PETITION FOR EXEMPTION
Pursusant to C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as
amended, and the Subdivision Regulations of Garfield County, Colorado,
adopted April 23, 1984 Section 2:20.49, the undersigned
Richard Hendrick
respectfully petitions the Board
of County Commissioners of Garfield County, Colorado, to exempt by
Resolution the division of 37.77 acre tract of land into_ 2 tracts of
approximately 2.6 & 35.1 acres eochc, more or less, from the definitions of
"subdivision" and subdivided land" as the terms are used and defined in
C.R.S. (1973) Section 30-28-101 (10) (a) - (d) and the Garfield County
Subdivision Regulations for the reasons stated below:

SUBMITTAL REQUIREMENTS:
An application which satisfies the review criteria must be submitted with
all the following information.
A. Sketch .map at a minimum scale of 1"=200' showing the legal
description of the property, dimension and area of all lots or
separate interests to be created, access to a public
right-of-way, and any proposed easements for drainage,
irrigation, access or utilities;
B. Vicinity map at a minimum scale of 1"-2000' showing the general
topographic and geographic relation of the proposed exemption to
the surrounding area within two (2) miles, for which a copy of
U.S.G.S. quadrangle map may be used.
C. Copy of the deed showing ownership by the applicant, or a :letter
from the property owner(s) if other than the applicant; and
D. Names and addresses of owners of record of land immediately
adjoining anal within 200 feet of the proposed exemption, mineral
owners and lessees of mineral owners of record of the property to
be exempted, and tenants of any structure proposed for
conversion; and
E. Evidence of the soil types and characteristics of each type; and
F.. Proof of legal and adequate source of domestic water for each lot
created, method of sewage disposal, and letter of approval of
fire protection plan from appropriate fire district; and
G. If connection to a community or municipal water or sewer system
is proposed, a letter from the governing body stating a
willingness to serve; and
H. Narrative explaining why exemption is being requested; and
I. It shall be demonstrated that the parcel existed as described on
January 1, 1973 or the parcel as it exists presently is one of
not more than three parcels created from a larger parcel as it
existed on January 1, 1973.

RE: Hendrick Subdivision Exemption
Dear Mark:
Attached, herewith, please find the appropriate supplemental information and
application form for a subdivision exemption for a 37.778 acre parcel of land
owned by the Hendrick family. The parcel is located adjacent to the City
Limits of the Town of Carbondale. The property is bounded on the north by the
Crystal Village PUD; on the east by Hwy. 133; on the west by the proposed
Crystal Acres Subdivision; and, on the south by the Crystal River and Gray
Ranch PUD. Richard Hendrick has Power of Attorney to act as the legal
representative of the Hendrick family members in regard to this property.
The subdivision exemption requests the creation of a 2.6 acre parcel of land,
leaving a 35.1 acre tract. The 2.6 acre parcel is located in the northwest
portion of the property and includes an existing single-family residence. Two
occupied residences are located on the remaining large tract. All three
residences apparently were in existance prior to 1970. According to the
family members, 2 parcels have been created from the original Hendrick tract
that existed in January of 1973. One pacel was sold to Sego Services and
became part of the Crystal Village PUD. Another tract was more recently sold
and is now occupied by the senior housing project. This would leave the
opportunity for the creation of 2 parcels from the remaining land in
accordance with the Garfield County Subdivision exemption criteria.
The existing residences are accessed by easement from Hendrick Drive, a Town
of Carbondale public street. The large tract also has frontage on Hendrick
Road and Hwy 133. The residence on the 2.6 acre parcel and one of the other
residences is served by Town of Carbondale domestic water. The other
residence is on a private well. All three have a septic tank and leachfield
for wastewater treatment.

As is evidenced by the adjacent subdivisions and the attached SCS Soil
Descriptions, the property is well adapted for single-family home sites. The
southwesterly edge of the larger tract is affected by the Crystal River flood
plain.
Sale of the 2.6 acre parcel may be used to investigate other land use options
on the larger tract of land including possible annexation to the Town of
Carbondale.

SOIL CONSERVATION SERVICE SOILS DESCRIPTIONS
The entire site is mapped as X11C - Atencio-Azeltine complex except for a very
narrow sliver along the edge of the Crystal River which is outside any
developable area of the site.

13--Atencio-Azeltine complex, 3 to 6 percent slopes. This map unit
is on alluvial fans and terraces. The native vegetation is mainly grasses
and shrubs. Elevation is 5,900 to 6,500 feet. The average annual
precipitation is 15 to 18 inches, the average annual air temperature is 44
to 46 degrees F, and the average frost -free period is 105 to 120 days.
This unit is 60 percent Atencio sandy loam and 30 percent Azeltine
gravelly sandy loam. The components of this unit are so intricately
intermingled that it was not practical to map them separately at the scale
used.
Included in this unit are small areas of soils that are similar to the
Atencio and Azeltine but have finer texture. Also included are small areas
of gravel bars. Included areas make up about 10 percent of the total
acreage.
The Atencio soil is deep and well drained. It formed in alluvium
derived dominantly from sandstone and shale. Typically, the surface layer
is reddish gray sandy loam 6 inches thick. The next layer is sandy loam 4
inches thick. The subsoil is sandy clay loam 10 inches thick over gravelly
sandy loam 4 inches thick. The upper 6 inches of the substratum is gravelly
sandy loam. The lower part to a depth of 60 inches is very gravelly sand.
The soil is noncalcareous to a depth of 20 inches and calcareous below that
depth. In some areas the surface layer is gravelly or cobbly.
Permeability of the Atencio soil is moderate to a depth of 30 inches
and rapid below this depth. Available water capacity is low. Effective
rooting depth is 60 inches or more. Runoff is slow, and the hazard of water
erosion is slight.

The Azeltine soil is deep and well drained. It formed in alluvium
derived dominantly from sandstone and shale. Typically, the surface layer
is reddish gray gravelly sandy loam 9 inches thick. The upper 7 inches of
the underlying material is gravelly loam. The lower part to a depth of 60
inches is extremely gravelly sand. The soil is calcareous throughout the
profile. In some areas the surface layer is cobbly loam or sandy loam.

Permeability of the Azeltine soil is rapid,1below a depth.of 16 inches.
Available water capacity is low. Effective rooting depth is 60 inches or
more. Runoff is slow, and the hazard of water erosion is slight..
This unit is used mainly for irrigated hay and pasture. It is also
used for cropland, urban development, wildlife habitat, and rangeland.
If this unit is used for hay and pasture, the main limitations are low
available water capacity and small stones. Grasses and legumes grow well if
adequate fertilizer is used. Using management that maintains optimum vigor
and quality of forage plants is a good practice. Because these soils are
droughty, applications of irrigation water should be light and frequent.
Irrigation water can be applied by the corrugation, sprinkler, and flooding
methods. If properly managed, this unit can produce.4 tons of irrigated
grass hay per acre..
This unit is moderately well suited to irrigated crops. If furrow or
corrugation irrigation systems are used, runs should be on the contour or
across the slope. If properly managed, this unit can produce 70 bushels of
barley per acre.

The potential ant community on this unit is mainly western
wheatgrass, Indian ricegrass, needleandthread, big sagebrush, and Douglas
rabbitbrush. Nevada bluegrass, prairie junegrass, and bottlebrush
squirreltail are also present in the potential plant community. The average
annual production of air—dry vegetation is about 800 pounds per acre.
Management practices suitable for use on this unit are proper grazing use
and a planned grazing system.
If the range vegetation is seriously deteriorated, seeding is needed.
The main limitations for seeding are cobbles and stones. For successful
seeding, prepare a seedbed and drill the seed. Brush management improves
deteriorated areas of range that are producing more woody shrubs than were
present in the potential plant community.
If this unit is used for homesite development, the main limitation is
small stones. Population growth has resulted in increased construction of
homes on this unit. Topsoil can be stockpiled and used to reclaim areas
disturbed during construction. Removal of gravel and cobbles in disturbed
areas is needed for best results when landscaping, particularly in areas
used for lawns. If the density of housing is moderate to high, community
sewage systems are needed to prevent contamination of water supplies as a
result of seepage from onsite sewage disposal systems.
The map unit is in capability subclass IVe, irrigated, and VIe,
nonirrigated. It is in Rolling Loam range site.

Dear Andrew: .
The Town of Carbondale would like to thank you for referring the
Sopris R.V. Park F.U.D. amendment and the Hendrick lot split to
the Town for comment. The Carbondale Planning and Zoning
Cammis_sion reviewed these projects at. their July 1st meeting,
Their comments are provided below.
By a vote of 4 to 0, the Carbondale P & Z recommends that the
County look favorably on the proposed amendment with the
following conditions:
]) that new development and improvements be in conformance
with proposed Division of Wildlife guidelines. This
includes the 20 foot vertical buffer from the high water
mark to any proposed development.
2) that public fishing access be established.
3) that the other parcel (R.V. park) be operated in
compliance with all existing P.U.D. agreements and zoning
regulations.
In regard to Condition #3 above, it appears that some R.V.'s have
been staying on the property for significantly longer than eight
months. There are framed in decks, additions, etc., which do not
seem in keeping with the relatively short term nature of an R.V.
park. The open space parcel presently needs some additional
cleanup.work, such as removal of a number of 55 -gallon drums and
culvert pipe which are located at, the west end of the project.
Ry a vote of 4 to 0, the Carbondale Planning and Zoning
Commj_ssion recommends that Garfield County give favorable
'consideration to the Hendrick lot split with the condition that
aperf-,Driate limitations be considered for the access easement.

In regard to the above noted easement, Town Staff has seen
.=-conflicting information whether this is actually an access
easement or a right-of-way. Its location and angle of
'intersection to Hendrick Road would make for safety problems if
":the intent was to use this access easement for more than a few
'-single family homes or similar types of uses. Tt would be best
`if the situation was clarified at this time.
Once again, Carbondale thanks Garfield County for giving us the
`opportunity -to review projects which may affect the Town. Please

We have received the above referenced proposal for a subdivision exemption to split a 37.77
acre parcel into two parcels, one 2.6 acre tract and one 35.1 acre tract. Both tracts have existing
residences. The 2.6 acre tract is served water by the Town of Carbondale and the 35.1 acre tract
is served by a private well.
This office can recommend approval of the exemption given the following condition:
The 2.6 acre tract will be served water from the Town of Carbondale. Issuance of a well
permit for this lot, if requested, will be contingent upon a review of the previous subdividing
after 1972 of the original Hendrick tract.
We strongly suggest that the existing well on the 35.1 acre tract be registered with this office.
A preliminary review of our records indicates that there is no permit number for this structure.

A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD
COUNTY SUBDIVISION REGULATIONS FOR THOMAS HENDRICKS.
WHEREAS, Thomas Hendricks has petitioned the Board of County
Commissioners of Garfield County, Colorado, for an exemption from the
definition of the terms "subdivision" and "subdivided land" under C.R.S.
1973, 30-28-101 (10) (a) -(d), as amended, and the Subdivision
Regulations of Garfield County, Colorado, adopted April 23, 1984,
Section 8:00 through 8:60 and for the division of a 37.7 acre tract as
described in Book 700, Page 724, as filed in the Office of the Clerk and
Recorder of Garfield County, Colorado, into two parcels of approximately
3.43 acres and 34.348 acres each, more or less, which proposed divided
tracts are more practically described as follows:
