Plans and specifications for the proposed use including the hours of operation, the amount of vehicles
accessing the site on a daily, weekly and/or monthly basis, and the size of any existing or proposed
structures that will be utilized in conjunction with the proposed use. Please submit tlus information
in narrative form and be specific.
If you wrll be using water or will be treating wastewater in conjunction with the proposed use, please
detail the amount of water that would be used and the tvpe of wastewater treatrnent. [f you will be
utilizing well water, please atiach a copy of the appropriate well permit and any other legal water
supply information, including a water allotnent contract or an approved water augmentation plan.

statement consistent with the requirements of Sections 5.03, paragraphs I thru 3; 5.03.07, inclusive;

rvill be a trvo bedroom single family modular home. A septic system to meet county
approval and standards. After special use permit if approved, I will submit on a septic
system. Holet'er, all requirements for placement of the septic system have been

Dear Don:
As you know, I represent the Carbondale Land Development Corporation. I was
approached by Tom Zancanella, on behalf of Ed Johnson, who requested that I provide you with
my opinion regarding the water rights appurtenant to Mr. Johnson's parcel. Based upon the
records of the Carbondale Land Development Corporation, and other recorded documents which
I have reviewed, I believe Mr. Johnson owns the Morris Well No. 1, adjudicated in Case No.
79CW68 (Water Division No. 5), which well is augmented in Case No- 79CW97. Mr. Johnson
also owns 0.3 acre-feet of augmentation water associated with the Park Ditch water rights, more
fully outlined in Case No- 79CW97. This amount of water is sufficient to serve the proposed
accessory dwelling unit being requested by Mr. Johnson.
This letter is written solely on behalf of the Carbondale Land Development Corporation
and is provided for informational purposes only to the County. If you have any questions, please

I am writing on behalf of Ed Johnson to provide the Couffy with a legai opinion regarding
the water supply for the three properties in the Sharpe Subdivision Exemption. In 1977, the
Counry approved the John A. Sharp and Joan French Subdivision Exemption by Resolution No.
77-lM. We have reviewed the water supply for each of the three properties and can advise you
that each property has a well permit based upon an augmentation plan, and that none of the parcels
have a right to use water on any of the other parcels. Enclosed is a copy of a chain of title for
each of the lots, showing that each lot has its own legal water supply. As I have previously
advised you, Mr. Johruon's water supply is adequate to serve an additional accessorl'dwelling
unit.

WHEREAS, Joft A. SHARP and JoAN FRENCH, have petitioned the Board of County
Conmissioners of Garfield County, Colorado, for an exemption under C.R.S. (.|973)
Section 30-28-l0l (10) (a) - (d) as amended, and the Subdivjsion Regulations of
Garfield County, Colorado, adopted September 1,1972 and amended April 14,1975,
Sections 1.02.t7 (d) and 3.02.01, for the division of a 43 acre tract into three

the general purposes and intent of the subdivision Regulations of the state of

definition of the terms "subdivision" and "subdivided land" as set forth in
