CommissionerLarn, McCown , Commissioner Caroiyn Dahlgren , Deputy County Attorney Jean Alberico , Clerk of the BoaLrd , County Manager and done. to-wit: Ed Green when the foliowing proceedings, among others were had RESOLUTION NO. 2oo7 -43 A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT FOR AN ACCESSORY DWELLING UNIT FOR A PROPERTY OWNED BY RANCHO TRIO.EL.IEBEL, LLC, GARFIELD COUNTY PARCEL N O# 2 39 I 3 _1 3000 I 6 WHEREAS, the Board of County Commissioners of Garfield County, Colorado ("Board"), has received an application from Rancho Trio-El Jebe1. LLC for a Special Use Permit ("SUp,') to allow an Accessory Dwelling Unit on their properry within the ARRD (A,ericulturat Residential Rural Density) zone district; and, WHBREAS, the Board heid a public hearing on the 21't day of May. 2OO7 ,upon rhe question of whether the above described SUP should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions concerning the approval of said special use permit; and, WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the foilowing determination of fact as listed bejow: 1. That proper public notice was provided as required for the hearing before the Board of County Commissioners. 2. That for the above stated and other reasons, the proposed Special Use Permit is in the best interest of the health. safet1,, convenience. order. prospenty and welfare of the crtizens of (:--f,^1A /-nrrntrzv4alrvru uvulrL Y. 4. That the application is in conformance with the Garfield County ZontngResolution of 1978, as amended. NOW TIIEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado. that Special Use Permit for an Accessory Dwelling Unit for a propefry owned by Rancho Trio-El Jebei. LLC is hereby approved subject to compliance with all of the following specific conditions: All representations of the applicant, either within the application or stated at the hearin_s before the Board of County Commissioners, shall be considered conditions of approval unless otherwise modified by the Board. All lighting associated with the ADU shall be the minimum amount necessary. All exterior lighting shall be shielded to prevent light trespass on any adjoining property and be downward facing towards the structure. The applicant shall obtain any applicable Garfield County gradin-e permits and Coiorado Department of Transportation access permits. 4. The Applicant shall meet all requirements of the Garfield County Zoning Resolution of 1978. as amended, and shal1 meet all building code requirements. 5. The gross floor area of the accessory dwelling unit shall not exceed 1,500 square feet. 6. The accessory dwelling unit shall not be conveyed as a separate interest but may be leased. Prior to the issuance of a building permit for the primary dwelling unit, the Applicant shall submit a noxious weed inventory including a managernent plan for the identified noxious weeds to the Building and Planning Department. Prior to issuance of the building permit for the primary dwelling unit, the Applicant sha1l obtain a well permit with sufficient rights and quantity to provide for the new unit. 9.
