Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) -(d) as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted September 1,
1972 and amended April 14, 1975, Section 1.02.17 (d) and 3.02.01 the undersigned

petitions the Board of County Commissioners of Garfield County, Colorado, to
exempt by resolution the division of acre tract of land into

*CONDITIONS:
1. All installation must comply with all requirements of the County Individual Sewage Disposal Regulations, adopted pursuant to au-
thority granted in 66-44-4, CRS 1963, amended 66-3-14, CRS 1963.
2. This permit is valid only for connection to structures which have fully complied with County Zoning and building requirements. -
Connection to or use with any dwelling or structures not approved by the building and Zoning office shall automatically be a viola-
tion of a requirement of the permit and cause for both legal action and revocation of the permit.
3. Section III, 3.24 requires any person who constructs, alters, or installs an individual sewage disposal system in a manner which in-
volves a knowing and material variation from the terms or specifications contained in the application of permit commits a Class 1,,
Petty Offense (5500.00 fine — 6 months in jail or both.

WHEREAS, DANNY and KAREN PRALL have petitioned the Board of County
Commissioners of Garfield County, Colorado, for an exemption under C.R.S. (1973)
Section 30-28-101 (10) (a) - (d) as amended, and the Subdivision Regulations
of Garfield County, Colorado, adopted September 1, 1972 and amended April 14,
1975, Sections 1.02.17 (d) and 3.02.01, for the division of a 16 acre tract of
land into two parcels of 9.32 acres and 6.68 acres, more or less, and said 16
acre tract is more particularly described as follows:

WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board
of County Commissioners of Garfield County, Colorado, that they desire said
exemption for the purpose of re -sale into single-family residential acreage; and,
WHEREAS, the Board of County Commissioners recognizes the extreme physical
problems to development posed by the extremely high groundwater table on said
16 acre tract, and the pollution potential which exists with the Petitioners'
individual sewage disposal system; and,
WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board
that there is a reasonable probability of locating domestic water on each of
said tracts, that there is adequate ingress and egress to said tracts, that the
location of individual sewage disposal systems will be permitted by the Colorado
Department of Health, that the requested division is in accordance with the
general purposes and intent of the Subdivision Regulations of the State of
Colorado and the County of Garfield and should, therefore, be exempted from the
definition of the terms "subdivision" and "subdivided land" as set forth in
C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended;
NOW THEREFORE, upon motion of .P'ave,Ar.-, p seconded by

exempted from such definition and transfer of said tract may be made by division
into two tracts of 9.32 acres and 6.68 acres, more or less, and further that
said exemption is conditioned upon the Petitioners constructing an individual

sewage disposal system to serve his existing residence which meets the requirement
of the Garfield County Zoning Regulations and the Garfield County and Colorado
State Regulations pertaining to individual sewage disposal and construction
on said individual sewage disposal system be completed no later than February 1,
1978 and further that said exemption is conditioned upon the Petitioners preparing
an adequate legal description of parcels prior to conveyance of said tracts.
A copy of the instrument (s) of conveyance when recorded shall be filed with
this Resolution.

Re: Henke and Prall Exemptions
We have reviewed the material submitted for the above referenced
applications for exemption. The developers propose to use wells for the
water supply which would intercept ground water tributary to the Roaring
Fork River at a point where there is still water available for appropriation.
This office can issue individual domestic well permits to individual lot
purchasers and we recommend approval of the Henke and Prall Exemptions.

Principal Meridian, in the County of Garfield, State of
Colorado. Said parcel being more particularly described
as follows:
Commencing at an iron post with brass cap properly marked
for the Southeast corner of Section 33 of said Township
and Range; thence N.66°56'42"W. 7923.01 feet; thence N.82°
38'00"W. 848.84 feet; thence S.01°58'45"W. 331.10 feet to
the True Point of Beginning; thence .79°44'24"E. 265.07
feet; thence S.02°14'30"W. 991.26 feet; thence N.82°38'00"W.
258.90 feet; thence N.01°58'45"E. 1005.11 feet to the
True Point of Beginning.
The above described parcel of land contains 5.96 acres,
more or less.
The above described parcel of land is together with a 30.00
foot road easement as described in Book 501 Page 215 as
recorded in the Garfield County Clerk and Recorder's Office,
and a 30.00 foot access easement being 15.00 feet on
each side of and parallel with the following described
centerline:
Commencing at said Southeast Corner of Section 33; thence
N.69°33'53"W. 8423.56 feet to the True Point of Beginning;
thence along said centerline S.02°14'30"W.104.97 feet to
a point on the Southerly line of said Parcel C the Point
of Terminus.
