(1973) Section 30-28-'l0l (10) (a) - (d) as arnnded, and the Subdivision Regulaliions of Garfietd County, Co]orado, adopted September 1,lg72 and amended April 14, 1975, Sections 1.02.17 (d) and 3.02.01, for the division of a portion of ground to create a 2.029 acre tract of land, and more particularly described as follows: A tract of land situate in Lots I and 7 of Section 3, Township 8 South, Range BB hlest of the 6th P.M. being more particularly described as follows: Beginning at a point whence the Witness Corner to the North t corner of said Section 3 bears N. 670 03'21u ld. 1957.86 feet with all bearings contained herein relative to a bearing of N. 890 57' t,{. on the centerline of Main Street in the Town of Carbondale, Colorado; thence N. 610 30' 16" E. 27.75 feet to the centerline of a road as built and in place; thence along said road centerline the following courses:s. 2Bo 29'. 44" E. 141.99 feet; thence 179.57 feet along the arc of a 550 foot radius curve the left, which arc subtends a chord bearing S. 370 50' 56" . E. 178.78 feet; thence S. 47o i2'-09" E. 92.70 feet; thence 166.97 feet a'long the arc of a 1'199.08 foot radius curve to the right, which arc subtends a chord bearing S. 43o 12' 48" E. 166.83 feet; thence leaving said road centerline on a course^bearing S. 43o 20' 17" l'l. 345.00 feet; thence N. 00u 13' E. 60.00-feet; thence N. 00o 40' l,{. 265.24 feet; thence N. 55o 34' t,l. 124.66 feet; thence N. 0Bo 06' l,J. 295.45 feet to the point of beginning, containing 2.A29 acres, more or less. Subject to a right-of-way easement for a road as built and in place along the entire northeasterly" boundary line of the above described parcel. WHEREAS, the Petitioners have shown to the satisfaction of the Board that the exemption is desired for the purposes of construction of a church; and, WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board that there is a reasonable probability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of.HeaIth, that the requested division is in accordance with the general purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield and should, therefore, bB exempted from the definition of the tenm "subdivision" and "subdivided land" as set forth in C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended; NOt{ THEREF0RE, upon motion of F/ayen (ler't. - seconded by brn.t Vl-laoaX> and carried, said tract of land is hereby exempted for the purposes of construction of a church.
