I. RELATIONSHIP TO THE COMPREHENSIVE PLAN
The subject property is located in District A - Carbondale
Urban Area of Influence as designated on the Garfield County
Comprehensive Plan Management and Districts Map.
II. DESCRIPTION OF THE PROPOSAL
A. Site Description: The subject property is located south
of Crystal Village Subdivision on the west side of
Highway 133. The property is a portion of a County
island and is surrounded by properties within the
incorporated limits on all sides but one. The majority
of the property is flat pasture land. The Crystal River
forms the southwest property line. There are currently
three (3) residences on the subject property.
B. Project Description: The applicants are requesting an
exemption from the definition of subdivision to split the
38 parent parcel into a 4.0 and a 34 acre parcel. The 4
acre parcel would contain one residence with 2 residences
on the large parcel. No new development is being
proposed.
C. Background: The subject property was originally a
portion of a substantially larger parcel. The northern
portion of the property was merged with the adjacent
parcel and eventually subdivided as a portion of Crystal
Village. Another parcel was separated in 1985 and
annexed into the town. This parcel, housing the
Carbondale Senior Center, was subsequently split in 1988.

III. MAJOR ISSUES AND CONCERNS
A. Based on the applicant's representations and staff
review, it appears that the parcel would qualify for the
proposed exemption. No further exemptions would be
allowed in the future. Any future development should
occur after annexation into the Town of Carbondale.
B. Access to both parcels is obtained via an access easement
which extends westward to the property from Hendrick
Drive. This easement directly abuts the smaller parcel.
Access to the larger parcel is obtained via a north -south
easement which crosses the Senior Center parcel.
C. Domestic water to two of the three residences is provided
by taps from the Town of Carbondale. The third
residence, located on the larger parcel, is served by a
well. The Division of Water Resources has reviewed the
application and has no objections to the proposed
division.
D. Each residence is served by an I.S.D.S. system. Staff is
unaware of problems relative to any of these systems.
E. The Town of Carbondale Planning Commission reviewed the
proposal at their July 1, 1991 meeting (see enclosed
letter on page 15 ).
IV. SUGGESTED FINDINGS
A. That proper posting and public notice was provided as
required for the meeting before the Board of County
Commissioners.
B. That the meeting before the Board of County Commissioners
was extensive and complete, that all pertinent facts,
matters and issues were submitted and that all interested
parties were heard at that meeting.
C. That for the above stated and other reasons, the proposed
exemption is in the best interest of the health, safety,
morals, convenience, order, prosperity and welfare of the
citizens of Garfield County.
V. RECOMMENDATION
APPROVAL, subject to the following conditions:
1. That all representations of the applicant, either within
the application or stated at the meeting before the Board
of County Commissioners, shall be considered conditions
of approval.
2. That the applicant shall have 120 days to present a plat
to the Commissioners for signature. Extensions of time
may be granted if requested prior to the expiration date.
3. That the following plat note be included on the Exemption
Plat:
No further exemptions from the definition of
subdivision shall occur on the subject property.
4. Adequate easements for waterlines, as required -by the
Town of Carbondale, shall be identified on the Exemption
Plat.

Dear Andrew:
The Town of Carbondale would like to thank you for referring the
Sopris R.V. Park P.U.D. amendment and the Hendrick lot split to
the .Town for comment. The Carbondale Planning and Zoning
Commission reviewed these projects at. their July 1st meeting.
Their comments are provided below.
•13y a vote of 4 to 0, the Carbondale P & Z recommends that the
County look favorably on the proposed amendment with the
following conditions:
]) that new development and improvements be in conformance
with proposed Division of Wildlife guidelines. This
includes the 2(Yfoot vertical buffer from the high water
mark to any proposed development.
2) that public fishing access be established.
3) that the other parcels (R.V. park) be operated in
compliance with all existing P.U.D. agreements and zoning
regulations.
In regard to Condition #3 above, it appears that some R.V.'s have
been staying on the property for significantly longer than eight
months. There are framed in decks, additions, etc., which do not
seem in keeping with the relatively short term nature of an R.V.
park. The open space parcel presently needs some additional
cleanup•work, such as removal of a number of vv -gallon drums and
culvert pipe which are located at, the west end of the project.
By a vote of 4 to 0, the Carbondale Planning and Zoning
Commission recommends that Garfield•County give favorable
'consideration to the Hendrick lot split with the condition that
apprrpriate limitations be considered for the access easement.

•ln regard to the above noted easement, Town Staff has seen
canflicting information whether this is actually an access
easement or a right-of-way. Its location and angle of
intersection to Hendrick Road would nuke for safety problems if
"'the intent was to use this access easement for more than a few
'single family homes or similar types of uses. It would be best
"if the situation was clarified at this time.
