Individual wells are proposed as the water supply; however, these proposed wells would obtain ground water tributary to Rlfle Creek which ls over-appropriated. Therefore, this office cannot lssue per- mits for these wells wlthout an approved plan for augmentation. As an alternate, the owner proposes to serve the three lots from hls exlstlng well. Whlle this may be posslble, we need addltlonal informatlon concerning the well in order to determine if an adequate water supply exlsts. Since we have no record of a well reglstered ln Mr. Heuser's name, we request that a copy of the permit together with informatlon concernlng the yield and long term dependability of the souroe be submltted. The well located on the property (reglstratlon no. 2S635) ts reglstered for domestic use and can legally serve the three proposed lots and allow for a total of one acre of lawn or garden irrigatlon. It appears that physlcally the weII can supply three units. Slne the developer intends to serve all three lots from the slngle well, we strongly suggest that the County requlre some form of legal agreement between all parties concerning the ownershlp, operatlon and maintenan@ responsibllities for thls well. The newly created parcel will be for a spouse, son, daughter, or spouse of a deceased child. 2. The subdivided parcel is split by a public right-of-way (State or Federal' Highway, County Road or Railroad) or natural feature preventing ioint use of proposed tracts and the division occurs'along that public right-of-way or natural feature. 3. The newly created tract will be owned by a public entity or wiII be used soley for the purpose of providing access to existing parcels, resulting in the creation of no additional tracts. 4. The conveyance is for the purpose of adjusting property Iines, and the conveyed tracts becone part of existing tracts, there being no new parcel created. 5. The proposed tracts were created and separately identified prior to thelst day of September, I973, or were created and separately identified through the exemption process prior to the effective date of this resolution. 6. The property being subdivided has been under the same ornership for at least five (5) years, and the division together with any earlier permitted under circunstances not defined above, wiil create no npre than tiree (3) new tracts under 35.0 acres in size. All new parcels created must meet all requirements of the applicable zone district. Procedures:....,,....,....,..','....'..,.......-,,' l. Applicant will obtain a copy of the petition for exemption from the Planning 0ffice 2. The completed petition for exemption will be returned with the required information as outlined on the application. 3. Upon review and determination that the application is complete, a neeting with the Board of County Conmissioners will be set by the Planning Office. 4. If approved by the Board, d legal description of each new tract created will be furnished to the Planning Departnpnt within 120 days. A resolutionwill be prepared and signed by the Chairnnn of the Board granting the exemption The following information will be submitted along with the petition for exemption: l. Map drawn to scale showing pnoposed lot subdivision and access. 2. Copy of deed and letter from property owner, if other than petitioner. 3. Vicinity map (Copy of USGS quadrangle map showing property location or equi val ent . ) 4. Statenent on source of donrestic water to each tract. (Individual welI, community well, spring, cistern, municipal system, etc.)* 5. Staterent on nethod of sewage disposal. '(Individua'l system or conrnunity system)* 6. 100 year floodplain information where Iive stream crosses or adioins the proposed subdivided land. 7. Evidence of the soil types and characteristics of each type. (Soit conservation analysis ) *If corrnunity or municipal system will provide service, then letter from the governing body stating the wi'llingness to serve wiII be provided. Fee: $50.00 plus $1.00 per acre for each parcel created under 35 acres in size. Checks will be made payable to "Garfield County Treasurer."
