From: Scott Aibner — Garfield County Surveyor Subject: Plat Review Neiley / Maniscalchi Subdivision Exemption Plat Date: 4/9/2013 Jason, Upon review of the Neiley / Maniscalchi Subdivision Exemption Plat, I have no comments or corrections to be made prior to approval for survey content and form. Once all final comments from Community Development have been completed, the Mylar may be prepared for recording. The Mylar shall be delivered to the Community Development office with all private party signatures no later than Monday the week prior to the next commissioner meeting day in order to make that meeting. CO 81601 Office: 970-945-8212 Fax: 970-384-3470 Reference: Neiley/Maniscalchi Exemption Garfield County File Number MIEA7518 Dear Rick, Garfield County is in receipt of your application for a Road -split Exemption to create two parcels currently divided by County Road 154. Staff has previously provided you with a Public Notice form that is required to be sent, Certified Mail Return Receipt, to owners of all property within 200' of the subject site. This notice specifies a Director Decision date of April 12, 2013. If approved the end result will be to obtain the Board of County Commissioner signature on the Exemption Plat which will then be recorded. The Exemption Plat must satisfy the requirements of the Unified Land Use Resolution of 2008, as amended as well as state statutory requirements. Staff has reviewed the submitted plat for compliance with the ULUR and requires that the following changes be made: 1. Required certificates are located on the plat however the language in most, if not all, is not consistent with the requirements of the ULUR. Further, none of the Certificates are labeled with a title which must be added for clarity. Please revise the language of the following (exemption) certificates based on the attachment provided: a. Lienholder Consent; b. Title Certificate; c. Surveyor Certificate; d. Certificate of Dedication and Ownership; e. County Surveyor Certificate; f. County Commissioner's Certificate. 2. Please label the Notes and revise as follows: a. Remove notes 4, 5, 6, 7, and 8 (from the second set of notes on the plat) as these are not requirements related to this division of land. b. The County is unaware of Covenants associated with this land, is Note 1 applicable to this site and is the Title Commitment information correct? c. Please add the following standard Plat Notes required by the County: i. Control of noxious weeds is the responsibility of the property owner. ii. No open hearth solid -fuel fireplaces will be allowed anywhere within an exemption. One (1) new solid -fuel burning stove as defied by C.R.S. 25-7- 401, et. seq., and the regulations promulgated thereunder, will be allowed in any dwelling unit. All dwelling units will be allowed an unrestricted number of natural gas burning stoves and appliances. iii Addresses are to be posted where the driveway intersects the County road. If a shared driveway is used, the address for each home should be posted to clearly identify each address. Letters are to be a minimum of 4 inches in height, % inch in width and contracts with background color. iv. Combustible materials should be thinned from around structures so as to provide a defensible space in the event of a wild land fire; and v. If necessary, "The mineral rights associated with this property will not be transferred with the surface estate therefore allowing the potentia! for natural resource extraction on the property by the mineral estate owner(s) or lessee(s). " d. The proposed plat note regarding the provision of water for Lot 2 is required to be on plat. Please work with the Attorney's Office to confirm the necessary language. We are currently awaiting comments from the County Attorney's Office and the County Surveyor. Once those comments are received and possible amendments made to the plat, please provide a revised blue -line for review prior to obtaining a mylar.
