Abplanalp, Jr. Nancy Sprick Page, Deputy when the following proceedings, among others were had and done, to -wit: Commissioner Commissioner County Attorney Clerk of the Board RESOLUTION NO. 80-14 RESOLUTION CONCERNED' WITH GRANTING AN EXEMPTION FROM THE GARFLELD'COUNTY` SUBDIVISION REGULATIONS WHEREAS, The Rifle Moose Lodge No. 1345 has petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption from the definition of the terms "subdivision" and "subdivided land" under C.R.S. 1973, 30-28-101 (10) (a)-(d), as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted January 2, 1979, Sections 2.02.21 (d) and 3.02.01 for the division of a 5.20 acre tract described as follows: that parcel of land as described in Docu- ment No. 296607 as filed in the Office of the Clerk and Recorder of Garfield County, Colorado into 2 tracts of approximately 2.0 and 3.2 acres each, more or less, which proposed tract is more particularly described as follows: Tract A: A parcel of land situated in Lot 6, Section 16, Township 6 South, Range 93 West of the 6th Principal Meridian. Lying South- erly and Westerly of the existing fences as in place of this date. Said parcel of land being part of that Document No. 269579 as recorded in the Clerk and Recorders Office, Garfield County, Colorado and more. particularly described as follows: Beginning at the South 1/4 Corner of said Section 16, an iron post with a Brass Cap marked and set by the Garfield County Surveyor; thence West 229.28 feet to the True Point of Beginning, said point being on that line as described on Document No. 269579; thence West 276.72 feet; thence North, 367.50 feet; thence East, 193.76 feet to a point on the Westerly line of a tract of land described in Rec. No. 283013 of the Garfield County Clerk and Recorders Office; thence S.13°13'06"E., 274.76 feet along the Westerly line of those tracts of land described on Rec. Numbers 283013 and 282972 of the Garfield County Clerk and Recorders Office; thence along said Westerly line of Rec. No. 282972 S.17°48'13"E., 68.10 feet; thence continuing along said Westerly line S.01°07'06"W., 35.19 feet to the True Point of Beginning, said parcel of land containing 2.00 acres more or less. Tract "A" is located in the State of Colorado and County of Garfield; WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that the proposed division does not fall within the purposes of Part 1, Article 28, Title 30, Colorado Revised Statutes 1973, as amended, for the reason that the impact created is. not sufficient to proceed through the full subdivision review, and; WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that there is a reason- able probability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks .: will he permitted by the Colorado Department of Health, that the requested division is not part of an existing or larger development and does not fall within the general purposes and intent of the subdivision regulations of the State of Colorado and the County of Garfield, and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. 1973, 30-28-101 (10) (a)-(d), as amended; NOW, THEREFORE, BE IT RESOLVED that the division of the above described ract`:;A_ ..from the "above .:describe d;.5:2 acre tract is hereby exempted from such. definitions.and"said tract`. may be divided into tract "A", allasis more fully. described above, and said divided tract may be conveyed in the form ofsuch smaller tracts without further compliance with theaforesaid subdivision statutes.: and regulations; provided, however, that this exemption is granted on the condi- tion and with the express understanding and agreement of the Petitioner that no_.`::. further exemptions be allowed on said tract "A", and that a copy of the instrument. or instrurnents of conveyance when recorded shall be filed with this Resolution:-_: Adopted .the ATTEST; i' Glivi Ca/ 7d Deputy Cl the Board, of County Commissioners.
