Cerise Gravel Mine (MIPA 6545)

I. GENERAL PROJECT DESCRIPTION
Request
The Applicant's representative requests another one year extension to complete the
conditions of approval as documented in Resolution 2011-44. This time extension is
needed to complete the conditions of approval.
Project Background
The Board of County Commissioners (BOCC) approved this application on July 5, 2011
with conditions of approval. On June 18, 2012, the BOCC reviewed and approved a one
year time extension for the Applicant in order to complete the conditions of approval.
II. SITE DESCRIPTION
The Cerise Mine is located approximately two miles directly northeast of Carbondale,
Colorado, north of SH 82, and east and adjacent to CR 103.
III. REVIEW STANDARDS AND STAFF COMMENTS
The Board has the authority under Section 4-103 of the Unified Land Use Resolution of
2008, as amended (ULUR) to grant time extension requests. This section of the ULUR is
as follows:
Section 4-101 (I)(3). Requests for longer periods of time, or additional time extensions
following the first extension, shall be made to the BOCC prior to the expiration of the
current approval.
IV. STAFF RECOMMENDATION
Staff recommends the Board of County Commissioners approve the request from
Applicant for a time extension of one year for the Cerise Gravel Mine located on a 65.48
acre site located at the northeast corner of SH 82 and CR 103.
V. RECOMMENDED FINDINGS
1. Proper notice was provided as required for the meeting before the Board of County
Commissioners.
2. The meeting before the Board of County Commissioners was extensive and complete,
that all pertinent facts, matters and issues were submitted and that all interested parties
were heard at that meeting.
The above stated and other reasons, the Applicant has demonstrated that the one year
time extension to complete the conditions of approval plan is necessary because
original conditions of approval cannot be met within the existing timeframe.
