I have since discussed with the County Attorney the situation in Rifle Village Sout[ our regulations, and your intent to develop a duplex on lots 26 and27. The Connty Attorney has dernonstrated that the R/L/IJD zone district and County regulations do not have provisions for a zero-lot-line setback, which means that the duplor cannot be dweloped as proposed. The proposal for a duplex on the subjea lots would result in the common property line aaing as the "side yard" between the two lots. The underlying zoning requires a minimum l0 foot setback from the side lot ling for each lot, requiring an oflset distance of 20 feet In his opinion, the final plat for the Subdivision would require to be amended, erasing the common lot line, prior to approval of a building permit application. We have disanssed items 1 and1, itenr 3 would require a preliminary survey, performed by a licensed surveyor, that shows the contemplated erasure of the corrmon line between the subject lots. You may combine all elements into one application under one fee; howwer, if you choose to do this, the application must contain the various elements before it can be scheduled for a public hearing before the Board of County Commissioners. The conditions that shall govern the approval and development of the lot are as follow: 1. That all representations by the applicant made before the Board of County Commissioners shall be conditions of approval, unless otherwise stated. 2. That the minimurn, finished floor elevation of the rwo-family dwelling shall be no less than 5328.6 feet. 3. The foundation shall be cast-in-place reinforced concrete footers and stem walls and all foundation designs shall be based upon the site specific geotechnical soil and foundation investigations performed by Hepworth-Pawlak. Additionally, the engineered foundation design shall clearly state the fotrndation has been designed to withstand the hydrodynamic and hydrostatic forces associated with water moving at up to four (a) feet per second. 4. The surface drainagl around the perimeter of the structure shall comply with the recommendations contained within the Hepworth-Pawlak Geotechnical repon, dated VIarch 10, 1997. 5. All foundation construction shall comply with the 1994 Uniform Building Code, as adopted by Garfield County. 6. Prior to the approval of a final/cenificate of occupancy for the residence, the properry owner shall strbmit an elevation ceftificate, signed and stamped by a licensed land surveyor, for the finished floor elevation of the single family dwelling unit. 7. The conditions are as follows: That all representations of the applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval; That the amended final plat shall be signed and dated by the Cotrnty Surveyor, then signed and dated by the Chairman of the Board and recorded within the Clerk and Recorder's Office of Garfield County within ninety (90) days; That the following plat notes shall be included on the final plat: The minimum defensible space distance for stnrctues shall be ttrirty (30) feet on level terrairu plus appropriate modification to recognize the increased rate of fire spread at sloped sites. A duplex sEucture can not be sold as separate interests. The duplex can only be owned by one entity. Leasehold-interest in one or both units is allowed. A resolution containing the conditions will be written by this office, signed by the Board of County Commissioners, and recorded in the Clerk & Recorder's office. A resolution for the Special Use Permit will be processed in the same manner. A special use permit will be issue4 in the sarne mailter, as well.
