit Application for an "Amendment to an Approved LUCP - Major lmpact Review" is a follows: Pre-a pplication Conference. L3LLZ Highway 82 Type of Application: Amendment to an Approved Land Use Change Permit - Major lmpact Narrative: On July Lg,2Ot3 Oldcastle acquired the assets of Lafarge West, lnc. With the acquisition of Lafarge's assets Oldcastle assumed the lease for the Powers Ready Mix plant site. The leased 5.85 acre area resides wlthin the 35.308 acres described in the attached Exhibit A.g.1. With this application we are requesting that the parcel identification number and legal description for the batch plant site approved under Resolution 20t,l-77, z1tz-gireflect that the batch ptant site now resides in PIN 239326400007 as descrlbed in attached Exhibit A.g.1 tn 2013 Garfietd County approved a resolution permitting the concrete batch plant to be located and maintained within the reclaimed Powers Pit. A copy of this resolution is attached. ln 2015 CDOT awarded the Grand Ave Bridge Replacement project to Granite Construction. Granite Construction issued a ready mix purchase order to Oldcastle to supply ready mix for this project. The project specifications require that the bridge replacement project keep the impact to the motoring public to a minimum. The project is scheduled to take a little over two years to complete. Because of the long duration of this project it is impossible to predict exactly when the ready mix is going to be needed on site. However, we do know the project schedule will require ready mix production and delivery to the project site to take place during nighttime hours and potentially 7 days per week. Currently the Powers Ready Mix plant site is permitted to operate Monday through Saturday from 7am to 7pm. Because of the reasons stated above we seek to amend the condition of approva! #5.h to allow to run 24 hours per day and 7 days a week. Obviously we will not run this many hours or days but we need this for the.flexibility to meet the project schedule. The gravel materiat used in the ready mix product will be hauled to the site during the regular operating hours. This request is project specific meaning we will only operate outside the current hours of operation for the Grand Ave Bridge Replacement Project. The ready mix purchase order for the Grand Ave Bridge project is for +/- L7,OOO cubic yards. Currently the Powers Ready Mix plant has a CDPHE Air Permit with an annual production limit of 100,000 cublc yards. The project specific yards will make up roughly L7% ol our annual production limit. During the last 2 years we've averaged +/- 20% of our production limit so the addition of the bridge project yardage wil! be well below our limit.
