Dear Mr. and Mrs. McCormick:
0n August 10, 1981, the Garfield County Board of Commissioners
gave tentative approval to your Senate Bil'l 35 Exemption requestto split a 40 acre tract into 2 parcels of 2 acres and 38 acres.each. The Iegal description for the 2 acres was to be submitted
by December 10, 1981. 0n Decentber 15, 1981, you requested a six
month extension of the submittal time. That deadline expired
June 10, 1982.
You now have until July 31, 1982 to submit the required information
or your exemption will be declared null and void. The items that
need to be submitted are as follows:
1. Lega'l description for two-acre tract2. Results of an 8 hour pump test to show 5 gpm per household;3. Conveyance of 1/3 interest in your domestic well (to be
included in lega'l description) I4. A description of the maintenance easement to the commonwell, to be included in the 1egal description;5. $200.00 school assessment fee.

Dear Ms. Bowman:
We have received the above referenced proposal asklng if well per-
mlts can be lssued in this area. The applicants have 40 acres and would
l1ke to give two acres to thetr son. A house and well extst on the 40 acres.
An additional well i.s sought for the two acre tract.
Our recotds lndlcate permit +116450 was lssued to Glen McCormlck
on September 30, 1980 for a domestlc well as the only well on thls 40 acres.
Thls permit has been tssued as a domesttc wetl although the appllcant has
indicated there will be no irrigation. No record of drilling or statement of
beneflcial use has been returned.
The condltion on the above permtt "as the only well on a tract of 35
acres or more designated as 40 acres. . . " restricts this offtce's ablIlty
to [ssue additi.onal permits.
We would recommend the two acre parcel be served by the extsting well
through a pLpeline. This would be an allowable use of the domestlc well. We
can recommend approval of this proposal tf the existLng well serves the two
acre parcel and provided an agreement ts developed for jotnt ownerstflp, ease-
ments, and the distrlbutlon of operatton and matntenance costs. Such an
agreement should extst as a covenant blnding future owners of each lot.
