Colorado, held in the Commissioners' Meeting Room, Garfield County Administration Building
in Glenwood Springs on Monday, the 8th day of August A.D. 2016, there were present:

A RESOLUTION OF APPROVAL FOR A CORRECTION TO A CERTIFICATE OF
DESIGNATION FOR THE SOUTH CANYON LANDFILL (CD -06-16-8470) OPERATED
BY THE CITY OF GLENWOOD SPRINGS, ON A 180 ACRE PORTION WITH A 40.9
ACRE FILL AREA OF A LARGER 2,518.87 ACRE PROPERTY OWNED BY THE
CITY OF GLENWOOD SPRINGS, LOCATED AT 1205 COUNTY ROAD 134 EAST OF
THE CITY OF GLENWOOD SPRINGS IN SECTION 11, TOWNSHIP 6 SOUTH,
RANGE 90 WEST OF THE 6TH PRINCIPAL MERIDIAN, GARFIELD COUNTY
PARCEL Nos. # 218303300088; 218311300020, 218309400002, and 218310200019
Recitals
A. The Board of County Commissioners of Garfield County, Colorado, "Board" received
a request for a correction to a Certificate of Designation (Application CD -06-16-8470) for the
South Canyon Landfill approved on December 15, 1997 and amended on March 9, 1999.
B. The South Canyon Landfill is located on an approximately 180 acre portion with a 40.9
acre fill area of a larger 2,518.87 acre parcel of land owned by the City of Glenwood Springs.
C. The subject property is located within unincorporated Garfield County in the Rural zone
district west of the City of Glenwood Springs off County Road 134.

D. C.R.S. §30-20-103 governs the review process, standards, and notification
requirements for a Certificate of Designation.
E. The Board is authorized to approve, deny or approve with conditions a Certificate of
Designation pursuant to the C.R.S. § 30-20-103.
F. The Board of County Commissioners opened a public hearing on the 8th day of August,
2016 for consideration of whether the proposed correction to the Certificate of Designation should
be granted or denied, during which hearing the public and interested persons were given the
opportunity to express their opinions regarding the request.
H. The Board of County Commissioners closed the public hearing on the 8th day of August,
2016 to make a final decision.
I. The Board on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following determinations of fact:
1. That proper public notice was provided as required for the hearing before the Board
of County Commissioners.
2. The hearing before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted and that all
interested parties were heard at that meeting.
3. That for the above stated and other reasons the proposed amendment to the approved
Certificate of Designation is in the best interest of the health, safety, convenience,
order, prosperity and welfare of the citizens of Garfield County.
4. That the application is in general conformance with the 2030 Comprehensive Plan,
as amended.
5. That the application is in general conformance with the Garfield County Land Use
and Development Code of 2013, as amended.
6. That the application has adequately met the requirements of C.R.S. § 30-20-103.

RESOLUTION
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
County, Colorado, that:
A. The forgoing Recitals are incorporated by this reference as part of the resolution.
B. The correction to the Certificate of Designation for the South Canyon Landfill is hereby
approved subject to compliance with the following conditions:
1. The legal description of the Certificate of Designation boundary as approved by the
Garfield County Board of County Commissioners on December 15, 1997 and amended
on March 9, 1999 shall be amended to the following description:
That portion of the SWI/4 SWI/4 in Section 2, lying southerly of the northerly line of
the Landfill access road
The SWI/4 SW1/4; the SEI/4 SW1/4; the SI/2 SW1/4SE1/4; the S12SE1/4 SE1/4; the
SW1/4NW1/4SE1/4, the NW1/4SW1/4SE1/4, the W12NE1/4SW1/4SE1/4, the
SEI/4NEI/4SW1/4, and the E12SW1/4NEI/4SW1/4 all in Section 3
N1/2NE1/4NW1/4,the N12NW1/4NEI/4,the N1/2NE1/4NE1/4 all in Section 10
That portion of the N12 NWl/4 NWl/4 in Section '11, lying southerly of the northerly
line of the Landfill access road and westerly of the westerly line of County Road 134,
T6S, R90 W of the Sixth Principal Meridian, Garfield County, Colorado. The above
described parcels of land total 180 acres, more or less.
