Application Requirements: These items must be submitted with the application
l] Plans and specifications for the proposed use including the hours of operation, the amount of vehicles
accessing the site on a daily, weekly and/or monthly basis, and the size of any existing or proposed
structures that will be utilized in conjunction with the proposed use. Please submit this information
in narrative form and be specific.
2] If you will be using water or will be treating wastewater in conjunction with the proposed use, please
detail the amount of water that would be used and the type of wastewater treatment. If you will be
utilizing well water, please attach a copy of the appropriate well permit and any other legal water
supply information, including a water allotment contract or an approved water augmentation plan.
3] A map drawn to scale portraying your property, all structures on the property, and the County or State
roadways within one (l) mile of your property. If you are proposing a new or expanded access onto
a County or State roadway, submit a driveway or highway access permit.
4] A vicinity map, sho,ving slope of your property, for which a U.S.G.S. 1 :24,000 scale quadrangle map
will suffice.
5] A copy of the appropriate portion of a Garfield County Assessor's Map showing all public and private
landowners adjacent to your property. Include a list of all property owners and their addresses.
6] Attach a copy of the deed and a legal description of the property. If you are acting as an agent for the
property owner, you must attach an acknowledgment from the property owner that you may act in
his/her behalf
7] For all applications pertaining to airports, the oil and gas industry, power generation and/or
transmission industry, or any other classified industrial operation, you must submit an impact
statement consistent with the requirements of Sections 5.03, paragraphs 1 thru 3; 5.03.07, inclusive;
and 5.03.08, inclusive.
The consideration of this proposed Special Use will require at least one (l) public hearing, for which public
notice must be provided. The Planning Department will mail you information concerning this hearing(s),
approximately 30 days prior to the scheduled hearing. You will then be required to notify, by certified return
receipt mail, all adjacent landowners and publish the notice provided by the Planning Department, in a
newspaper of general circulation. Both these notices must be mailed/published at least 15 days prior to the
public hearing. The applicant shall bear the cost of mailing and publication and proof of mailing and
publication must be submitted at the time of the public hearing.

Dear Sirs;
This letter is to serve as a description of the proposed
Special Use for the Byrnes Property. The Byrnes's would like to
finish the existing space above the barn which was originally
designed for a Caretaker Unit. The unit is presently wired and
drywalled but does not have any plumbing. The Caretaker unit would
consist of a one bedroom apartment with a bathroom, kitchen,
laundry, and living room. The existing space is 15 ft. x 60 ft.
900 sq.ft.
The intent of the Unit would be to provide housing for one or
two local persons who would assist with chores about the Ranch.
The property has an existing augmentation plan for the well
which allows for a single family home and a caretaker unit.
The subdivision covenants allow for a single family home and
a caretaker unit.
Enclosed please find a vicinity map, a list of adjacent
property owners, a plat of the property, an architectural drawing
of the caretaker unit, and the augmentation plan and well permit.

1) This well shall be used in such a way as to cause no material Injury to existing water rights. The Issuance of the
permit does not assure the applicant that no Injury wlll occur to another vested water right or preclude another
owner of a vested water right from seeking relief In a civil court action.
2) The construction of this well shall be In compliance with the Water Well Construction and Pump Installation Rules
2 CCR 402-2, unless approval of a variance has been granted by the Stat~ Board of Examiners of Water Well
Construction and Pump Installation Contractors In accordance with Rule 17.
3) Approved pursuant to CRS 37-92-602(3)(b)(ll)(A) and case 92CW109 for the Bob Well No. 3 as the only weil on
a tract of land of 35 acres described as that portion of the W1/2 of Sec. 18, Twp. 7 South, Rng. 87 West of the 6th
P.M., Garfield County, being more particularly described on the attached exhi bit "A". This structure was previously
permitted under file 165451 (expired).
4) The use of ground water from this well is limited to fire protection, ordinary household purposes inside two (2)
s ingle family dwellings, the irrigation of not more than one (1) acre of home gardens and lawns and the wat eri ng
of domestic animals.
5) The maximum pumping rate shall not exceed 15 GPM.
6) The return flow from the use of this well must be through an individual waste water disposal system of the
non-evaporative type where the water is returned to the same stream system in which the well is located.
7) This well shall be constructed not more than 200 feet from the location specified for the Bob Well No. 3 In case

4. Statement of Pl.an for Augmentation.
(a) General description of development.
Applicants own two separate residential parcels of
approximately 17.5 acres each, situated about two miles northeast
of Carbondale. Each parcel will contain one single family
residence, plus one accessory unit.
(b) Water regu.j,rements and supply.
The water requirements (in terms of total monthly demand and
consumptive use) for in-house domestic uses, stock watering for up
to lO horses and outside lawn and landscape sprinkler irrigation of
up to a total of 12,000 square feet are reflected on the attached
table (Exhibit A), which shows the monthly demand and consumptive
use (including a 5% transit loss) from the well covered by the 0.90
annual acre feet of water contracted for from the District in the
event of a call. Additionally, applicants each own 10 shares of
Missouri Heights Irrigation Company, which they use for regular
paeture irrigation on their parcels, The water supply for the
applicants will come from the Bob Well No. 3, mentioned above. In
the event that the Bob Well No. 3 would ever be out-of-priority
with respect to senior calls on the Roaring Fork River, or any cf
it's tributaries er the Colorado River, applicants' diversions will
be covered by the Ruedi Reservoir releases, mentioned above,
5. There was no oppo15ition to the proposed plan filed by e111y
other affected owners of vested, decreed water rights. The proposed
plan meets the statutory criteria for a plan for augmentation set
forth in the statute and, if operated in accordance with the terms
and conditions of this Ruling, will not injuriously affect the
owner of or persons entitled to the use of water under a vested
water right or decreed conditional water right.
The application for the plan for augmentation contained herein
is hereby approved and the operation thereof shall be conducted in
a manner pursuant with the terms and conditions of this Ruling, and
it is further ordered that the decree herein supercedes the
previous decree for exempt, domestic well in 92CW109, which is
hereby vacated in order that the underground water right for the
Bob Well No. 3 be amended to conform to the terms and conditions of
the plan for augmentation approved and decreed herein.
It is accordingly ORDERED that this Ruling shall be filed with
the Water Clerk, subject to Judicial Review.

This letter is to describe the nature of the work proposed for
the Byrnes Residence at 7205 County Road 100.
We would like to finish the existing Accessory Dwelling Unit
which exists above the barn. The barn exists and is build according
to the existing plans. The ADU is presently wired, and drywalled,
but has no plumbing. I understand that we will have to bring
everything up to code and add a new septic field and tank for the
ADU. We would also like to add a toilet and sink downstairs in the
barn onto the system.
