II. AUTHORITY - APPLICABLE REGULATIONS The Amended Final Plat Application is being processed in accordance with Section 5-305, Amended Final Plat and 4-103, Administrative Review of the Land Use and Development Code, as amended. Public notice is required in accordance with Sections 4-103 and4-101 and the Applicant has provided documentation that all required public notice has been completed. Review Criteria An application for an Amended Final Plat shall meet the following criteria: 1. Does not increase the number of lots; and 2. ' Does not result in a major relocation of a road or add any new roads; or 3. Willcorrect technical errors such as surueying or drafting errors. III. STAFF ANALYSIS 1. The Application was referred to the County Road and Bridge Department (see comments attached). The Road and Bridge Department response indicated that the drainage from the lots needs to be incorporated into the main drainage system for Travelers Highlands. 2. The Application was also referred to the County Surueyor, Scott Aibner and he indicated that he had no comments or corrections prior to approval for survey content and form. 3. The Application was also referred to the Garfield CountyAdministration Depaftmentas the contact for the Travelers Highland Public lmprovements District (PlD). Subsequently the information was provided to the Gar{ield County Road and Bridge Department and an update has been scheduled for the Travelers Highland PID Boardbf Directors which is the Board of County Commissioners. That update is scheduled for Monday, May 18th. 4. Verbalcomments were received from two adjacent propefty owners but no written comments submitted. Verbal inquires including verification of the location of the proposal, discussion of how water and sanitation was being addressed, whether any moratoriums on development were in place, and general support for changes to the overall plan to eliminate the many small lots. 5. Staff contacted the Garfield County Chief Building Official and Community 2 Development Director and confirmed that no moratoriums exist at this time regarding issuance of building permits within the Travelers Highlands Subdivision. 6. The draft amended plat and all plat certificates shall be subject to final review and approval by the County Attorney's Office and the County Surueyor. Any required changes or edits shall be made to the plat prior to submittal to the County for exetution. Corrections to the title of the plat will be required as part of the finar review. 7. The following plat notes should be included on the amended plat. Final wording for the plat notes shall be subject to approval by the County Attorney's Office. a. An explanation for the purpose of the plat amendment limited to combination of lots.b' lndicating that all plat notes and provisions of the existing subdivision plat recorded at Reception No. 218477 shall remain in effect except as amended on the proposed plat. 8 The Applicant has initiated their building permit review process and said review has included referrals tothe Grand Valley Fire Protection District. Their comments will be part of the building permit review process and approvals. IV. SUGGESTED FINDINGS AND RECOMMENDATION Staff supports a finding that the Amended Final Plat Application for Lots 6 - 19 Block 10 of the Travelers Highlands Subdivision meets the requirements and standards of the Garfield County Land Use and Development Code as amended including the Review Criteria contained in Section 5-305 (C) and is recommended for Administrative Approval by the Director of the Community Development Department subject to the following'conditiohs of approval. ] That all representations of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein. 2. The amended plat shall be subject to final review and approval by the County Attorney's Office with edits to include but not limited to corrections io the title, a Certificate of Taxes Paid, a Title Certificate, a Lien Holders Certificate if appropriate, and revisions to the Ceftificate of Ownership. All requirements from the County Surveyorshallbe met prior to submittal of the plat for final execution. 3. The Plat shall include the following plat notes with the final wording of the notes subject to review and approval by the county Attorney's office. The purpose of the amended plat is for the combination of lots as shown hereon. No other changes are proposed. a. 3 b 4 All plat notes and provisions of the existing subdivision plat recorded at Reception No. 218477 shall remain in effect except as specifically modified by this amended plat. The building permit review process for development on the combined lot shall address site drainage and demonstrate consistencywith the main drainage system for the subdivision.
