At a regular meeting of the Board of County Commissioners for Garfield County' Colorado'
held inthe Commissioners'Mecting Room, Ctarnefa County Courthouse' in Glenwood Springs on'
Monday, the 196 day of May A'D' 2008, there were present:

WHEREAS, the Board of county commissioners of Garfield county, colorado ("Board")'
ha-s received an application tom Cuty uni 6slie Joch,m for a Special Use Permit ("51-';rp") to allow
an Accessory Dwelling unit on their property within the ARRD (Agriculnral/Residential'IRural
Density) zone district; and,
WHEREAS, the Board held a public hearing on the 19th day of May, 2008, upon the
question of whether m"-uU*. describei SUP shouldt granted or denied' at which hearing the
public and interestea perrons were given the opportunity to express their opinions concerning the
approvat of said special use permit; and,
WHEREAS,theBoardonthebasisofsubstantialcomPot€ntevidenceproducedatthe
aforemeltion"a n"*i"g, nas made the following determination of fact as listed below:
1. That proper public notice was provided as required for the hearing before the Board of
County Commissioners.
2. That the hearing before the Board of County Commissioners was extensive and complete'

that all pertinent facts, matters and issues were submitted and that all interested parties were heard at
that meeting.
3. That for the above stated atrd other reasons, the proposed Special Use Permit is in the best
interest of the healt\ safety, convenience, order, prosperity and welfare of the citizens of Garfield
County.
4. That tbe application is in confonnance with the Garfietd County 7-oningResolution of 1978,
as amended.
NOW THEREFORE, BE IT RESOLVED by the Board of county commissioners of Garfield
County, Colorado, fhat Special Use Permit for an Accessory Dwelling Unit for a property owned by
Gary *a tslie Jochum is hereby approved subj ect to complia.nce with all of the following specific
conditions:
L All representations of the applican! either within the application or stated at the hearing
before the Board of Counry bommissioners, shall be considered conditions of approval
unless otherwise modified by the Board'
2. All lighting associared with the ADU shall be the minimum amount necessary. All
exterior [gf,ting shall be shielded to prevent light tespass on any adjoining property and
be downward facing towards the stn:cture'
3. The applicant shall obtain any applicable Garfield County building permits, grading
permits and access Permits.
4. The Applicant shall meet all requirements of the Garfield County ZnfugResolution of
1978, as asrended, and shall meet all 6uil.Iing code reguirements.
5. The gross floor area of tle accessory dwetling unit shall not exceed 1,500 square feet.
6. The accessory dwelling unit shall not be conveyed as a separate interest but may be
leased.
