The proposed use is located 4611 CR 237 and known by Assessor's Parcel No. 2127-131-02-001. The Director's Decision on the Application is based on the following findings and subject to the Applicant's representations and conditions of approval. 1. All representations of the Applicant contained in the application shall be considered conditions of approval unless specifically modified by the Director of Community Development. 2. The Applicant shall comply with all local, state and federal regulations regarding facilities of this type. 3. Prior to issuance of the Land Use Change Permit the Applicant shall obtain a Road & Bridge Driveway Permit and complete all required improvements. 4. Prior to issuance of the Land Use Change Permit the Applicant shall make upgrades to the existing driveway per the requirements of the Colorado River Fire Rescue District including widening of the road to 16' and creation of 10' x 40' pullouts every 400 foot along the private road. 5. Prior to issuance of the Land Use Change Permit the Applicant will provide Community Development a letter of acceptance from Colorado River Fire Rescue regarding the sufficiency of the Fire Mitigation Plan. 6. If event capacity exceeds 50 persons the two on-site restroom facilities shall be augmented with adequate porta-potties with hand -washing Roberts Community Meeting Facility Director Decision May 2, 2016 stations based upon national standards for special events or a qualified service provider. 7. Based upon the limited provision of infrastructure to serve the facility, the Roberts Public Meeting Facility shall be limited to 52 events annually and a maximum capacity of 200 persons per event. The facility may not be expanded, nor guest capacity exceeded, until such time as permanent water, sanitation and electricity is provided to serve the facility. 8. The facility shall be subject to all Garfield County Building Code Requirements. The property owner shall obtain any necessary Garfield County Building Permits for the proposed structure. 9. The Applicant shall obtain all necessary state permits that may be necessary regarding the vault and haul scenario for both water and sanitation. 10. All exterior lighting shall be downcast and shielded in compliance with Section 7-304, Lighting Standards, of the Land Use and Development Code of 2013, as amended. 11.The Public Meeting Facility hours of operation shall be 8 a.m. until midnight with all activities to occur inside the structure after 10 p.m. 12. Prior to and during special events the Applicant shall provide adequate dust mitigation on the private subdivision road, either through watering or application of magnesium chloride. This Director's Decision will be forwarded to the Board of County Commissioners for a period of 10 days so that they may determine whether or not to call up the application for further review. Once this time period has passed with no request for review or public hearing, and provided all relevant conditions of approval have been resolved the Land Use Change Permit will be issued. DESCRIPTION OF THE PROPOSAL The Applicant is requesting a permit for a Community Meeting Facility on a 12.79 -acre parcel located within the Rural zone district north of the Town of Silt. The Applicant proposes to use this facility to host weddings, conferences and other public events. The event will be held in a building to be constructed, a building that will also function as agricultural storage. The proposal includes utilization of the site primarily in the spring, summer and fall months, with approximately two event held per week with 48 total number of events planned annually. Average attendance per event will be range between 150 to 175 guests and all food and beverage is planned to be catered, with all food preparation completed off-site and delivered for the event. The site will primarily be utilized for agricultural purposes and the proposed special events will not alter the ability to continue the existing use as it has historically operated. The meeting facility structure is proposed as dual use, for use as an equipment storage barn in addition to the community meeting facility use. The structure is to be located in an area of the property that is currently unirrigated, thus no loss of agricultural land is anticipated. The application proposes to provide water and sanitation via a vault and haul scenario, and access to the site is via an existing private roadway from CR 237. The gravel road will be upgraded to 16' width per Fire District requirements. Electricity is planned to be provided by portable generators. Roberts Community Meeting Facility Director Decision May 2, 2016 The Garfield County Comprehensive Plan identifies the property as Low Density Residential (10+ acres/dwelling unit). The site currently complies with this designation and it is not anticipated that the requested activities will impact the site's general conformity with the Comprehensive Plan. II. DESCRIPTION OF THE SITE Parcel 1, the subject site, was created by the Harvey Gap Minor Subdivision in 1980, Reception Number 310577. This plat is entitled Harvey Gap Minor Exemption and was signed by the Board of County Commissioners in December, 1980. WAIVER REQUESTS FROM STANDARDS The proposal will require a waiver from the Landscaping Standards. This is appropriate based upon the existing site and maintaining the agricultural appearance of the site. IV. APPLICABLE REGULATIONS A.The Land Use Tables contained in Section 3- 403 of the Land Use and Development Code, designates a Community Meeting Facility within the Rural zone district as requiring Administrative Review. B.Section 4-103 of the Land Use and Development Code sets forth the Administrative Review Procedures by which the current Application is being considered. C. The Application submittal requests four waivers from submittal requirements which include an Improvements Agreement, Development Agreement, Grading and Drainage Plan, and the Landscape Plan. Submittal waivers have been accepted as part of the completeness review. D. Article 7 of the Land Use and Development Code sets forth General approval standards in Division 1, General Resource Protection Standards in Division 2 and Site Planning and Development Standards in Division 3. The standards are addressed in the Application submittals and in the Staff Analysis section of the Staff Report. V. PUBLIC AND REFERRAL COMMENTS The Applicant has provided documentation that all required notice mailings have been completed in accordance with the LUDC. No public comments were received as a result of the public notice. Referral Comments received on the Application are attached as Exhibits and summarized below: 1. Farmers Irrigation Company, Exhibit F: Sean Mello responded on behalf of the ditch company that they had no issues with the proposal. 3 Roberts Community Meeting Facility Director Decision May 2, 2016 2. Garfield County Road and Bridge, Exhibit G: Wyatt Keesbery responded to the referral that he reviewed the existing driveway entrance which needs to be updated with a new apron, trees pruned for adequate site distance, and a stop sign installed. A driveway permit will be required which will itemize the required improvements. 3. Colorado River Fire Rescue, Exhibit H: Orrin Moon responded that he has been working with the Applicant to put an adequate Fire Mitigation Plan in place, he requests that the Plan include a fire access area to the front of the building. 4. Mountain Cross Engineering, Exhibits I and M: Chris Hale responded that the Applicant should provide existing and maximum driveway grades for access, and that they evaluate the size of the wastewater holding tank in Tight of the size of the potable water tanks. Mr. Hale responded to the submittal of additional information, Exhibit L, that all concerns had been adequately addressed. 5. Garfield County Vegetation Management, Exhibit J: Steve Anthony responded that he had no comments. Agencies that did not respond to the referral request: Sheriff Bureau of Reclamation Environmental Health Conservation District Parks and Wildlife Silt Water Conservancy VI. STAFF ANALYSIS In accordance with the Land Use and Development Code, the Applicant has provided detailed responses to the Submittal Requirements and applicable sections of Article 7, Divisions 1, 2, and 3, including Section 7-1001 Industrial Use Standards. The application materials include an Impact Analysis and related consultant reports, technical studies, and plans. DIVISION 1. GENERAL APPROVAL STANDARDS. The following standards apply to all proposed Land Use Changes, including divisions of land, unless elsewhere in this Code a use is explicitly exempt from one or more standards. 7-101. ZONE DISTRICT USE REGULATIONS. The Land Use Change is permitted by Administrative Review in the Rural zone district and it appears that the site is otherwise compliant with the zoning regulations. 7-102. COMPREHENSIVE PLAN AND INTERGOVERNMENTAL AGREEMENTS. The site is designated on the Future Land Use Map as Residential Low Density. The site will maintain its agricultural uses and the proposed structure will be dually used for the 4 Roberts Community Meeting Facility Director Decision May 2, 2016 public events and as storage for agricultural equipment. The site appears to be generally conforming with the Comprehensive Plan including Chapter 3 — Plan Elements, Section 4, Economics, Employment and Tourism as well as Section 6 regarding Agriculture. Section 4 - Economics, Employment and Tourism. This section of the Plan discusses the diversity of economic opportunities available in Garfield County and the growth of tourism. Section 6 — Agriculture. This proposal offers the owner the ability to diversify their use of this land while maintaining the agricultural activities so important to Garfield County. 7-103. COMPATIBILITY. Mei : MMM ■MM!MM' MMM', ■MM MMM MMR NORTH ELEVATION SOUTH ELEVATION Figure 3 Proposed Event Structure The intermittent nature of the proposal is compatible with the scale and intensity of the with adjacent land uses. 7-104. SOURCE OF WATER. The Applicant proposes to supply drinking water via Water Buffalo Trailer supplied and delivered by the Thirsty Water Company of Glenwood Springs. The trailer hold 1,235 gallons of drinking water with spigots on the side of the trailer. The amount of water to be provided to each event will be based upon proposed attendance of the event. 5 Roberts Community Meeting Facility Director Decision May 2, 2016 The Applicants also plan for delivery of water to be utilized in the vault and haul sanitation systems for the toilets and sinks. The water will be stored in 1,800 gallon tanks. Water for firefighting purposes will come from the existing subdivision system in place. Indoor fire sprinklers have been deemed unnecessary by the Fire District. 7-105. CENTRAL WATER DISTRIBUTION AND WASTEWATER SYSTEMS. Wastewater will be provided via a vault and haul system due to the seasonal intermittent nature of the project. This will allow for the provision of two interior restrooms with the ability for hand washing. Wastewater will be stored in a buried cement tank with 2,000 gallons capacity. The tank will be pumped once a week, or more often as needed. Mountain Cross Engineering questioned the capacity of the wastewater tank, based upon the size of the potable water tanks, Exhibit I. Bruce Lewis, the Applicant's engineer, responded that the potable water tank capacity will not exceed 1,800 gallons, Exhibit L. 7-106. PUBLIC UTILITIES. The Applicant proposes that electricity be provided to the facility by portable generators, which may be adequate based upon the number of events planned annually. 7-107. ACCESS AND ROADWAYS. The site has access to CR 237 via a subdivision private roadway. The existing land width of the private road will need to be expanded in areas to 16' width to accommodate emergency vehicles and a standard vehicle passing on the road. The Fire District also requires the construction of 10' x 40' pullouts every 400 feet to allow for sufficient access to the site. Road & Bridge will also require some improvements in order to issue a driveway permit for the site. These improvements include installation of a stop sign, removal of vegetation to improve site distance, and a new apron is required. These improvements will need to be completed prior to issuance of the Land Use Permit and therefore a condition is recommended regarding this requirement. The proposed average daily traffic on this road includes the proposed facility as well as agricultural traffic. This should not exceed average daily trips designated for Semi - Primitive road standards in the LUDC, therefore it appears that the facility meets the minimum roadway requirements of the LUDC based upon the dual use and intermittent nature of the facility. 7-108. USE OF LAND SUBJECT TO NATURAL HAZARDS. Numerous maps were provided in the application to demonstrate that the site is not subject to any natural hazards, including the 100 year floodplain. 6 Roberts Community Meeting Facility Director Decision May 2, 2016 7-109. FIRE PROTECTION. The site is located within the Colorado River Fire Rescue District and Fire Marshall Orrin Moon responded, Exhibit H, that they have been working with the Applicants on a Fire Mitigation Plan. They request that this plan include fire access to the front of the structure and this has been added as a recommended condition of approval. DIVISION 2. The following resource protection standards apply to all proposed Land Use Changes, including divisions of land unless elsewhere in this Code a use is explicitly exempt from one or more standards. 7-201. AGRICULTURAL LANDS. The Applicant proposes to utilize an agricultural structure for intermittent events to be held at the site. The events will not impact the agricultural aspect of the site. 7-202. WILDLIFE HABITAT AREAS. Brian Gray of the Colorado Parks and Wildlife provided the Applicant an email that stated that the site did not contain any critical wildlife habitat therefore impacts would be insignificant. 7-203. PROTECTION OF WATERBODIES. The Applicant has stated that there are no water bodies on the site. The site is immediately adjacent to Harvey Gap which is a state park administered by the Colorado Parks and Wildlife. No comments were received from CPW with regard to any potential impact to the park. 7-204 DRAINAGE AND EROSION. Based upon the topographic analysis of the site, Bruce Lewis, P.E. of Boundaries Unlimited, stated that drainage and erosion are not an issue on the site and that drainage from this facility will not adversely affect he existing use of the property or any neighboring properties. An Erosion Control Plan has been compiled for the construction of the building and this plan will be reviewed at building permit. 7-205. ENVIRONMENTAL QUALITY. The use of the site for intermittent public meetings/weddings should not adversely impact 7 Roberts Community Meeting Facility Director Decision May 2, 2016 either the air or water quality of the site. The site will utilize 50 -amp gas -powered generators for interior electricity and solar powered lights will be used on the pathways and in the parking lot. The proposed vault and haul waste management system is adequately set back from the 100' limit of Harvey Gap. No hazardous materials will be stored on-site. 7-206. WILDFIRE HAZARDS. The property vegetation consists of pinyon and juniper in the area of the facility, the remainder of the site is in agricultural production. The site is surrounded on more than 2 sides by Harvey Gap. A Fire Mitigation Plan should adequately address any potential fire hazards associated with the site. 7-207. NATURAL AND GEOLOGIC HAZARDS. No slope development issues or other geologic hazards are associated with the property. 7-208. RECLAMATION. The site is not subject to reclamation. DIVISION 3. SITE PLANNING AND DEVELOPMENT STANDARDS. Unless a use is explicitly identified elsewhere in this Code as being exempt from 1 or more standards, the following standards shall apply to all uses, divisions of land and PUDs. Single-family dwelling units, are specifically exempt from these Division 3 standards. 7-301. COMPATIBLE DESIGN. Operation of the proposed facility may be consistent with nearby uses if capacity, lighting and noise issues are mitigated. The intermittent nature of the use, in conjunction with maintaining the existing agricultural operation, will allow the site to remain compatible with adjacent uses. 7-302. OFF-STREET PARKING AND LOADING STANDARDS. The site proposes to construct 75 parking spaces with overflow parking available on the adjacent field. Based upon the capacity and square footage of the proposed structure this should be adequate. A circular drive will allow access to the potable water storage and waste collection tanks as well as deliveries to the structure. 8 Roberts Community Meeting Facility Director Decision May 2, 2016 7-303. LANDSCAPING STANDARDS. The Applicant was granted a waiver from the Landscape Plan submittal requirements. The site will preserve the natural vegetation in the area of the facility and will continue with the irrigated agricultural operation on the remainder of the site. A Waiver from this standard is appropriate in order to maintain the agricultural appearance of the site. 7-304. LIGHTING STANDARDS. The application states that the facility will comply with this standard and a condition of approval is recommended to assure this standard. 7-305. SNOW STORAGE STANDARDS. The snow storage area appears to be sufficient. 7-306. TRAIL AND WALKWAY STANDARDS. The site plan includes walkways from the parking area to the proposed facility. These are sufficient for their purposes. VH. STAFF CONCERNS Staff has several concerns, most of which can be mitigated by the adoption of conditions of approval. 1. Wastewater Management — the proposal to have a vault and system may be appropriate for an intermittent seasonal use, however the provision of two restrooms to serve a potential 175-200 guests is insufficient. Based upon research staff has found that recommendations on the number of restroom facilities or porta- potties for special events is based upon the length of the event and the number of attendees. Based upon the chart below the current provision of 2 restrooms would be sufficient for events of less than 50 people, or events of 100 people for four hours, or vents lasting no longer than 2 hours for a maximum capacity of 250 people. SUGGESTED FINDINGS AND RECOMMENDATION Staff recommends a finding that the proposed Public Meeting Facility is in conformance with the Comprehensive Plan of 2030 as well as the Land Use and Development Code. Staff, therefore, recommends approval with conditions of the Roberts Public Meeting Facility. Suggested Findings 1. That proper public notice was provided as required for the Administrative Review Land Use Change Permit. 2. That with the granting of a waiver from Landscape Standards and compliance with conditions of approval the application is in general conformance with the 2030 Comprehensive Plan, as amended. 3. I still think this is all that is needed for the entrance to be sufficient for their proposed facility. Thanks for the opportunity to comment on this proposal. Wyatt I went out with Bruce Lewis, Katie Day and Mr. & Mrs. Roberts and looked at the entrance to the proposed wedding and events center that Mr. & Mrs. Roberts and Kaite Day have planned to build on their property at Harvey Gap Reservoir. There is an existing entrance already in place that will need to be updated with a new apron and a few trees cut for visibility. The site distance will be sufficient once the trees are cut. I did forget to mention to them that we will require a STOP sign at the entrance for people leaving their property. A driveway permit will need to be purchased from the Road and Bridge for $75.00, and it will outline everything that needs to be done to bring the current access up to current County standards, which I discussed with everyone present today on our onsite meeting. I see no need for any upgrades to the county road at this time. If there is anything else I need to do for this please let me know and I will be more than happy to answer any questions anyone may have in the future regarding this project. Wyatt From: Kathy A.
