At a regular meeting of the Board of County Commissioners for Garfield County,
Colorado, held in the Commissioners' Meeting Room, Gaifield County Courthouse, in Glenwood
Springs on Monday , the 4th of April - A.D. 19 94 , there were present:

when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 94-030
A RESOLUTION CONCERNED WITH THE APPROVAL OF A CONDITIONAL USE PERMIT
APPLICATION BY CARBONDALE AND RURAL FIRE PROTECTION DISTRICT
(MICHAEL STRANG).
WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received
application from CARBONDALE AND RURAL FIRE PROTECTION DISTRICT For a
Community Building (Fire Substation) on the following described tract of land:
see attached
(in the State of Colorado and the County of Garfield); and
WHEREAS, the Board held a public meeting on the 21st day of March, 1994, upon the
question of whether the above-described Conditional Use Permit should be granted or denied, at which
meeting the public and interested persons were given the opportunity to express their opinions
regarding the issuance of said Conditional Use Permit; and
WHEREAS, the Board on the basis of substantial competent evidence produced at the
aforementioned meeting, has made the following determination of fact:
1. That the meeting before the Board of County Commissioners ;vas extensive and
complete, that all pertinent facts, matters and issues were submitted and that all
interested parties were heard at that meeting.
2. That the application is in compliance with the Garfield County Zoning Resolution of
1978, as amended.
3. For the above stated and other reasons, the proposed use is in the best interest of the
health, safety, morals, convenience, order, prosperity and welfare of the citizens of
Garfield County.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
County, Colorado, that the Conditional Use Permit be and hereby is authorized permitting the use of
the above described tract of land for a Community Building upon the following specific conditions:
I . All representations of the applicant, either contained in the application or stated at the
public meeting, shall be considered conditions of approval unless stated otherwise.
2. No residential or public meeting use of the structure shall be permitted until an
approved water supply is submitted to the Garfield County Planning Department.
3. Wildfire prevention guidelines shall be followed in the construction of all buildings.
4. Any expansion or modification of the Community Building shall require the applicant
to file a new Conditional Use Permit application.
5. Prior to final issuance of a Conditional Use Permit, the District must obtain a driveway
permit from Garfield County Road and Bridge Department.

BEGINNING AT A POINT FROM WHICH THE WEST ONE-QUARTER CORNER OF
SECTION 17, T.7S., R.87W. OF THE SIXTH P.M., BEARS N. 68 05'33" E.,
1,180.16'; THENCE N. 71 56'51" W., 228.69' TO A POINT OF CURVE ON THE
EASTERLY R.O.W. LINE OF COUNTY RD. 100; THENCE SOUTHERLY ALONG
THE ARC OF SAID CURVE, THE CORD OF WHICH BEARS S. 09 53' 14" E.,99.74',
