At a meeting of the Board of County Commissioners for Garfield County, Colorado,
held at the Court House in Glenwood Springs on Monday , the .2.3.td day of

RESOLUTION NO. 82-225
A RESOLUTION CONCERNED WITH THE APPROVAL OF THE PRELIMINARY -PLAN OF RIFLE:`:CREEK
RANCH SUBDIVISION.
WHEREAS, Ann Catherine Robinson has filed an application with the Board of
County Commissioners of Garfield County for approval of a Preliminary Plan in -
the Agricultrual/Residential/Rural Density Zone District; and,
WHEREAS, based on the material submitted by the applicant and the comments of
the Garfield County Planning Department, this Board finds as follows
1. That proper posting, publication, and public notice was provided as
required by law for the hearing before .the Planning Commission.
2. That the hearing before the Planning Commission was extensive and complete,
that all pertinent facts, matters, and issues were submitted and that -all interested
parties were heard at that hearing.
3. That the Garfield County Planning Commission recommended approval of the Pre-
liminary Plan.
-4. That the proposed subdivision of land is in compliance with the recommendations
set ,forth'in the Comprehensive Plan for the unincorporated are4 of the -county.
5. That all data, surveys, analyses, plans, studies, and designs as are required
by the Sts'te of Colorado and Garfield County have been submitted, reviewed, and found
to meet all noun d planning and engineering requirements of the Garfield County Sub-
division Regulations.
6,. That the proposed subdivision of° -land conforms to the Garfield County Zoning
Resolution.
7. That for the above --stated and other reasons, the proposed subdivision is in
the best interest of the health, safety, morals, convenience, orider, proposerity, and
welfare ofthe citizens of _Garfield County.
NOW, THEREFORE, BE IT RESOLVED that the Preliminary Plan of Rifle Creek Ranch Sub-
division for the following described unincorporated area of Garfield County be approved
with the following conditions:
1. A note be placed on the plat that all lots will access' off of internal
subdivision roads and not directly off the State Highway 325.
2. A note be placed on the plat that all sewage disposal systems will be designed
by a registered professional engineer.
3. A note be placed on the plat indicating that evapotranspiration sewage disposal
systems are not permitted due to the:. conditions of the water augmentation plan.
4. The developer address the floodplain situation with the State Engineer prior to
Final Plat.
5. The well: permits_ be amended and water system details be clarified per the
State Engineer's letter prior to Final Plat approval.
6. Building envelopes be designated on the Final Plat.
7. Utility easements be approved by the utility companies prior to Final Plat.
8.- The construction costs of the acceleration/deceleration lanes, as required by
the State Highway Department, shall be included in the Subdivision Improvements Agree-
ment.'
9. The results of the water quality tests for the wells shall be provided at Final
Plat together with attendant recommendations from.the.°State Health Department to alleviate
any adverse water quality concerns. The costs of any water improvements required to
implement the mitigation provision shall be included in the Subdivision Improvements
Agreement.
10. The applicant shall provide detailed design and site survey information for that'
portion of Ridge Road that exceeds 8% grade. The applicant shall present 2 alternatives_
at the Final Plat showing the design and environmental impacts of the road as proposed
on the Preliminary Plat and:a road"d.esign not exceeding 8% to be approved by the
Planning Commission at Final Plat.

LEGAL DESCRIPTION:
A parcel of land situated in Lots 3 and 4 of Section 19, Township 5 South,
Range 92 West of the Sixth Principal Meridian, Garfield County, Colorado,
lying partly Westerly of the Westerly right-of-way line of Colorado State.
Highway No. 325 and Northerly of the Rifle Creek Estates Subdivision as
platted and filed in the Garfield County, Colorado records, said parcel
of land is more fully described as follows:
Beginning at the Southwest Corner of said Section 19; thence N.00`03'29"W.
1326.01 feet along the West line of said Lot 4; thence N.00°04'59"W. along
the West lire of said Lot 3, 1325.71 feet to the West Quarter Corner,)of:lsaiid
Section 19: thence S.89°56.'43"E. along the East-West Centerline of said
Section 19, 1350.44 feet to the Northeast Corner of said Lot 3; thence S.00°

S -.08°47.'16"E. 217.03 feet; thence S.06°04'04"E. 96.47 feet; thence 113.99
feet along the .arc of a curve to the left, having azadius of 1544.378 feet, the
chord of which bears: S.08°10'56"E. 113.96 feet; thence 192.85 feet along
the arc of 'a -curve to, the right, having a radius of 905.359 feet; the
chord of which bears: S.04°11'40"E. 192.49 feet; thence S:01°54'29"W.
787.55 feet to a point on the South l'ne.of said Section 19; thence
5.89°50'02"W: along the Northerly line of said Rifle Creek Estates.'
Subdivision, 565.98 feet to the point of beginning, containing 48.22
acres, more or Less.
