Sievers were received by our office. While your intention was to try and establish nonconforming use status, it is questionable if a non -notarized statement would hold up in a court hearing as evidence. Regardless of that, no one in this office has any documentation to contest you or Mr. Sievers statements, and we will issue building permits under the provisions of the zoning resolution as it now reads. For your information and in the interest of trying to avoid any future confusion, the Board of County Commissioners recently amended the Zoning Resolution to include the following language: 7.05 REPLACEMENT OF MOBILE HOME - A mobile home which is a nonconforming use, may be replaced by another mobile home on the same lot, provided the replacement mobile home has the same amount of habitable floor area or is larger than the nonconforming mobile home and it conforms to the Building Code Resolution permit requirements for the placement of a mobile home and the Individual Sewage Disposal System Regulations of the County. These are the criteria we will have to use in reviewing applications for nonconforming mobile homes. As you can see, the laws and regulations of the County are subject to change after the appropriate public hearings and notices. The previously noted change was initiated by the Board of County Commissioners. As such, the determinations of anyone regarding nonconforming uses is subject to the laws and regulations in existence at that time.
