when the following proceedings, among others vrere had and done, to-wit:
RESOLUTTON NO. 87-83
A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD COUNTYSUBDIVISION REGULATIONS FOR ROBERT AND DOROTHY PRETTI.
WHEREAS, Robert and Dorothy Prett,i have petitioned the Board ofCounty commissioners of Garfield County, colorado, for an exemption fromthe definition of the terms isubdivisionn and ;subdivided fanO' underc.R.9. 1973, 30-28-101 (10) (a)-(d), as amended, and the SubdivisionRegulations of Garfield county, colorado, adopted April 23, I9g4, Section8:00 through 8:60 and for the division of a 2aa.9 acre tract as describedin Book 507 , Page 27L, as filed in the office of the Clerk and Recorder ofGarfield county, Colorado into four parcels of approximately 5.10, 4.02,3.96, and 253.2 acres each, more or Iess, which lroposed divided tractsare more practically described as follows:

(in the state of colorado and the county of Garfierd); and
WHEREAS, the Petitioners have demonstrated to the satisfaction of theBoard of County Commissioners of Garfield County, Colorado, that theproposed division does not fall within the purposes-of part 1, Article 2g,Title 30, colorado Revised Statutes 1973, l" imended, for th; reason thatthe division does not warrant further subdivision review, and
WHEREAST the Petitioners have demonstrated to the satisfaction of theBoard of county Commissioners of Garfield County, Colorado, that, there isa reasonable probability of locating domestic water on each of saidparcels, that there is existing ingress and egress to said parcels, thatthe location of septic tanks _wi]1 be permitted by the Colora-clo Departmentof Health, that the requested division is not part of an exiiting orIarger development and does not falI within tha general purposes andintent of the subdivision regulations of the St,ate of Colorado and theCounty of Garfie1d, and should, therefore, be exempted from the definitionof the terms isubdivision" and "subdivided landi as set forth in c.R.s.1973, 30-28-10I (10) (a)-(d), as amendedi
NOW THEREFORE, BE IT RESOLVED that the division of the above describedparcels 'A', nB', nco and 'D" from Ehe above described 269.9 acre tract ishereby exempted from such definitions and said Lract may be divided intosaid parcels 'An, 'Bo, "C' and 'Dn and may be conveyed in the form ofsuch parcels nA', 'Bn, nCn and "Dn, alt as is more ful1y described aboveand that a copy of the instrument or instruments of conveyance whenrecorded shall be filed with this Resolution.
