RE: Special Use Permit Application
Lots 26 & 27, Block 6, Rifle Village South Subdivision
Dear Tony:
Thank you for your prompt attention to my letter of I April, 1997. I have since discussed with the
County Attorney the situation in Rifle Village Sout[ our regulations, and your intent to develop a
duplex on lots 26 and27.
The Connty Attorney has dernonstrated that the R/L/IJD zone district and County regulations do not
have provisions for a zero-lot-line setback, which means that the duplor cannot be dweloped as
proposed. The proposal for a duplex on the subjea lots would result in the common property line
aaing as the "side yard" between the two lots. The underlying zoning requires a minimum l0 foot
setback from the side lot ling for each lot, requiring an oflset distance of 20 feet In his opinion, the
final plat for the Subdivision would require to be amended, erasing the common lot line, prior to
approval of a building permit application.
Once the lot line is erased and the constnrcted, the structure could not be sold as
ine that the duolex could be owned bv- one
