I. GENERAL PROJECT DESCRIPTION
Applicants seek to amend approvals granted by the Board of County Commissioners for a
Concrete Batch Plant approved by Resolution 2OLL-77 and extended by Resolution 2OL2'96. A
Land Use Change Permit was issued in 2013 and recorded with Reception No. 835254. The
approvaland specificallythe resolution, permitted a concrete batch plant to be located and
maintained within the reclaimed Powers Pit despite ektraction operations ceasing at
this location. The Appticant has been awarded a contract to provide concrete
material to the work being complete on the Grand Avenue Bridge.
The Applicant is seeking to amend the
condition of approval#5.h. that provides that the
plarit operate only Monday through Saturday
between 7.00 a.m. to 7.00 p.m. The Applicant has
represented that the contract with CDOT will
require the plant to run during nighttime hours and
potentially 7 days per weeks. The gravel material
will be able to be hauled to the site during the
regular operating hours however, the concrete will
be processed and exit the site during the night.

II. REGUTATORY PROVISIONS APPLICANT IS REqUIRED TO ADDRESS
The Land Use and Development Code requires any change to a specific condition of the approvalto be
considered a Substantial Amendment pursuant to Section 106.A.3, therefore, the following provisions
of the LUDC will apply:

III. SUBMITTAL REqUIREMENTS
lf the Director determines that the proposed amendment constitutes a Substantial Modification, the
change shall require a new application for a Land Use Change Permit. However, the Director shall
determine the contents of the application submission requirements for a Substantial Modification.
The following information shall be submitted as part of this application:

night), discussion of compliance with state statutes related to noise, existing air
permits, and any other relevant information describing proposed operations.
Waiver request for Section 7-ilOOL H. regarding hours of operation and reason for
waiver. Please respond to criteria in Section 4-118 of the LUDC (attached is a
word version of this section of code);

IV. REVIEW PROCESS
Though a new application is required, the review of the application may result in an approval,
approval with conditions or denial of the amendment only. lf the amendment is denied, the
Applicant's original approval is stillvalid. The process to accommodate this request shall
require a Land Use Change Permit Application for an "Amendment to an Approved LUCP -
Major lmpact Review" is a follows:

Narrative:
On July Lg,2Ot3 Oldcastle acquired the assets of Lafarge West, lnc. With the acquisition of Lafarge's assets
Oldcastle assumed the lease for the Powers Ready Mix plant site. The leased 5.85 acre area resides wlthin the
35.308 acres described in the attached Exhibit A.g.1. With this application we are requesting that the parcel
identification number and legal description for the batch plant site approved under Resolution 20t,l-77,
z1tz-gireflect that the batch ptant site now resides in PIN 239326400007 as descrlbed in attached Exhibit
A.g.1
tn 2013 Garfietd County approved a resolution permitting the concrete batch plant to be located and
maintained within the reclaimed Powers Pit. A copy of this resolution is attached.
ln 2015 CDOT awarded the Grand Ave Bridge Replacement project to Granite Construction. Granite
Construction issued a ready mix purchase order to Oldcastle to supply ready mix for this project. The project
specifications require that the bridge replacement project keep the impact to the motoring public to a
minimum. The project is scheduled to take a little over two years to complete. Because of the long duration of
this project it is impossible to predict exactly when the ready mix is going to be needed on site. However, we
do know the project schedule will require ready mix production and delivery to the project site to take place
during nighttime hours and potentially 7 days per week. Currently the Powers Ready Mix plant site is
permitted to operate Monday through Saturday from 7am to 7pm. Because of the reasons stated above we
seek to amend the condition of approva! #5.h to allow to run 24 hours per day and 7 days a week. Obviously
we will not run this many hours or days but we need this for the.flexibility to meet the project schedule. The
gravel materiat used in the ready mix product will be hauled to the site during the regular operating hours.
This request is project specific meaning we will only operate outside the current hours of operation for the
Grand Ave Bridge Replacement Project.
The ready mix purchase order for the Grand Ave Bridge project is for +/- L7,OOO cubic yards. Currently the
Powers Ready Mix plant has a CDPHE Air Permit with an annual production limit of 100,000 cublc yards. The
project specific yards will make up roughly L7% ol our annual production limit. During the last 2 years we've
averaged +/- 20% of our production limit so the addition of the bridge project yardage wil! be well below our
limit. (See attached truck count analysis)

per the requirernents set forth in Section lll. Submittal Requirements ltem B. Oldcastle SW
Group, lnc. dba United Companies reguests a Waiver Request for Section 7-lOF/lH regarding
Hours and Days of Operations (currently Monday through Saturday 7am to 7pm) to allow the
plant to supply concrete material to the Grand Avenue Bridge project. CDOT specifications,
scheduling & traffic safety program require that the concrete supplier (United Companies) make
available the concrete 24 hours a day, 7 days a week for the duration of the project. This waiver
request is project specific to the Grand Avenue Bridge Project and will not apply to other
projects not related to the Grand Ave. Bridge project.The justification for this request is the
plant will not exceed its annual production limits and will not exceed fugitive dust emissions
limits set forth in State permit#. (See attached Exhibit A production spreadsheet and truck
count analysis). We feelthis waiver: imposes no greater lmpacts on adjacent properties than
would occur through compliance with the specific requirements of this Code.

Landlord') and Roaring Fork Sand & GravelCompany, lnc. dated April 19,2001; as modified by (i) Fkst
Amendment to Lease Agreement between Original La.ndlord and Westem Mobile, lnc. dated June22,
2OO1; (ii) Second Amendment to Lease Agreementbetween Crystal Ranch Corp. ('tgru!lorc!") and
Lafarge West, lnc. ("@!') dated June 30, 2008; (lii) Third Amendment to Lease Agreement between
Landlbrd and Tenant dated as of September 18, 2009; (iv) Fourth Amendment to Lease Agreement
between Landlord and Tenant dated as of November 15, 2010; and (v) Short Term Lease Extension
between Landlord and Tenant dated effective as of April 28, 2013 (the "Extension) (collectively, the
"ElE'), Landlord leases to Lafarge West, lnc. certain property located in Garfield County, Colorado, as
more fuity described in said Lease as the Revised Leasbd Premises (the'Property") for a term and upon
the terms and conditions set forth in said Lease; and
WHEREAS, Oldcastle SW Group, lnc. ('Eg.fg@l') entered into an Asset Purchase Agreement
with Tenant dated as of May 2, 2013(the nPurchase Aoreement'), pursuant to which Purchaser has the
right to acquire certain rights, properties and assets owned or held by Tenant or used by Tenant primarily
related to Tenant's operations in Colorado as morc particularly described in the Purchase Agreement,
including without limitation all of Tenant's rights, interests and obligations under the Lease (excepting the
Stage One and Stage Two reclamation obligations and othei matters and obligations that Tenant will
coniinue to perform, in each case, as described in that certain Continuing Reclamation Obligations
Agreement of even date herewith between Landlord and Tenant) (the 'Acquisition"). Landlord
understands that in connection with the Acquisition, Tenant requires Landlord's consent to the
assignment of the Lease to Purchaser (the 'Assignment'), and that Purchaser has requested an estoppel
certificate certifying as to the facts set forth below.
NOW, THEREFORE, subject to the matters set forth below and in Paragraph 14 of the Lease,
Landlord hereby consents to the Assignment and certifies to Purchaser as follows:
1. Athched to ttris Certification as Exhibit A is a true and complete copy of the Lease.
The Lease is in fullforce and effect, and (excepting as setforth in the Extension) Landlord has no
knowledge of any uncured default on the part of Landlord or Lafarge West, lnc. (as Tenant) under the
Lease and no ev-ent has occurred that, with the delivery of notice, the passage of time or both, would
constitute a breach or default under such Lease, and no amounts are past due under the Lease.
2. Lafarge West, lnc, ls ln possession of the Property. Except as disclosed in matters
of record, or as may be set forth ln the Lease, no other parties have a right to possess, use, access or
occupy any portion of the Property.
3. The Lease has not been changed, modified, amended orassigned exceptas
descrlbed above. There are no agreements between Landlord and Lafarge West, lnc. or its affiliates
regarding the Proper$ or the Lease except as described above.
4. The Extended Batch Plant Term of the Lease is through Aprll 28, 202ti. Tenant has
no options to extend the Lease Term following such date.
5. The current Ground Rent payable under the Lease is $16,032.65 per month.

G. The Garfield County Planning Cornmission closed the public heming on September
28,2011and forwarded a recomnendation of approval with conditions to the Board.of Cowty
Commissioners
H. The Board of County Qemmissioners'opened a public hearing on the 5e day of
December, 201I upon the question of whether the I.and Use Change Pen:rit application for the
substantial modifioation to an existi4g Special Use Permit should be approved, approved with

2011 to make a final decision.
J. The Board of County Commissioners on the basis of substantiat competent. evidence
produced at the aforementioned hearings has made the following determinations of fagt:
1. That the proper notice was provided as required for the hearings before ths Board of
Comty Commissioners; and
2. That the hearings before the Board of County Commissioners was ortensive and
complete, that all pertinent facts, matters.and issues were submitted or could be zubmitted

NOW TITnREFORE, BE IT RESOL\IE,D by the Board of County Commissioners of Garfield
County, Colorado, that:

private driveway access taking into account stacking disbnce ancl site

Applicaat shall workwith Colorado Deparhent of Tranqportatiou'and
County Road and Bridge to determine the necessity of any additional road
improvemen8, including but not limited to turn lanes,
deceleration/acceleration lanes, aad drainage improvements. A copy of an
approved Colorado DeparEnent of Transportation access permit shall be
provided to the Planning Departnent

construct andprovide adequate financial secuity for any work to be
completed on County Road 103, in b form as requirod by the County and

upon or cross the Crystat Ranch Corp. property.

on private property and shdll not be conducted on a publio right-of-way;
iii. All indushiat wast$ shall be disposed of in a manner consistent with statutes
and requiremeuts of Coloredo Departuent ofPublic Health and Environmenfi
iv. Bvery use shall be oporated so that tho ground vibration inhere,ntly and
recurrently generated is not perceptible without instruments at any point of any
bounilary line of the property; and
v. Eyery use shall be operated so that it does not emit, heat, glare, radiatiou, dust,
or fumes which substantially interfere with the existing use of adjoining property
or which constitrtes a publio nuisance or hazard. Flaring of gas€s, aircraft
waming signal and reflective painting of storage tanks, of ofier legal
requirements for safety or air pollution contnol measures shall be exempbd from
this provision.
k. The applicant shall impleme,nt the revised landscaping plan in areas outside of
those directly impacted by the continued operation of the concrete batch plant by
April 30, 2013. The full extent of the landscaping plan shall be implemented upon
the termination ofthe batchplant lease in 2028.
l. Prisr to the issuance of a Iand Use Change Permit an Emergency Preparedness
Plan shall be submitted tq the Planning Departnrert and the Carbondale Rural Fire
hotection District.
m. Gravel for this concrete batch plant shall be hauled from Cerise Mine excepi
for limited quautities of specialty products not available at this location which
may bs brougfut ia &om other sources. Coutrary to any provision in the C-ormtyns
Unified Land Use Resolution in effest at the time of the request, the Director of
Building and Plenring or the Board of County Commissioners may consider my
change to this condition ofapproval as either a *non-substantial ch4 ge" or a*substantial changd'depending uponthe evidence of any changes to off-site

D. The Land Use Change Permit for the "Continued operation of a concrete batch
plant known as the Power's Pit Concrete Batch Plant" was conditionally approved on
December 5,2012 under Resolution No. 20ll-77 for the property located at 0l3l l4 State
Highway 82 described in Exhibit A of Resolution20ll-77.
E. [n accordance with the Garfield County Land Use Resolution of 2008, as
amended, the approval was effective for a period of one year, with the allowance for the
applicant to request an extension of one year to complete conditions of approval.
F. In accordance with the Garfield County Land Use Resolution of 2008, as
amended, the Applicant filed a request to extend the time period to satisry conditions of
approval for an additional year, to December 5,2013,

Commissioners of Carfield County, Colorado, that:

B. The request for extension of approval of a Land Use Change Permit was made

Narrative:
On July L9,20t3 Oldcastle acquired the assets of Lafarge West, tnc. With the acquisition of Lafarge,s assets
Oldcastle assumed the lease for the Powers Ready Mix plant site. The leased area resides within the 35.30g
acres described in the attached Exhibit A.g.1. With this apptication we are requesting that the parcel
identification number and legal description for the batch ptant site approved under Resolution zot1.-71,
2Ot2'96 reflect that the batch plant site now resides in PIN 239326400007 as described in attached Exhibit
'A.g.1
ln 2013 Garfield County approved a resolution permitting the concrete batch plant to be located and
maintained within the reclaimed Powers Pit. A copy of this resolution is attached.
ln 2015 CDOT awarded the Grand Ave Bridge Replacement project to Granite Construction. Granite
Construction issued a ready mix purchase order to Otdcastle to supply ready mix for this project. The project
specifications require that the bridge replacement project keep the impact io the motoring public to aminimum' The project is scheduled to take a little overtwo years to comptete. Because of the long duration ofthis project it is impossible to predict exactly when the ready mix is going to be needed on site. However, we
do know the project schedule witl require ready mix production and delivery to the project site to take ptace
during nighttime hours and potentially 7 days per week. Currently the powers Ready Mix plant site ispermitted to operate Mondaythrough Saturday from 7am to 7pm. Because of the reasons stated above we
seek to amend the condition of approval #5.h to allow to run 24 hours per day and 7 days a week. obviousty
we will not run this many hours or days but we need this for the flexibility to meet the project schedule. Thegravel material used in the ready mix product witl be hauted to the site during the reguiar operating hours.
This request is project specific meaning we will only operate outside the current hours of operation for the
Grand Ave Bridge Replacement pr:oject.
The ready mix purchase order for the Grand Ave Bridge project is for +/- 17,000 cubic yards. Currently the
Powers Ready Mix plant has a CDPHE Air Permit with an annuat production limit of rO6,OoO cubic yards. Theproject specific yards will make up roughly LTYo of our annual production limit. During the last z years we,ve
averaged +/'zl%of our production limit so the addition of the bridge project yardage will be well below ourlimit. (See attached truck count anatysis)

Group, lnc. dba United Companies requests a Waiver Request forSection 7-1001H regarding
Hou,rs and Days of Operations (currently Monday through Saturday 7am to 7pm) to allow the
plant to supply concrete material to the Grand Avenue Bridge project. CDOT specifications,
scheduling & traflic safety program require that the concrete supplier (United Companies) make
available the concrete 24 hours a day,7 days a week for the duration of the project. This waiver

projects not related to the Grand Ave. Bridge project. The justification for this request is the
plant will not exceed its annual production limits and will not exceed fugitive dust emissions
limits set forth in State permit #. (See attached Exhibit A production spreadsheet and truck
count analysis). We feel this waiver imposes no greater:impacts on adjacent properties than
would occur through compliance with the specific requirements of this code.

PAYMENT AGREEMENT FORM
GARFIELD COUNW ("COUNff") and Property Owner ("APPLICANT")CPt, LLc
egree as follows:
The Applicant understan& and agrees that Garfleld County Resotutlon No. 2014-6O, as
amended, establlshes a fee schedule for each type appllcatlon, and the guldelines forthe
admlnlstratlon of the fee structure.
The Applicant and the County agree that because of the slze, nature or scope of the
proposed proJect, lt ls not possible at thls tlme to ascertaln the full extent of the costs
lnvolved ln processing the appllcatlon. The Appllcant agrees to make payment of the Base
Fee, established forthe Project, and to thereafter permit additlonalcosts to be bllled to the
Appllcant. The Appllcant agrees to make addltlonal payments upon notlflcation bythe
County, when they are necesary as costs are lncured.
The Base Fee shall be in addltlon to and excluslve of any cost for publlcatlon or cost of
consuhing service determlned necessary by the Board of County Commlssloners for the
consideratlon of an appllcatlon or addltlonal County staff tlme or expense not covered by
the Base Fee. lf actual recorded costs exceed the inhial Ease Fee, the Appllcant shall pay
additlonal bllllngs to the County to relmburse the County for the processing of the Project.
The Appllcant acknowledges that al! biliing shall be pald prlor to the final conslderatlon by
the C.ounty of any Land Use Change or Division of Land.
